A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS RECOMMENDING APPROVAL OF
TENTATIVE TRACT MAP NO 10538 - WITH CONDITIONS
WHEREAS, an application was made by Calvin Meekhof to divide 1 45
acres of land into six lots yielding a density of four units per acre located
at 9731 Walker Street and
WHEREAS, the Planning Commission considered evidence presented by the
applicant City staff and other interested parties at a public meeting
held with respect thereto
NOW, THEREFORE, the Planning Commission of the City of Cypress
DOES HEREBY RESOLVE as follows:
1 The proposed map is compatible with the objectives policies,
general land uses and programs specified in the General Plan of the City of
Cypress in that
a The map will provide for the subdivision and development of the
subject property in a manner which is compatible with the Land
Use Element of the General Plan
b The density of development for the residential portions of
the subdivision will be in conformance with the requirements of
the Zoning and Subdivision Ordinances and within the density
limitations of the Land Use Element of the General Plan
c Approval of the map will facilitate the development of housing
units which will incrementally increase the supply of housing
within the City in accordance with the broad objectives of the
Housing Element of the General Plan
2 The design and improvement of the proposed subdivision as designated
on the tentative tract map and supplemented by the conditions attached
hereto as Exhibit "A", and incorporated herein be reference, are compatible
with the objectives policies general land uses and programs specified in
the Genral Plan of the City of Cypress in that:
The map will provide for the subdivision of the subject property
in a manner which is compatible with surrounding land use patterns
and will result in the installation and extension of public
improvements and utilities in accordance with the long-range
objectives of the Land Use Element Housing and Circulation
Elements of the City's General Plan
3 None of the findings set forth in Government Code Section 66474 can
be made
4 The discharge of waste from the proposed subdivision into the
existing community sewer system shall not result in a violation of the existing
requirements prescribed by the California Regional Water Quality Control
Board having jurisdiction over the proposed subdivision pursuant to the
provisions of Division 7 of the California Water Code (Sections 12000 et seq )
Denial of a subdivision for violation of the proposed waste discharge standards
or an addition to an existing violation thereof, is a ground for denial of the
tentative subdivision map although such denial is not mandatory
NOW THEREFORE BE IT FURTHER RESOLVED that the Planning Commission of
the City of Cypress does hereby recommend approval of Tentative Tract Map
No 10538 subject to the conditions attached hereto as Exhibit "A"

TENTATIVE TRACT NO 10538
1 The developer shall conform to all applicable provisions of the City
Code All requirements of the State Subdivision Map Act and the City's
Subdivision Ordinance shall be satisfied
2 Drainage shall be solved to the satisfaction of the City Engineer
A grading plan shall be submitted for approval A topograph of the
area surrounding this development shall be made to establish existing
drainage flow patterns If the existing natural flow of any adjoining
parcel is across the land of this development a drainage easement
shall be granted and drainage facilities provided for that property to
the satisfaction of the City Engineer All lots shall have a slope
gradient of between one percent (1%) and three percent (3%) from rear
lot line to the street
3 A minimum six-foot (6') high block wall, measured from the highest
adjacent grade, shall be maintained and/or constructed along the north
south and west property line(s) and between Lots 1 and 2 A retaining
wall per City standards shall be constructed at the property line where
the grade difference is greater than twelve inches (12"). A six-inch
(6") concrete curb per City standards shall be constructed at a minimum
distance of three feet (3') from the base of all block walls exposed to
vehicular traffic
4 Wheelchair and handicap access facilities shall be installed on-site and
off-site in accordance with State of California and City of Cypress
Building Department standards
5 On-site security lighting shall be arranged so that direct rays will
not shine on adjacent properties or produce glare for street traffic
All roof -mounted equipment, such as heating and air conditioning units,
shall be adequately screened from public view subject to the approval
of the City staff Commercial or industrial developments which adjoin
residentially zoned areas shall construct noise bafflers and/or deflectors
on all mechanical equipment mounted outdoors, to the satisfacion of the
City staff
6 The developer shall provide mailbox facilities for each residence, to the
satisfaction of the Public Works Director, Planning Director and
Postmaster
7 The proposed cul-de-sac shall be dedicated and fully improved with curb,
gutter, sidewalk, driveway, paving, etc in accordance with the Master
Plan of Streets and Highways The proposed cul-de-sac shall have a total
right-of-way width of forty-five feet (45'), with an additional six-foot
(6') wide walkway tree planting and public utility easement on the north
side of the street The right-of-way width shall be 23 5 feet north of
the centerline and 21 5 south of the centerline The curb line shall be
eighteen feet (18') north and south of the centerline with the south
curbline a minimum of 3 5 feet north of south property line The end of
the cul-de-sac shall have a property line radius of forty-four feet
(44') with additional six-foot (6') wide walkway, tree planting, and
public utility easement The north curb return at the intersection of
the cul-de-sac and Walker Street shall have a radius of thirty-five feet
8 Street structural sections shall be based on the recommendation and
soils report prepared by an engineering firm acceptable to the City
Engineer, with street structural sections to be determined by using an
applicable T I (Traffic Index) The minimum flowline grade in streets
shall be 0 20% All existing public improvements at the development
site which are damaged cracked, or otherwise below standard, shall be
removed and replaced to the satisfaction of the City Engineer
9. The quantity location width, and the type of driveways shall be subject
to the approval of the City Engineer An effective sight distance for
vehicular traffic shall be maintained at the intersection of the driveway
entrance with Walker Street No landscaping will be allowed in the
area of the curb returns Adequate sight distance also shall be maintained
within the development at all driveway intersections to the satisfaction
of the City Engineer
10 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one inch
(1") minimum thickness asphalt concrete from curb -to -curb if it is
necessary to open -cut the street in more than one place Any open cut
shall be backfilled per City of Cypress Standard No 110 Existing
overhead utility lines serving the existing commercial uses shall be
removed and replaced with underground service
11 Street lights shall be installed per City standards Street name signs
and traffic signs shall be installed per City standards Necessary
fire hydrants shall be installed in accordance with Fire Department
Requirements and City standards
12 Street trees (15 gal ) forty feet (40') on center shall be installed
along streets in conformance to the street tree policy of the Public
Works Department The type of trees shall be as required under the
Townscape and Urban Design Element of the General Plan
13 A master plan of sewers shall be submitted for approval by the City
Engineer, with plan check and inspection by the City's Engineering
Division, subject to plan checking and inspection fees
14 An agreement shall be made with the property owner to the south of
this development to grant permission to remove his driveway on Walker
Street and to build a new driveway to his property on the proposed
cul-de-sac street Also, a corner cut-off from this property owner is
required to maintain a minimum curb radius of twenty-five feet (25')
at the southwest corner of the cul-de-sac at Walker Street
15 The following fees shall be paid
a Final subdivision map filing fee (Per Resolution No 1713)
b Engineering plan checking and inspection fee (Per Resolution No 1713)

16 A plot plan shall be submitted showing the location and size of all
existing structures and improvements on the commercial lot (Lot 1)
The plans shall also indicate the relocation of required off-street
parking spaces and provision shall be made for the installation
of a landscaped area along Walker Street and the cul-de-sac street
frontage of Lot 1 to the specifications of the City staff
17 Existing underground gasoline storage tanks located on the subject
property shall be removed or filled to the specifications of the City
Code and the Orange County Fire Marshal
18 In accordance with the provisions of the Subdivision Ordinance, this
matter will be transmitted to the City Council for their review and
approval at the City Council's regularly scheduled meeting of October 10,
1978

to divide 9 acres of land into 15 lots located at 9141 Valley View Street,

WHEREAS, the Planning Commission considered evidence presented by the
applicant, City staff and other interested parties at a public meeting held
with respect thereto
NOW, THEREFORE the Planning Commission ofthe City of Cypress, DOES
HEREBY RESOLVE as follows
1 The proposed map is compatible with the objectives, policies, general
land uses and programs specified in the General Plan of the City of Cypress
in that.

potassium, pH, salinity, sodium status and boron saturation extract

be retained shall be inspected by a qualified tree specialist and shall
be trimmed and topped as necessary A report on the condition of the
trees and the steps necessary for their preservation shall be filed for
review by the City staff

CITY OF CYPRESS RECOMMENDING APPROVAL OF AMENDMENT
TO THE ZONING ORDINANCE NO 78-5
WHEREAS the Planning Commission of the City of Cypress held a public
hearing at their meeting of October 5, 1978, to consider Amendment to the
Zoning Ordinance No 78-5 which provides for the establishment of churches
in all Commercial zones in the City• and
WHEREAS, the Planning Commission considered eivdence presented by the
applicant and city staff; and
WHEREAS, the proposed amendment would allow for the establishment of
churches in all Commercial zones in the City subject to the granting of a
Conditional Use Permit
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS RECOMMENDING APPROVAL OF ZONE
CHANGE NO 78-10
WHEREAS, an application was received from the Robert P Warmington
Company to change the zone of approximately 9 0 acres of land situated at
9141 Valley View Street from its current classification of CG -10000 (CC)
Commercial General to a PCM Planned Commercial/Light Industrial Zone for
the establishment of commercial and light industrial uses, and
WHEREAS the Planning Commission of the City of Cypress conducted a public
hearing on the proposal at which time evidence was presented and considered
regarding the proposed change of zone, and
WHEREAS discussion was held regarding the appropriateness of the PCM Zone
and its compatibility with surrounding land uses and zoning patterns and
WHEREAS the Planning Commission considered the standards of performance
and development of the types of uses to be permitted within the PCM Zone
as described in the accompanying text
NOW THEREFORE BE IT RESOLVED that the Planning Commission of the City
of Cypress does recommend approval of Zone Change No 78-10

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT
NO 78-26 - WITH CONDITIONS
THE PLANNING COMMISSION OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES
DETERMINES AND ORDERS AS FOLLOWS.
1 That an application was filed for a conditional use permit in accordance
with the provisions of Section 17 2 of the Zoning Ordinance of the City of
Cypress to establish a racquetball/office complex at 9922 Walker Street
2 That the Planning Commission after proper notice thereof, duly held
a public hearing on said application as provided by law
3 That the Planning Commission, hereby finds that
a The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located in is:
To provide appropriately located areas for office uses, retail
stores service establishments, and wholesale businesses offering
commodities and services required by residents of the City and its
surrounding market area
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental to
the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
1 The design of the project is such as to maximize building setback
and landscaped area in relationship to adjacent single family
property in order to minimize any adverse affects as a result of
this project
2 The adjacent arterial highway has more than adequate capacity to
accommodate the projected increase in pedestrian and vehicular
traffic to be generated by this use
3 The proposed land use is compatible with the range of uses
projected on the Land Use Element of the General Plan
c The proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance except for approved variances or adjust-
ments
4 The Planning Commission DOES HEREBY GRANT said conditional use permit
subject to the conditions attached hereto as Exhibit "A"

CONDITIONAL USE PERMIT NO 78-26
1 The applicant shall provide an additional intermittent three feet of
front setback along Walker Street unobstructed vertically, to allow
the planting and growth of trees within the onsite planter area subject to
City staff approval
2 All future signing shall be subject to City staff review and approval prior
to its installation
3 All conditions of the Orange County Fire Marshal's office shall be complied
with, which includes an emergency crash gate along the south property
line adjacent to the rear parking area
4 A masonry trash enclosure shall be provided to the rear of the building
in place of any one parking space from 4142 to 4157, subject to City staff
approval
5 The developer shall conform to all applicable provisions of the City
Code Should vehicular access be desired to property along the south,
the developer shall obtain an agreement from the property owner to
allow vehicular drive through
6 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan shall be submitted for approval
7 A minimum six-foot (6') high block wall, measured from the highest adjacent
grade shall be maintained and/or constructed along the north and east
property lines A retaining wall per City standards shall be constructed
at the property line where the grade difference is greater than twelve
inches (12") A six-inch (6") concrete curb per City standards shall be
constructed at a minimum distance of three feet (3') from the base of all
block walls exposed to vehicular traffic
8 A landscape and irrigation plan shall be submitted for review and approval
by the City and a bond posted by the applicant to guarantee against any
defects in plant materials and workmanship A soils report for all
planting areas, by a qualified agricultural laboratory shall be submitted
to the Public Works Department for approval at least 30 days prior to
planting date Test results shall include concentration of nitrogen,
phosphorus potassium, pH, salinity, sodium status, and boron saturation
extract
9 Wheelchair and handicap access facilities shall be installed onsite and
offsite in accordance with State of California and City of Cypress Building
Department standards
10 Onsite security lighting shall be arranged so that direct rays will
not shine on adjacent properties or produce glare for street traffic
All roof -mounted equipment such as heating and air conditioning units
shall be adequately screened from public view, subject to the approval
of the City staff Commercial developments which adjoin residentially
zoned areas shall provide noise bafflers and/or deflectors on all mechanical
equipment mounted outdoors, to the satisfaction of the City staff
11 The number, location, width and type of driveway shall be subject to the
approval of the City Engineer An effective sight distance for vehicular
traffic shall be maintained at the intersection of the driveway entrances
with Walker Street No landscaping will be allowed in the area of the curb
returns Adequate sight distance also shall be maintained within the
development at all driveway intersections to the satisfaction of the City
Engineer

12 All existing public improvements at the development site which are damaged,
cracked or otherwise below standard, shall be removed and replaced to the
satisfaction of the City Engineer
13 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one inch
(1") minimum thickness asphalt concrete from curb to curb if it is necessary
to open cut the street in more than one place Any open cut shall be
backfilled per City of Cypress Standard No 110
14 Necessary fire hydrants shall be installed in accordance with Fire
Department requirements and City standards Existing street light and
street tree in conflict with future driveway shall be relocated to the
satisfaction of the City staff
15 The following fees shall be paid.
A Engineering plan checking and inspection fee (Per Resolution No 1713)
B Sanitary sewer connection fee (Per Orange County Sanitation District #3

C All applicable Building Department fees shall be paid

the objectives of the Zoning Ordinance and the purpose of the zone in

will result in the establishment of a use which will be highly
compatible with the neighborhood
3 The adjacent arterial highway has more than adequate capacity to
accommodate the increased pedestrian and vehicular traffic
generated by this use
c The. proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance except for approved variances or
adjustments
4 The Planning Commission DOES HEREBY GRANT said conditional use permit,

1 Conditional Use Permit No 78-27 is contingent upon the approval of
Amendment to the Zoning Ordinance No 78-5 by the Cypress City Council
2 All future signing for the church is subject to review and approval by
City staff prior to its installation
3 All conditions of occupancy stipulated by the Orange County Fire Marshal s
Office and City Building Department shall be satisfied
4 The parking area shall be seal coated and restriped to reflect the
revised parking plan prior to occupancy of the church facilities
5 The developer shall conform to all applicable provisions of the City Code
6 Wheelchair and handicap access facilities shall be installed onsite and
