RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CYPRESS
RECOMMENDING APPROVAL OF AMENDMENT TO THE ZONING ORDINANCE
NO 90, SECTION 111 2 "PERMITTED BUILDINGS AND USES'
WHEREAS the Cypress City Planning Commission held a public hearing
on August 20, 1964 at 7 30 p m in the Council Chambers,9471 South Walker
Street, Cypress, California, to consider an amendment to the Zoning Ordinance
No 90, Section 111.2 by amending subsection "F" and "0" as follows*
'F Eating places, not to exceed seating capacity for thirty
(30) persons - drive-ins or walk-ups, subject to a Conditional
Use Permit, no sale of alcohiic beverages permitted
b; Suburban service stations '
WHEREASno one appeared in favor of the proposed amendment and no
protests were heard, and,
WHEREAS the Planning Commission determined that suburban service
stations are compatible in the C-1 zone and that walk-up or drive-in
eating places might be allowed in some C-1 areas,
NOW THEREFORE BE IT RESOLVED that the proposed amendment to Zoning
Ordinance No 90, Section 111 2 regarding 'Permitted Buildings and Uses'
be recommended for approval by the City Council

SECTIONS 112 2, 113 2 and 114 2 "PERMITTED BUILDINGS AND USES"
WHEREAS the Cypress City Planning Commission held a public hearing
on August 20, 1964 at 7:30 p m in the Council Chambers 9471 South Wacker
Street Cypress California to consider an amendment to the Zoning Ordinance
No 90, Sections 112 2, 113 2 and 114 2 by amending these sections to
read as follows
"Section 112.2 PERMITTED BUILDINGS AND USES. Only the following
buildings, structures, and uses, either singly or in combination, are
permitted in a community shopping center. All uses except newsstands,
off-street parking, electric distribution substations, and nurseries,
shall be in an entirely enclosed building unless a Conditional Use
Permit is obtained No uses shall be permitted hereunder which include
the service of alcoholic beverages unless a Conditional Use Permit
approved by the City Council is obtained therefor No building or structure
shall be erected, structurally altered, or enlarged except for the
following purposes,
"Section 113.2 PERMITTED BUILDINGS AND USES. Only the following
buildings, structures, and uses, either singly or in combination, are
permitted in a Central Commercial Zone All uses, except newsstands
and electric distribution substations shall be in an entirely enclosed
building, unless a Conditional Use Permit is obtained therefor No uses
shall be permitted hereunder which include the service of alcoholic
beverages unless a Conditional Use Permit approved by the City Council is
obtained therefor No building or structure shall be erected, structurally
altered or enlarged except for the following purposes
"Section 114.2 PERMITTED BUILDINGS AND USES: Only the following
buildings, structures, and uses either singly or in combination, are
permitted in the H -C, Highway Commercial Zone No uses shall be
permitted hereunder which include the service of alcoholic beverages
unless a Conditional Use Permit approved by the City Council is obtained
therefor No buildings or structures shall be erected, structurally
altered, or enlarged except for the following purposes.
WHEREAS no one appeared in favor of the proposed amendment, one inquiry
was made, and no protests were heard, and,
WHEREAS the. Planning Commission determined that establishments which
serve alcoholic beverages should be permitted only after review of the
Council,
NOW THEREFORE BE IT RESOLVED that the proposed amendment to Zoning
Ordinance No 90 Sections 112 2, 113 2 and 114 2, regarding "Permitted
Buildings and Uses" be recommended for approval by the City Council

WHEREAS the Cypress City Planning Commission held a public hearing
on August 20, 1964 at 7.30 P M in the Council Chambers, 9471 South Walker
Street, Cypress, California to consider an amendment to the Zoning
Ordinance No. 90, Section 114.7, Subsection A, 1 by amending this
subsection to read as follows
"A Front Yard
1 Each lot in the H -C Zone shall have a front yard
extending except for access drives and walks, across
the full width of the subject property, of a depth of
not less than five (5) feet In the case of a corner
lot, also a yard meet ng the same requirements, along
the abutting side street. Such yards shall be landscaped
and permanently maintained as a condition to the use of
the property "
WHEREAS no one appeared in favor of the proposed amendment and no
protests were heard, and,
WHEREAS the Planning Commission determined that the front yard could
be reduced since this zone is intended for highway use and will not require
deep yards,

Ordinance No 90, Section 121 2, Subsection A, paragraph three (3) by
amending said section to read as follows:

Ordinance No 90 Section 121 4, amending said section by adding the
following.

Marking of Spaces: All parking spaces shall be
permanently striped and maintained to designate
parking stalls "

WHEREAS the Cypress City Planning Commission held a public hearing
on August 20, 1964 at 7:30 P.M. in the Council Chambers, 9471 South Walker
Street, Cypress, California, to consider an amendment to the Zoning Ordinance
No 90, Part 21, "Off -Street Parking Requirements", amending said Part 21
by adding Section 121 6 to read as follows:
"Section 121 6 PAVING OF EXISTING LOTS. All parking lots that are
now in existence, but are not improved, shall be deemed to be
non -conforming Such lots shall be paved to the specifications of the
City of Cypress within eighteen (18) months.
WHEREAS no one appeared in favor of the proposed amendment, one inquiry
was made, and no protest were heard, and,
WHEREAS the Planning Commission determined that paved lots are necessary
for the safety of the community and encourage good development of commercial
property,
NOW THEREFORE BE IT RESOLVED that the proposed amendment to the

WHEREAS the Cypress City Planning Commission held a public hearing
on August 20, 1964 at 7.30 P.M in the Council Chambers, 9471 South Walker
Street, Cypress, California, to consider an amendment to the Zoning Ordinance
No 90, Section 125 8, paragraph one (1), amending said section to read as
follows:
"Section 125 8 WALL, FENCE, OR HEDGE MAY BE MAINTAINED: In any
"R" Zone a wall, fence, or hedge, three (3) feet in height may be
located and maintained on any part of a lot On an interior lot
a wall, fence, or hedge not more than six (6) feet in height may be
located anywhere on the lot to the rear of the required front yard
setback line On corner lots and reverse corner lots, a six (6)
foot fence may be located anywhere on the lot except in those areas
comprising the required front yard or the required side yards on the
side street side of such lots No barbed wire, or any fence containing

hearing on August 20, 1964 at 7:30 p m in the Council Chambers, 9471
South Walker Street, Cypress, California, to consider a proposed
amendment to the Zoning Ordinance No 90 by adding Section 125 22 to
read as follows.
"Section 125.22 MULTIPLE PARKING AREAS. Open parking areas
required for the R-2, 3, and 4 districts may be located within
any required side or rear yard provided the total requirement
for all off-street parking shall exceed 4 spaces. All open
parking areas in a required side or rear yard shall be enclosed
by a 6' solid fence."
WHEREAS no one appeared in favor of the proposed amendment and no
protests were heard, and,
WHEREAS the Planning Commission determined that the side yard
can be used for light and ventilation even if cars are parked in
the required yards,
NOW THEREFORE BE IT RESOLVED that the proposed amendment to

(CITY OF CYPRESS)
WHEREAS the Cypress City Planning Commission held a public hearing
on September 17, 1964 at 7:30 p m in the Council Chambers, 9471 South
Walker Street, Cypress, California, to consider an application for
amendment to the Zoning Ordinance to change the zone from R-1 (One -family
Residential) to C-1 (Neighborhood Stores) or C-2 (General Commercial)
on property generally located at the northwest corner of Walker and
Cerritos, initiated by the City of Cypress, known as Zone Change
No Z-114 (Amended), and,
WHEREAS one person appeared in favor of the C-2 zoning, no one
appeared in favor of the C-1 zoning, and no protests were heard, and,
WHEREAS the Planning Commission determined that uses permitted in
the C-2 zone would not be detrimental to the area if the landscaping
plan were approved by the staff and the traffic problem solved, but would
benefit the surrounding residential areas,
NOW THEREFORE BE IT RESOLVED that approval of Zone Change No Z-114
(Amended) be recommended to the City Council to change the zone from
R-1 (One -family Residential) to C-2 (General Commercial).

DENYING VARIANCE NO V-196 (TEXACO OIL CORPORATION)
WHEREAS the Cypress City Planning Commission held a public hearing
on September 3, 1964 at 7.30 P.M. in the Council Chambers, 9471 South Walker
Street, Cypress, California, to consider an application for variance to permit
the installation of a non -conforming ground sign exceeding the height limitations
of the Sign Ordinance No 185, requested by Texaco Oil Corporation, 2100 E
Parific Coast Highway, Wilmington, California, known as Variance No V-196, and,
WHEREAS two people appeared in favor and no protests were heard, and,
WHEREAS the Planning Commission determined there was no deprivation of
property use, there was only one other sign in the area that exceeded
the height limitation, and the size and shape of the property did not justify
the granting of such a variance,
NOW THEREFORE BE IT RESOLVED that Variance No V-196 be denied for
the reasons previously stated above

WHEREAS the Cypress City Planning Commission held a public hearing
on October 15, 1964 at 7.30 P M in the Council Chambers, 9471 South Walker
Street, Cypress, California, to consider an application for amendment to
the Zoning Ordinance to change the zone from R-1 (One -Family Residential)
to C-1 (Neighborhood Stores) or C-2 (General Commercial) on property
generally located on the southwest corner of Knott Avenue and Cerritos
Avenue, requested by Stanley H. Ritter, 15300 Ventura Blvd., Sherman Oaks,
California, known as Zone Change No. Z-119, and,
WHEREAS two people appeared in favor of the request and one protest
was heard, and,
WHEREAS the Planning Commission determined that the property could not
logically be developed for single-family use and the normal zoning for
a service station use should be C-1 rather than C-2 since the C-2 allows
much heavier uses,

C-2 (General Commercial) on property generally located at the northeast
corner of Ball Road and Bloomfield Street, requested by Augustine G Garcia,

No. 90, Section 121.4 by adding Subsection "E Striping", initiated by the

would be in the best interest of the city by providing for orderly and
safe loading or unloading of passengers, parking and storage of vehicles,

WHEREAS the Cypress City Planning Commission held a public hearing
on October 15, 1964 at 7.30 p.m. in the Council Chambers, 9471 South
Walker Street, Cypress, California, to consider an amendment to the Zoning
Ordinance No 90, Section 107 6 B, paragraph 2, initiated by the City of
Cypress, and,
WHEREAS no one appeared in favor of the proposed amendment and no
protests were heard, and,
WHEREAS the Planning Commission determined that the rear of the lots
can be increased by requiring a larger side yard on a corner lot, which is
necessary if a fence is constructed according to existing provisions of the
Ordinance.
NOW THEREFORE BE IT RESOLVED that the Commission re -affirm their previous

WHEREAS the Cypress City Planning Commission held a public hearing
on Thursday, December 17, 1964 at 7:30 p m in the Council Chambers,
5311 Orange Avenue, Cypress, California, to consider an application for
conditional use permit to allow the construction of a drive-in theater
and related concession on property generally located at the southeast corner
of Lincoln and Bloomfield, as requested by Guy J. Tedesco, 1104 E Marcelle,
Compton, and B W Wright, 3109 Volk Ave., Long Beach, known as Conditional

WHEREAS one person appeared in favor of the request and three protests

purposes shall be enclosed by a fence, wall, or structure used as a wall, of
not less than six (6) feet in height.
Section 118-A.7 PARKING: There shall be provided and maintained
usable automobile parking spaces equal to the sum of the following.
A. One (1) parking space for each three (3) persons, employed,
B. One (1) parking space for each three (3) seats in any church or
chapel, and
C. One (1) parking space for each three hundred fifty (350) square
feet of floor space used for retail sales of services or
commodities

Section 118-A.8 STREET DEDICATIONS AND IMPROVEMENTS REQUIRED -
Anticipating that changes will occur in the local neighborhood and the City
generally due to the increase in vehicular traffic, including trucking,
increase in pedestrian traffic, increased noise, and other activities
associated with the City's growth and development, the following dedications
and improvements are deemed to be necessary to prevent congestion of the
land, and these requirements must be met or complied with before any building
permit may be issued:
A. All required streets and alleys, both local and highways,
which abut the subject property shall be dedicated, or a
deed of dedication deposited in escrow with an escrow agent
acceptable to the City Attorney, the delivery of which is
conditioned upon the requested permit being granted, to the
full width required by this Ordinance on the side of the
Street highway, or alley abutting such property.
B. All street, highway and alley improvements shall have either
been installed or a performance bond in a reasonable amount
to be determined by the City Engineer, with Sureties to be
approved by the City Attorney, shall have been filed with the
City Clerk, or cash in a like amount shall have been deposited
with the Department of Finance to be placed in a Trust Fund
Said improvements shall meet the standards established by the
City Council and shall include curb, gutter, sidewalks, and
street and alley paving, street trees, street signs, street
lights, and all required utilities.
C. The City Engineer shall not approve the issuance of a
Building Permit, nor shall the Building Department issue
a Building Permit, until the requirements of this Section
have been met.
Section 118-A.9 INCONSISTENT PROVISIONS If any of the provisions of
PART 18-A of this Ordinance No. 90 are found to be inconsistent with any
other provisions of said Ordinance, the provisions of PART 18-A shall prevail

bring the Subdivision Ordinance of the City of Cypress into conformity with
the existing State Subdivision Map Act,
NOW THERE FORE BE IT RESOLVED that the proposed amendment be recommedded to
the City Council for Approval, to read as follows
"SECTION 1 Sectopm 5-18 of Ordinance No 77 the Subdivision Ordinance
as amended is hereby amended by deleting the existing Subsections (f)
and (g) and adding Subsection (f) as follows
"(f) To assure the City that this work will be completed a cash deposit
instrument of credit from a financial institution subject to regulation
by the State and Federal Government, or bonds of duly authorized corporate
sureties, guaranteeing faithful performance and guaranteeing payment for
labor and materials pursuant to the provisions of Section 11612 of the
Business and Professions Code of California shall be furnished, the amount
of this deposit, instrument of credit or bond shall be in the amounts and
for the following purposes (1) An amount determined by the governing
body, not less that 50 percent nor more than 100 percent of the total e
estimated cost of the improvement, conditioned upon the fathful performance
of the aggreement or contract and (2) an additional amount determined by
the governing body, not less than 50 percent nor more than 100 percent
of the total estimated cost of the improvement, securing payment to the
contractor, his subcontractors and to persons renting equipment or furnishing
labor or materials to them for the improvement ""

APPROVAL OF CONDITIONAL USE PERMIT NO C-180 (GERALD M. LAYER)
WHEREAS the Cypress City Planning Co mmission held a public hearing on
Thursday, March 4 1965 and March 18, 1965 at 7 30 p m in the Council
Chambers, 5311 Orange Avenue, Cypress, California, to consider an application
for condtiional use permit to allow the service of alcholic beverages on the
premises at 4114 Lincoln Avenue, Cypress requested by Gerald M Layer,
2731 Whidby Lane, Anaheim, California known as Conditional Use Permit NO
C-180 and
WHEREAS two people appeared in favor of the proposed use and no pootests were
heard, and,
WHEREAS the Planning Commission determined the proposed use was compatible with
the surrounding uses and sufficient parking is available to server the existing
and proposed uses
NOW THEREFORE BE IT RESOLVED that Conditional Use Permit No C-180 be
recommended to the City Council for approval subject to the following conditions.
1 That the street improvements on Bloomfield and Lincoln be installed
2 That a bond be posted for all drainage fees in the amount required for

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CYPRESS DENYING
VARIANCE NO V-203 (PAUL CRANE)
WHEREAS the Cypress City Planning Commission held a public hearing on
Thursday, March 18, 1965 at 7.30 p m in the Council Chambers, 5311
Orange Avenue, Cypress, California, to consider an application for variance
to allow the installation of a 10' x 25' sign three feet (12. south and
six feet (6') east of the northwest corner of 4001 Myra Avenue, and extending
east approximately 25 ft on said property, requested by Paul Crane,
4001 Myra Avenue, Cypress, California, known as Variance NO V-203, and,
WHEREAS no one appeared in favor of the proposed variance, fourteen (14)
written protests were received, no oral protests were heard, and,
WHEREAS the Planning Commission determined the proposed variance would be d
detrimental to the surrounding area and was not justified due to the following
facts
1 The sign had been illegally erected without benefit of a building permit
or necessary variance
2 Telephone complaints had been received stating it was a commercial
use in a residential neighborhaood
3 Protests from fourteen (14) property owners in the vicinity of the
proposed sign had been received
The Commission further determined that hhe variance did not meet the conditions
precedent to the grating of a variance as outlined in Section 123 3 of the
Zoning Ordinance No 90,
NOW THEREFORE BE IT RESOLVED that Variance No. V-203 be denied due to the Planning
Commission's determinations as listed

RECOMMENDING DENIAL OF ZONE CHANGE NO Z-134 (FLYNN, MC BRIEN & SCALLY)
WHEREAS the Cypress City Planning Commission held a public hearing on
Thursday, April 1, 1965 at 7:30 p.m. in the Council Chambers, 5311 Orange
Avenue, Cypress Californ.i3, to consider an application for amendment to the
Zoning Ordinance No 90, to change the zone from R-1 (One -family Residential)
to C-1 (Neighborhood Stores) on property generally located on the southwest
corner of Juanita and Orange, requested by Clinton H and Ruth R Flynn,
Frederick R. and Suzanne I McBrien, and Lola A Scally, c/o C H and
R R. Flynn, 1101 W North Street, Anaheim, California known as Zone
Change No Z-134, and,
WHEREAS no one appeared in favor of the request, two inquiries were made and
no protests were heard, and,
WHEREAS the Planning Commission determined that the proposed change would not
be in the best interest of the City for the following reasons:
1 The location fo the existing railroad line indicates great possibility
for traffic congestion
2 The General Plan does not indicate any commercial needs in the area
3 The proposed R-1 subdivision immediately west of the subject property
will be directly effected by the traffic, noise, lights, etc
generated from the proposed uses at hhis location
4 Commercial developments of the size proposed by the applicant are
normally located in the intersection of secondary, primary, and major
highways and not on interior block situations off of residential collect
or streets
5. The size of the proposed development would probably have little success
due to the lack of present and future dwelling units within the area
6 The property would not conform to the criteria established in the
"Description and Purpose' of the C-1 (Neighborhood Stores) zone
NOW THEREFORE BE IT RESOLVED that Zone Change No Z-134 be recommended to
the City Council for denial due to the reasons stipulated above

WHEREAS the Planning Commission of the City of Cypress held a public
hearing on April 1, 1965 at 7.30 p m in the Council Chambers, 5311 Orange
Avenue, Cypress California, to consider an application for variance to allow
the reduction of the width and lot size of lots in an R-1 subdivision known
as Tentative Tract No 5337, generally located between Grindlay and Moody
Streets approximately 686' south of Lincoln Avenue on Moody and property
immddiately south of the Catholic Church School property on Grindlay Street
requested by John S May, 9886 Garden Grove Blvd Garden Grove California
known as Variance No V-204, and,
WHEREAS one person appeared in favor of the requested variance and one protest
was heard, and,
WHEREAS by changing the design of the streets the applicant could comply with

5 The applicant shall obtain all necessary permits for inspection of
structures and bleachers from the Cypress Building Department
6 A business license is required for the sale of foods
7 The sound emitted by the loudspeakers shall not become objectionable
to the surrounding tracts
8 The grounds shall be policed and kept in an orderly manner
