A RESOLUTION OF THE PLANNING COiMMISSION OF THE
CITY OF CYPRESS RECOMMENDING APPROVAL OF ZONE
CHANGE NO 77-2
WHEREAS, the Planning Commission of the City of Cypress held a public
hearing to consider the establishment of an overlay zone for certain deep
lots located along Lincoln Avenue, and
WHEREAS, the Planning Commission considered testimony presented at the
public hearing both in favor and in opposition to the proposed change of
zone. and
WHEREAS, the Planning Commission determined that the change of zone was
consistent with the goals and objectives of the Land Use Element of the
General Plan as approved by the Planning Commission. and
WHEREAS, the proposed zone change would be consistent with the implementa-
tion program as contained in the adopted Lincoln Avenue Study, Phase II; and
WHEREAS, the change of zone will promote the development of identified
deep lots along Lincoln Avenue in a manner which would be compatible with the
objective of supplementing the economic base of the City of Cypress
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the
City of Cypress does here recommend approval of Zone Change No 77-2

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS RECOMMENDING APPROVAL OF ZONE
CHANGE NO 77-3
WHEREAS, an application was made by MEB Investments to rezone an
irregularly shaped 1 2 -acre parcel of land located on the southerly side
of Lincoln Avenue from the current classification of Commercial Heavy to
a duel classification of Commercial Heavy and Residential Multiple Family,
and
WHEREAS, the Planning Commission of the City of Cypress conducted a public
hearing on the proposal at which time evidence was presented and considered
both in favor and in opposition to the proposed change. and
WHEREAS, the Planning Commission determined that the proposed change of
zone would be consistent with the Land Use Element of the City's General
Plan• and
WHEREAS, the Planning Commission determined that the proposed change
of zone would implement the development of properties along Lincoln Avenue
in accordance with the objectives of the Lincoln Avenue Study, Phase II
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the
City of Cypress hereby recommends approval of Zone Change No 77-3

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS COMMENDING C BERT GREENWOOD
WHEREAS, Bert Greenwood was appointed to the Planning Commission on
August 27 1973, serving through April, 1977• and
WHEREAS, Commissioner Green ood was an active member in the Commission's
many duties which included passing elements of the General Plan, revising
and updating the City's Zoning Ordinance and Subdivision Ordinance; and
WHEREAS, Commissioner Greenwood also contributed much of his time and
effort in the research discussion and final adoption of such documents as
the Noise and Seismic and Safety Elements of the General Plan the Master
Plan of Trails and the Lincoln Avenue Study, Phase I and II, and
WHEREAS, Commissioner Greenwood was constantly concerned with improving the
standards of development within the community and thereby improving the quality
of life style for the citizens of Cypress' and
WHEREAS, the Planning Commission has nothing but the highest regard,
admiration and appreciation for Commissioner Greenwood
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City
of Cypress does hereby formally commend Commissioner C BERT GREENWOOD for
his continuous loyalty and dedication to the Planning Commission and his
contribution to the betterment of the City of Cypress

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CYPRESS FINDING THAT THE IMPROVEMENT
OF THE MOODY CREEK CHANNEL IS IN CONFORMANCE WITH THE
CITY'S ADOPTED GENERAL PLAN
WHEREAS, the Orange County Environmental Management Agency is con-
sidering widening and lining the Moody Creek Channel with reinforced
concrete from Coyote Creek Channel to Crescent Avenue within the City
of Cypress, and
WHEREAS, the Government Code of the State of California, Section
65402, provides in part that a local agency such as the Environmental
Management Agency shall not acquire real property nor dispose of any
realproperty, nor construct a public building or structure in any
county or city, until the location, purpose and extent of such activity
has been reported upon as to conformity with the adopted general plan
applicable thereto; and
WHEREAS Section 21151 of the California Public Resources Code
provides in part that a local agency such as the flood control district
shall make an environmental impact statement for any project which may
have a significant effect upon the environment, and
WHEREAS, the Environmental Management Agency has prepared the
necessary environmental documents; and
WHEREAS, the proposed project of Environmental Management Agency
has been reviewed by the City of Cypress Planning Commission within the
context of Section 65402 of the California Government Code
N(* THEREFORE, BE IT RESOLVED that the Planning Commission of the
City of Cypress does hereby find that the proposed flood control and
drainage improvements within the City of Cypress are in conformance with
the City's adopted general plan

WHEREAS, an application was made by Dr Robert B Nevin to divide
75 acres of land into 31 lots yielding a density of 18 6 units per acre
located at 6101 Orange Avenue Cypress
WHEREAS, the Planning Commission considered evidence presented by the
appli-ant, City staff and other interested parties at a public meeting held
with rspect thereto
NOW THEREFORE, the Planning Commission of the City of Cypress, DOES' HEREBY
RESOLV;' as follows
The prrpposed map is compatible with the objectives policies,
general land uses and programs specified in the General Plan of the City of
Cypress in that:
a The density of development is in accordance with the objectives
and standards established by the Land Use Element of the General
Plan
b The subdivision of the property will provide for the improvement
of the adjacent arterial street in accordance with the Circulation
Element of the General Plan
c The proposed development being implemented through this map
will improve the housing stock of the City in accordance with the
general guidelines set forth in the Housing Element

CONDITIONAL USE PERMIT NO 77-5
1 The plot plan shall be revised to show existing
landmark trees in their proper location It is
probable that only one existing tree will interfere
with the proposed development
2 All existing trees on the subject site or within
public right-of-way shall be retained wherever possible
and incorporated into the landscaping program No
existing tree shall be removed without prior approval
from the Planning Director
3 Development of this project shall be in substantial
compliance with the plot plans and elevations submitted
with this request and as reviewed and approved by the
Planning Commission
4 Plans of the proposed landscaping and irrigation system
shall be submitted for review and approval by the
Planning Commission All required landscaping and irri-
gation systems shall be installed prior to the issuance
of a Certificate of Occupancy by the City
5 Soil in planting areas, including trees, shall be tested
by a qualified agricultural laboratory to determine the
organic and chemical amendments for optimum growth for
the plants specified The test results shall include
concentration of nitrogen phosphorus potassium pi -I
salinity, sodium status and boron saturation extract
Results of these tests with recommendations of the
agricultural laboratory shall be furnished to the
Public Works Department for approval at least 30 days
prior to planting date
6 Orange Avenue shall be dedicated and fully improved
with a meandering sidewalk, driveway, etc , in accor-
dance with the Master Plan of Streets and Highways and
the Public Works Department An additional four -foot
(4') easement for walkway and parkway purposes shall be
dedicated on Orange Avenue
7 Street trees (15 gallon) 20 feet on center shall be
installed along streets in conformance with the street
tree policy of the Public Works Department The type
of trees shall be as required under the Townscape and
Urban Design Element of the General Plan, to wit
Washingtonia robusta trees planted alternately with
Evergreen Pear trees
8 A grading plan shall be prepared and submitted for
review and approval by the Public Works Department
Drainage shall be solved to the satisfaction of the
City Engineer
9 The minimum flowline grade in streets and drives
shall be 0 20%
10 Drainage fees shall be paid in accordance with the
Master Plan of Drainage.

The street in front of this development shall be
resurfaced with one inch (1") minimum thickness
asphalt concrete from curb to curb if it is necessary
to open cut the street in more than one place Any
open cut shall be backfilled per City of Cypress
Standard No 110
12 All existing public improvements at the development
site which are damaged, cracked, or otherwise below
standard, shall be removed and replaced to the satis-
faction of the City Engineer
13 Adequate "No Parking - Fire Lane" signs shall be
installed along the alleyways per California Vehicle
Code No 22658, to the satisfaction of the City Engineer,
Building Superintendent and County Fire Marshal
14. Alleyways shall be twenty-four feet (24') minimum
clear paved width between buildings up to a height
of fourteen feet (14') above street grade
15 All garages shall be increased in width to nineteen
feet (19') and constructed up to the property line
Garage walls which are adjacent to the property line
shall be constructed of masonry block per City of
Cypress standards
16 A continuous curb six inches (6") in height, shall
be installed along the east side of the westerly alley
and along the west side of the easterly alley, to
protect dwelling units from vehicular traffic Wheel-
chair ramps shall be provided in the curb adjacent
to all entrance walkways. Patio slabs and walls shall
be installed a minimum distance of three feet (3')
from the continuous curb to avoid damage from vehicles.
17 A six inch (6") wide concrete header per City standards
shall be installed along the north property line adja-
cent to and flush with the alley pavement The developer
shall perform pavement patching operations in the alley,
within ten feet (10') of his north property line as
required by the City Engineer
18 Driveways shall be constructed with a ten -foot (10')
radius flare -out where they join with the alley to
the north
19 The northerly ten feet (10') of this development,
between the proposed driveways shall be paved to
provide for additional parallel parking stalls for
guests A continuous curb, six inches (6') in height,
shall be installed adjacent to the buildings in this
area for protection of the wall Curb face shall be
installed a minimum of two feet (2') from the base
of the wall
20 Four parking stalls along the northerly lot line shall
be provided and designated for guest parking stalls
These stalls shall be left uncovered and free of any
obsttuction along the northerly side of the stalls
21 Street lights shall be installed per City standards
22 Advance street light energy charges shall be paid
23 A Master Plan of Sewers shall be submitted for approval
by the City Engineer with plan check and inspection
b) the City's Engineering Division, subject to plan
checking and inspection fees
24 The sanitary sewer connection fee in the amount of
$250 00 per unit shall be paid by the developer and
forwarded by the City of Cypress to the appropriate

with the City of Cypress Subdivision Ordinance
27 Plan checking and inspection fees shall be paid in
accordance with City of Cypress Resolution #1713

29 All requirements of the County Fire Marshal shall be

30 The development shall be limited to one (1) driveway
access onto Orange Avenue The drive approach shall
be twenty-eight feet (28') in width and shall be in-
stalled per City of Cypress Standard No 207
31 A retaining wall shall be constructed at the property
line where the grade difference is more than twelve
inches (12")
32 Fence materials used at the southerly terminus of the
westerly driveway shall be subject to City staff approval
33 Individual refuse: collection shall be arranged and
maintained for each individual condominium unit
34 The developer shall provide mailbox facilities for all
dwelling units, to the satisfaction of the Public Works
Director, Planning Director, and Postmaster
35 A copy of the conditions, covenants, and restrictions
(CCU's) covering the development shall be submitted
to the City staff and City Attorney for their review,
recommendations, and approval to assure the continuance
maintenance, applicability and enforceability of the
CCU 's so that the development will not become a lia-
bility to the City at a later date
36 Developer shall conform to all applicable provisions
of the City Code
37 A bond shall be posted by the applicant to guarantee
maintenance of the irrigation system so that it operates
in a manner for which it was designed and to guarantee
mintenance of the plant materials in a helathy growing
condition free of weeds and litter for a period of not
less than 12 months to the specifications of the City
staff
RESOLUTION NO 758
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS RECOMMENDING APPROVAL OF AMENDMENT
TO THE ZONING ORDINANCE NO 77-1
WHEREAS, a report and a proposed Ordinance were prepared by the City
Planning Department establishing procedures and standards for the establish-
ment of condominiums and condominium conversions within the City of Cypress
and
WHEREAS, the Planning Commission conducted public hearings held on
April 7, 1977 and May 5, 1977, to review and discuss the report and Ordinance
as recommended by the Planning Department, and
WHEREAS, following extensive discussion on this subject, the Planning
Commission determined that a need existed for the adoption of an Ordinance
regulating condominiums and condominium conversions
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Cypress does hereby approve the proposed Amendment to the Zoning Ordinance
No 77-1, and recommends its adoption by the City Council.

CONDITIONAL USE PERMIT NO 77-6
1 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan shall be submitted for approval
2 Drainage channels shall be provided to carry runoff from the downspouts
located on the south side of the commercial building to the satisfaction
of the City Engineer Necessary drainage easements shall be granted
3 The minimum flowline grade in streets shall be 0 20%.
4 A concrete gutter shall be installed along the east property line of
Lot 11, near the southeast corner and along the east property line of
Lot 10, to correct drainage problems and pavement settlement
5 All secondary and primary utility services shall be underground
6 The existing sewer line next to proposed Lot 1 shall be encased in
concrete or replaced with cast iron pipe where it is within six feet
(6') of any building. Necessary sewer easements shall be granted to
the property south of this development
7 Necessary fire hydrants shall be installed in accordance with Fire
Department requirements and City Standards
8 Adequate "No Parking - Fire Lane" signs shall be installed along the
private drives per California Vehicle Code ##22658, to the satisfaction
of the City Engineer, Building Department Superintendent, and County
Fire Marshal
9 Any security lighting at the rear of the commercial buildings shall be
arranged so that direct rays will not shine on adjacent properties or
produce glare for street traffic
10. Soil in planting areas, including trees, shall be tested by a qualified
agricultural laboratory to determine the organic and ehcmical amendments
for optimum growth for the plants specified The test results shall
include concentration of nitrogen, phosphorus, potassium, pH, salinity,
sodium status and boron saturation extract. Results of these tests with
recommendations of the agricultural laboratory shall be furnished to the
Public Works Department for approval at least 30 days prior to planting
date
11 A bond shall be posted by the applicant to guarantee maintenance of the
irrigation system so that it operates in a manner for which it was
designed and to guarantee maintenance of all plant materials in a
healthy, growing condition, free of weeds and litter for a period of
not less than twelve (12) months to the specifications of the City Staff
12 The sanitary sewer connection fee shall be paid by the developer in
accordance with Orange County Sanitation District No 3, Resolution
No 303
13 A retaining wall per City of Cypress Standards shall be constructed at
the property line where the grade difference is greater than twelve
inches (12").
14 A block wall, six feet (6') in height shall be constructed from the
southeast corner of the existing commercial building to the east property
line, and continuing southerly along the east property line to join
with the existing six-foot block wall. A gate shall be provided in the
block wall to permit pedestrian traffic along the east side of the
commercial building
15 No wall shall be constructed along the property line separating Lot 10
from Lot 11. Small partitions shall be allowed in this area to screen
existing commercial doors from view, subject to design approval by the
City Staff
16 In order to drain the rear portion of the dwelling units, it will be
necessary to provide a drainage structure along the south property line
of Lots 1 through 9 Private drainage easements shall be recorded on
the record map The drainage structure shall be capable of handling
a theoretical 100 -year storm without endangering living units
17 An effective sight distance for vehicular traffic shall be maintained
at the intersection of the private drives No landscaping will be
allowed in the area of the curb returns Block walls shall have a
maximum height of three feet (3') within twenty feet (20') of the
driveway intersections
18 A continuous physical barrier (i e , 6" high concrete curb) shall be
constructed at a minimum distance of three feet (3') from the base of
all block walls exposed to vehicular traffic to the satisfaction of the
City Engineer. Planting may be installed in the area between the block
wall and the curb
19 The developer of this project shall provide adequate speed control
within the development to the satisfaction of the City Engineer
20 The private drive in front of the nine units shall be twenty-five feet
(25') minimum clear width between buildings up to a height of fourteen
feet (14') above street grade. The entire drive shall be included
within Lot 10
21 A copy of the conditions, covenants and restrictions (CC&R's) covering
the development shall be submitted to the City Staff and City Attorney
for their review, recommendations, and approval to assure the continuance,
maintenance, applicability and enforceability of the CC&R's so that the
development will not become a liability to the City at a later date,
22 The CC&R's for this development shall prohibit the parking of recrea-
tional vehicles (motor home, etc.), trailers, and commercial vehicles
within designated guest parking stalls
23. The final location of the private gate activating mechanism shall be
subject to the approval of the City Staff The proposed location may
conflict with vehicular movements into the adjacent parking lot
24. The developer shall provide mailbox mounting facilities for each resi-
dence, to the satisfaction of the Public Works Director, Planning
Director and Postmaster
25 Developer shall conform to all applicable provisions of the City Code.
26. Prior to installation of any landscaping,. a specific landscape plan
shall be reviewed and approved by the Planning Commission
27 All required landscape and irrigation systems shall be completed prior
to the issuance of a Certificate of Occupancy for the residential
portion of this project.
28 The design and location of trash receptacles to serve the commercial
developments shall be submitted for approval by the Planning Commission
in conjunction with the applicant's submittal of the required landscape
and irrigation plans Generally, one trash receptacle shall be located
near the southeasterly corner of the Lincoln Plaza Center, the other
receptacle shall be located near the northwesterly corner to serve both
the existing commercial uses and the proposed restaurant
29 The thirteen foot (13') wide emergency access alley at the east end of
the commercial building shall be kept free of all obstructions, in-
cluding but not limited to trash bins parked vehicles, delivery trucks,
etc.
30 Adequate "No Parking - Fire Lane" signs shall be installed along the
thirteen -foot (13') wide emergency access alley at the east end of the
commercial building, per California Vehicle Code ##22658, to the satis-
faction of the County Fire Marshal and City Staff.
31. Condition No 14 of the staff report for C U P No 77-6 should be
revised to read: 'A wall, six feet (6') in height and capable of being
driven through by emergency vehicles shall be constructed from the
southeast corner of the existing commercial building to the east prop-
erty line. Wall design and construction shall be subject to approval
of the County Fire Marshal and City Staff A gate shall be provided
in the wall to permit pedestrian traffic along the east side of the
commercial building A block wall, six feet (6') in height, shall be
constructed along the east property line of Lot #E11 connecting the
aforementioned crash gate with the existing block wall to the south

1 The hours of operation shall be limited to 9:00 a m to 12:00 p m
Sunday through Thursday and 9.00 a m to 2.00 a m Friday and Saturday
The Planning Commission, at its discretion, may modify the hours of
operation should conditions relative to the operation of the business
justify such an action
2 Adult supervision shall be maintained on the premises during all hours
of operation
3 The operation and use permit shall be reviewed by the Planning Director
and the Chief of Police on an annual basis, at the time the business
license is renewed for this use
4 No form of betting or gambling shall be allowed

WHEREAS, the Planning Conmiission of the City of Cypress held a public
hearing at their meeting of June 16, 1977, to consider an application to
amend the Land Use Element of the General Plan which amendment would re-
classify the parcel of land located at the southwesterly corner of Holder
Street and Cerritos Avenue from its current designation of Commercial to a
low-density Residential• and
WHEREAS the Planning Commission considered evidence presented by City
staff and other interested parties, and
WHEREAS, after extensive discussion by the Commission, a motion was

1 All parking spaces shall be nine feet by twenty feet (9' x 20') in size
2 The outdoor storage area shall be maintained in a clean and litter free
condition at all times
3 Maintenance and repair ofzequipment shall be accomplished in a manner
which will not disturb or create undue hardship upon the surrounding
residents
4 The hours of operation shall be restricted to the hours between 7:00 a.m
and 7 00 p m seven days per week These hours are subject to modification
by the Planning Commission in order to insure compatibility with existing
developments in the inuuediate vicinity
5 A landscape and irrigation plan shall be reviewed and approved by the
Planning Commission
6 Electrical and plumbing equipment shall be certified by a qualified
contractor as to conformance with City codes prior to a Certificate of
Occupancy being issued
7 Gasoline pumps and storage tanks must be approved by the Orange County
Fire Marshal's office Should the storage tanks not be used, they must
be removed from the premises or adequately filled with inert material
8 Any welding or open flame services must be performed outside the existing
structure
9 The existing structure shall be refurbished to meet Building, Electrical
and Plumbing Codes where applicable
10 The westerly drive approach on Cerritos Avenue and the southerly drive
approach on Moody Street shall be removed and replaced with full -height

11 Street trees (15 gallon) and treewells spaced forty feet (40') on center
shall be installed along Moody Street and Cerritos Avenue in conformance
to the street tree policy of the Public Works Department. The type of
trees shall be as required under the Townscape and Urban Design Element
of the General Plan
12 A bond shall be posted by the applicant to guarantee maintenance of the
irrigation system so that it operates in a manner for which it was
designed and to guarantee maintenance of all plant materials in a

19 The proposed wall and gate at the northwest corner of the development

pedestrians southbound on the sidewalk Perimeter gates shall be
recessed to the satisfaction of the Traffic Engineering Department

WHEREAS, the Planning Commission of the City of Cypress held a public
hearing at their meeting of July 7, 1977, to consider an application to
amend the Land Use Element of the General Plan which amendment would reclassify
the area generally referred to as the Walker Street Area, situated easterly
of Walker Street and southerly of Lincoln Avenue from its current designation
of high-density residential and commercial to some other urban use; and
WHEREAS the Planning Commission considered evidence presented by City
staff and other interested parties, and
WHEREAS, after extensive discussion by the Commission, a motion was made

NO 77-12 - WITH CONDITIONS
THE PLANNING COMMISSION OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES AND ORDERS AS FOLLOWS
1 That an application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance
of the City of Cypress to establish, operate and maintain a tropical
fish store
2 That the Planning Commission, after proper notice thereof duly
held a public hearing on said application as provided by law
3 That the Planning Commission, hereby finds that
a The proposed location of the conditional use is in accord with the
objectives of the Zoning Ordinance and the purpose of the zone in which
the site is located is that:
To provide appropriately located areas for office uses, retail
stores, service establishments, and wholesale businesses, offering
commodities and services required by residents of the City and its
surrounding market area
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious
to properties or improvements in the vicinity in that.
1 The use will not generate any additional vehicular and pedestrian
traffic beyond that which was contemplated for the subject property
at the time the original development plans were reviewed and
approved by the Planning Commission
2 The proposed use is compatible with adjacent uses already
established within the same shopping center
3 The use will promote the development and •etention of a commercial
project in accordance with the objectives of the Land Use Elemnt of
the General Plan
c The proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance except for approved variances or
adjustments
4 The Planning Commission DOES HEREBY GRANT said conditional use permit,
subject to the conditions, attached hereto as Exhibit "A"

CONDITIONAL USE PERMIT NO 77-13
1. Prior to the issuance of a Building Permit for any
structure, the final building plans and elevations and
plot plans shall be submitted for review and approval
by the Planning Commission
2. Plans for the proposed landscape/irrigation system to be
undertaken in conjunction with each building shall be
submitted for review and approval by the Planning Com-
mission Required landscaping shall be installed prior
to the issuance of a Certificate of Occupancy for each
building
3 A bond shall be posted by the applicant to guarantee
maintenance of the irrigation system so that it operates
in a manner for which it was designed, and to guarantee
maintenance of all plant materials in a healthy, growing
condition, free of weeds and litter, for a period of not
less than twelve (12) months, to the specifications of
the City. staff.
4 All existing structures and improvements located on the
subject property shall be removed to the specifications
of the Building Superintendent A demolition permit
shall be obtained if required by the City Code
5 Existing landmark trees at the development site shall be
saved where possible Any removal of a landmark tree
shall be approved by the Planning Director
6 The parkway area of all streets not improved with sidewalks
shall be landscaped irrigated and maintained by the prop-
erty owners in accordance with the CC&R's which will be
submitted for City staff approval
7 Street trees (15 gallon) 40 feet on center shall be in-
stalled along streets in conformance with the street tree
policy of the Public Works Department The type of trees
shall be as required under the Townscape and Urban Design
Element of the General Plan.
8. Soil in planting areas including trees shall be tested by
a qualified agricultural laboratory to determine the
organic and chemical amendments for optimum growth for
the plants specified The test results shall include con-
centration of nitrogen, phosphorus potassium, pH, salinity,
sodium status and boron saturation extract Results of
these tests with recommendations of the agricultural
laboratory shall be furnished to the Public Works Depart-
ment for approval at least thirty (30) days prior to
planting date.
9 Drainage fees shall be paid in accordance with the Master
Plan of Drainage.
10 Drainage shall be solved to the satisfaction of the City
Engineer A grading plan shall be submitted for approval
by the Engineering Division
11 All on-site drainage shall be conveyed to the street by
means of an undersidewalk drain in any area where such
drainage would cross a City sidewalk
12. A cash deposit shall be posted with the City of Cypress to
cover estimated costs of constructing future local storm
drain facilities to serve the development subject to
approval of the City Engineer
13 A topograph of the area surrounding this development shall
be made to establish existing drainage patterns If the
existing natural flow of any adjoining parcel is across
the land of this development, a drainage easement shall
be granted where necessary, and drainage facilities pro-
vided for that property, to the satisfaction of the City
Engineer
14. Sewage flow shall be in conformance with the conditions in
the letter of agreement signed by Donald W Shaw dated
January 30, 1974
15 A Master Plan of Sewers shall be submitted for approval
by the City Engineer with plan check and inspection by the
City's Engineering Division subject to plan checking and
inspection fees
16. The sanitary sewer connection fee shall be paid by the
developer in accordance with Orange County Sanitation
District requirements
17. Walker Street (50') half street and Cerritos Avenue (50')
half street shall be dedicated and fully improved in accor-
dance with the Master Plan of Streets and Highways
18 Streets "A", "B', "C" and "D" (60' right-of-way) shall be
dedicated and fully improved in accordance with the Master
Plan of Streets and Highways with a curb separation of 44
feet Sidewalks shall not be required along these interior
streets
19 The corner cutoff at Cerritos Avenue and Walker Street shall
be dedicated to the City of Cypress for roadway purposes
20 The intersection of Street "D" and Walker Street shall be
designed to align with the Race Track entrance located on
the west side of Walker Street.
21 Cerritos Avenue shall be constructed with an eight -foot -wide
meandering sidewalk with jogouts provided around pole,
lights, etc , per City standards
22 Street structural sections shall be based on recommendation
and soils report by a soils engineering firm acceptable to
the City Engineer with street structural sections to be
determined by using an applicable T I
23 All driveway entrances shall be constructed per City of
Cypress Standard Plan No. 207.
24 The proposed drive approaches on Cerritos Avenue and Walker
Street shall be designed for "Right Turn Only" for traffic
exiting onto Cerritos Avenue and Walker Street with the
exception of the second driveway on Walker Street south of
Cerritos where a left -turn pocket may be provided CC&R's
shall be recorded and shall be attached to the title for
this property dedicating all exit rights to Cerritos Avenue
and Walker Street from this development to the City of
Cypress, except for right -turn movements from the proposed
driveways with the exception of the second driveway on
Walker Street south of Cerritos Avenue
25 All driveway entrances on Cerritos Avenue and Walker Street
shall be 35 feet wide All other driveways shall be
25 feet minimum width. Driveways to be constructed for
right-hand movements only shall be constructed to the
satisfaction of the City Engineer
26 The minimum flowline grade in streets shall be 0 20%.
27 The cost of any necessary restriping of traffic lanes
on Cerritos Avenue and Walker Street shall be borne by
the Developer
28 All requirements of the County Fire Marshal shall be
satisfied
29 Necessary fire hydrants shall be installed in accordance
with Fire Department requirements and City standards
30 All secondary and primary utility services shall be
underground
31 Street lights shall be installed per City standards
32 Advance street light energy charges shall be paid
33 Wheelchair and handicap access facilities shall be in-
stalled at the intersections of Cerritos Avenue and
Walker Street Also at Cerritos Avenue and "A" Street
and all other exits onto Cerritos Avenue and Walker Street
34. Any on-site security lighting shall be arranged so that
direct rays will not produce glare for street traffic
or properties adjacent to this development
35 Plan checking and inspection fees shall be paid in accor-
dance with City of Cypress Resolution No 1713
36 Final subdivision map filing fees shall be paid in accor-
dance with City of Cypress Resolution No 1713
37 Reciprocal easements between individual parcels where
shared access drives parking and maneuvering areas are
proposed shall be designated in the CC&R's guaranteeing
such provisions which shall be drafted for approval by
the City and recorded with the parcel map at the County
Recorder's Office
38 The CC&R's shall restrict fencing along common driveways
39 All requirements of the State Subdivision Map Act and
the City's Subdivision Ordinance shall be satisfied
40 Developer shall conform to all applicable provisions of
the City Code
41 The conditions of this Conditional Use Permit shall
apply to all parcels created, altered, or otherwise
affected by the parcel map
42 Plans for proposed walls fencing and screening shall be

1 The development of the subject property shall conform to
the plot plans, elevations, landscaping and signing plans
submitted with this request and as reviewed and approved
by the Planning Commission
2 Drainage fees shall be paid in accordance with the Master
Plan of Drainage
3 Drainage shall be solved to the satisfaction of the City
Engineer. A grading plan shall be submitted for approval

32 The most easterly driveway on Orange Avenue shall be
reduced to 20 feet in width and designated for ingress
only The adjacent designated parking spaces shall be
redesigned to provide for 60 degree angular parking for
access from Orange Avenue.
33 The proposed building location shall be adjusted ten (10')
feet to the east in order to provide for an additional
ten feet in width for the most westerly driveway thereby

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CYPRESS APPROVING TENTATIVE
PARCEL MAP NO 77-2 - WITH CONDITIONS
WHEREAS, an application was made by the Robert P Warmington Company
to divide 24 acres of land into 1 20 lots per acre located at the south-
east corner of Walker Street and Cerritos Avenue- and
WHEREAS the Planning Commission considered evidence presented by the
applicant, City staff and other interested parties at a public meeting held
with respect thereto
NOW, THEREFORE, the Planning Commission of the City of Cypress, DOES
HEREBY RESOLVE as follows.
1 The proposed map is compatible with the objectives, policies, general
land uses and programs specified in the General Plan of the City of Cypress
in that:
A The Map will provide for the development of a parcel of land as
an industrial project in conformance with the Land Use Element of
the General Plan
B The adjacent arterial streets will be fully dedicated and improved
in accordance with the objectives of the Circulation Element
of the General Plan
C Off-site and on-site improvements will be provided in accordance
with the Townscape Element of the General Plan
2 The design and improvement of the proposed subdivision as designated
on the Tentative Parcel Map and supplemented by the conditions attached
hereto as Exhibit "A", and incorporated herein be reference are compatible
with the objectives policies general land uses and programs specified in
the General Plan of the City of Cypress in that
A The design of the subdivision and required public improvements will
provide for the logical division of adjacent properties in accordance
with the Land Use Element and Circulation Element of the General Plan
B The lot configuration of the subject Map will facilitate the
development of the property in a manner which will be compatible
with the objectives of the Land Use Element of the General Plan
C Specific requirements for the improvement of adjacent streets will
insure the integrity of the adjacent arterial streets in accordance
with the Circulation Element of the General Plan
3 None of the findings set forth in Government Code Section 66474
can be made
4. The discharge of waste from the proposed subdivision into the existing
community sewer system shall not result in a violation of the existing
requirements prescribed by the California Regional Water Quality Control
Board having jurisdiction over the proposed subdivision pursuant to the
provisions of Division 7 of the California Water Code (Section 13000 et seq )
Denial of a subdivision for violation of the proposed waste discharge
standards or an addition to an existing violation thereof, is a ground for
denial of the Tentative Parcel Map although such denial is not mandatory
NOW THEREFORE BE IT FURTHER RESOLVED that the Planning Commission of

18 Location of all street furniture shall be approved by
the City Engineer

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS APPROVING MODIFICATION NO 2
TO CONDITIONAL USE PERMIT NO C-267
WHEREAS, the Planning Commission of the City of Cypress at its meeting
of November 3, 1977, conducted a public hearing to consider a proposed
amendment to Conditional Use Permit No C-267, and
WHEREAS, the purpose of the public hearing was to determine whether or
not a condition previously attached to Conditional Use Permit No C-267
should be eliminated which condition required that an area be provided for
the storage of recreational vehicles within the project authorized by the
Use Permit, and
WHEREAS at the public hearing the Planning Commission received a
report prepared by the Planning Director recommending elimination of the
specified condition; and
WHEREAS, at the public hearing, testimony was presented both in support
and in opposition to the proposed condition, and
WHEREAS, following discussion relative to all aspects of the case, the
Planning Commission took an action concurring with the recommendations of
the City staff
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the
City of Cypress does approve Modification No 2 to Conditional Use Permit
No C-267
PASSED AND ADOPTED by the Planning Commission of the City of Cypress
at a regular meeting held on the 3rd day of November, 1977

NO 77-24 - WITH CONDITIONS
THE PLANNING COMMISSION OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES
DETERMINES AND ORDERS AS FOLLOWS•
1 That an application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to establish, operate and maintain a fast food, drive-
thru restaurant and ice cream store to be located on a parcel of land in
the CS -N -2A Commercial Shopping Center, Neighborhood Zone
2 That the Planning Commission, after proper notice thereof duly
held a public hearing on said application as provided by law
3 That the Planning Commission hereby finds that:
a The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located in is -
To provide appropirately located areas for office uses, retail
stores service establishments and wholesale businesses offering
commodities and services required by residents of the City and
its surrounding market area
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that*
1 The adjacent arterial streets have more than adequate capacity
to accommodate the anticipated volumes of vehicular traffic
to be generated by the proposed uses
2 The hours of operation for the facility will be restricted to
reduce any possible impact of the operation on adjacent
residential properties
3 A review of the impacts of this project on the surrounding
environment concludes that no adverse impacts will be realized
by adjacent properties of the surrounding neighborhood
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved

CONDITIONAL USE PERMIT NO 77-24
1 A maximum two -foot -high extension shall be constructed along the block
wall dividing the subject property from the adjoining residences
located at 10541 Knott Street and 6962 Cerritos Avenue subject to the
approval and acceptance of the property owners and also subject to the
specifications of the Building Superintendent
2 A comprehensive signing program shall be reviewed and approved by the
Planning Commission prior to installation of any permanent signing
3 Elevations of the proposed satellite building (ice cream store) shall
be reviewed and approved by the Planning Commission prior to issuance of
building permits for this structure
4 Drainage fees shall be paid in accordance with the Master Plan of Drainage
5 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan shall be submitted for approval
6 A topograph of the area surrounding this development shall be made to
establish existing drainage flow patterns If the existing natural
flow of any adjoining parcel is across the land of this development,

WHEREAS, the City Engineer submitted a report to the Panning Commission
indicating that a portion of the easement can be abandoned,

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS RECOMMENDING APPROVAL OF GENERAL
PLAN AMENDMENT NO 77-5 - MEB INVESTMENTS
WHEREAS, the Planning Commission of the City of Cypress held a public
hearing at their meeting of December 1 1977 to consider an application to
amend the Land Use Element of the General Plan which amendment would
reclassify the property located at the northwesterly corner of Ball Road
and Juanita Street from a commercial designation to a dual classification
of•commercial and high-density residential, and
WHEREAS, the Planning Commission considered evidence presented by
City staff and other interested parties and
WHEREAS after extensive discussion by the Planning Commission a
motion was made to approve the subject General Plan Amendment and passed by
a unanimous vote
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City

and approved by the Planning Commission Since the property is located
in the CC Overlay Zone, final building and elevation plans shall be
submitted for Commission review prior to the issuance of a Building
Permit
2 Plans for the proposed landscaping and irrigation system shall be
submitted for review and approval by the Planning Commission Required
landscaping and irrigation systems shall be installed prior to the
issuance of a Certificate of Occupancy for this project
3 At the time landscaping plans are reviewed by the Commission, plans
for the proposed signing program shall be submitted for review and
approval by the Planning Commission
4 A bond shall be posted by the applicant to guarantee upkeep of the
landscape program and maintenance of the irrigation system so that the
