Minutes 1974-01-17MINUTES OF A REGULAR MEETING OF THE CYPRESS PLANNING COMMISSION HELD January 17 1974 The regular meeting of the Cypress Planning Commission was called to order at 4.25 p m on Thursday January 17 1974 in the Cypress City Council Chambers 5275 Orange Avenue Cypress California, Chairman Hilliard Warren presiding PRESENT - ABSENT: Commissioners Greenwood, Mullen, Ricker and Warren Commissioner Hart Also present were Planning Director Brian Hawley and Charles Bryant, Recreation and Park Director MINUTES December 20, 1973 It was moved by Commissioner Ricker seconded by Commissioner Mullen and unani- mously carried to approve the December 20, 1973 minutes January 3, 1974 It was moved by Commissioner Ricker seconded by Commissioner Mullen and unani- mously carried to approve the minutes of January 3 1974 Mr Ron Paige, of Recreation Systems Inc the City's consultant for the park bond program, made a slide presentation illustrating the development plans for parks to be developed under the bond program Mr Paige reviewed the plans in detail and dir-ussed revisions which were deemed necessary because of cost considerations He stated that approval by the Planning Commission was necessary for the removal of artifacts at Baroldi/Sycamore Park and for the relocation of dugouts at Oak Knoll Park Mrs Evelyn Ricker 5092 Evergreen, Cypress California, addressed the Commission in regard to the revisions of the development plans She recommended that the staff notify the press so that Cypress residents may be aware of the required revisions to the plans and also suggested that an update of park development be published It was moved by Commissioner Ricker seconded by Commissioner Greenwood and unanimously carried to approve the development plan revisions and the recom- mendations of the Recreation and Park Department relative to the removal of artifacts at Saroldi/Sycamore Park and relocation of dugouts at Oak Knoll Park ORAL COMMUNICATIONS Chairman Warren inquired if anyone wished to address the Commission in regard to any matter not on the agenda There was no one wishing to speak RECESS Chairman Warren recessed the meeting at 5.53 p m to 7.30 p.m in the Cypress City Council Chambers Planning Commission Minutes January 17 1974 CALL TO ORDER. The meeting of the Cypress Planning Commission was called back to order at 7:56 p m in the Cypress City Council Chambers 5275 Orange Avenue Cypress Chairman Warren presiding PRESENT. Commissioners Greenwood Hart Mullen Ricker and Warren ABSENT None Also present were Brian Hawley Planning Director Charles Bryant, Recreation and Park Director Art Schatzeder Public Works Director and Roger Grable Deputy City Attorney PLEDGE OF ALLEGIANCE Chairman warren led the pledge of allegiance CONTINUATION OF A PUBLIC HEARING RE. ZONE CHANGE 873-6 - HARVEY PROPERTY -- SGS DEVELOPMENT COMPANY Chairman Warren announced that this was the time and place for the public hearing to consider a proposed zone change on approximately 545 acres of vacant and agricultural land generally bounded by Knott Avenue an the east the Stanton Storm Channel on the south, Walker Street on the west and Cerritos Avenue and the Southern Pacific Railroad right-of-way on the north from the MP (Planned Research and Development Park) a CG (Commercial General) and PS (Public and Semi-public) Zones to the PC (Planned Community) Zone Chairman Warren noted that this and the following public hearing would be considered concurrently CONTINUATION OF A PUBLIC HEARING RE. AMENDMENT TO THE GENERAL PLAN - MASTER PLAN OF DEVELOPMENT FOR THE HARVEY PROPERTY Chairman Warren announced that this was the time and place for the public hearing to consider a proposed amendment to the City of Cypress General Plan by the adoption of a proposed Master Plan of Development which would provide for the establishment of various land uses in the area generally bounded by Knott Avenue on the east, the Stanton Storm Channel on the south Walker Street on the west and Cerritos Avenue and the Southern Pacific Railroad right-of-way on the north The Planning Director suggested that the Commission consider adjourning this meeting to a special meeting on January 31 at which time a public hearing regarding the environmental impact report for this property was scheduled He stated that the Administrative Coordinating Team would present an analyst_ of the development proposal at that time The Deputy City Attorney reported on a new law which went into effect January 1 1974 adding a provision to the Government Code which provides that no public hearing for the purpose of bringing zoning into consistency with the General Plan shall be held within two weeks of the date on which the General Plan or any element of the Plan has been either recommended or adopted modifying that General Plan. Therefore he recommended that the Commission close the public hearing regarding Zone Change #73-6 to be in compliance with the new law Mr Karl Mazzeo 9949 Madrid Circle Cypress California inquired about the procedure the Commission was following regarding the zone change and general plan amendment hearings He stated that he felt the environmental impact report should be reviewed prior to the conduct of the hearings Planning Commission Minutes January 17 1974 Commissioner Ricker asked for a clarification of the new procedure and following discussion, it was moved by Commissioner Hart and seconded by Commissioner Mullen to close the public hearing for Zone Change #73-6 - Harvey Property -- S&S Development Company The motion was unanimously carried by the following roll call vote AYES 5 COMMISSIONERS Greenwood Hart Mullen, Ricker and Warren NOES 0 COMMISSIONERS None ABSENT 0 COMMISSIONERS None Chairman Warren asked if the applicant wished to speak at this time No one wished to be heard Chairman Warren asked if anyone wished to speak in favor of or in opposition to the proposals There was no one wishing to speak He then asked that the representative from Los Alamitos Naval Air Station make their presentation Mr Bert Aukerman, Flight Operations Supervisor at Los Alamitos Air Station presented slides which indicated the major flight patterns over the Harvey property He discussed the current and projected air operations at Los Alamitos Naval Air Station and the impact of helicopter and fixed wing aircraft activities on various land uses Mr Aukerman felt the proposed development would be incompatible with the flight operations but expressed that noise generated by the aircraft would have less of a detrimental effect on industrial than residential development Chairman Warren opened the discussion to the audience and invited speakers Mr Leo Baroldi 233 Reposeda La Habra Heights California asked if the figures regarding expanded flights were projections by Mr Aukerman or the Defence Depart- ment Mr Baroldi stated that the air station did not seem to have much concern about the exi=ting schools under the flight patterns and he discussed the noise impact of aircraft Mr Aukerman responded that the flight activity projections were his own and based on the number of hour= required to be flown by each pilot He stated that the noise and safety impact on the proposed school would be considerable but would be insignificant on existing schools under the flight patterns Mr Archie Francis 2539 Tennyson, Anaheim California, inquired if the air station had considered the impact of air pollution generated by the aircraft Mr Bernard McCune, representing the applicant S & S Construction, accused the Navy of using unfair tactics to impede development of the Harvey property Mr McCune read a letter from the Assistant Secretarl of the Navy Jack Bowers which indicated that the Defence Department has not programmed a return of jet aircraft on a regular basis the present flight activity plans keep within the framework of the environmental impact report utilizing 97 rotary and two fixed wing aircraft the majority of flight activity will be conducted on weekends, and the Defence Department has not conducted further tests for any type of increased activity Mr Fred Thorley 5250 Vista del Sol Cypress California stated the Commission should accept the fact that the Los Alamitos air station will remain and be more interested in deciding the future development of the Harvey property as soon as possible He stated that he was not as concerned about what is developed as long as it provides a decent tax base for Cypress residents Mr Thorley indicated that he has never seen advertising by the City to entice industrial development of the Harvey property and he suggested that the City consider this Planning Commission Minutes January 17 1974 Mr Donald Hudson 6153 Lawrence Street, Cypress California read portions of the Open Space and Conservation Element of the General Plan pertaining to aircraft operations and the effect of the Los Alamitos Air Station Mr Hudson stated that he felt the staff s and Commission s judgment at a more objective time was more accurate an assessment than anything presented this evening and he urged that the Commission stay with their convictions as stated in the General Plan. Mr Clarence Howard Huntington Beach California spoke in favor of the proposed development in terms of the jobs it would provide to local residents and especially to construction workers He asked that the Commission consider the present job situation and he expressed confidence in the quality of work of the developer Mr Leo Baroldi, 233 Reposada La Habra Heights California stated that he had been a resident and property owner in Cypress for many years and was interested in seeing the property become a planned development as well as provide a good tax base Mr Dale Beland representing Wilsey and Ham planning consultants for the development proposal spoke in regard to the noise impact of the air station and presented a map prepared by Los Alamitos illustrating noise zones in the area of the Harvey property as contained in the environmental impact report prepared by the Defence Department Mr Boland stated that uses wnich were most noise compatible were proposed adjacent to the air station and he felt the plan was compatible with the air station operation. tkr Ed Jabbour 11300 Providencia Street Cypres_, California speaking as president of the College Park Cypress Homeowners Association, announced the Association full support of the proposed master plan as being a plan which would provide the proper mixture of industrial commercial and residential development necessary for the financial health of the City Mr Jabbour felt it would he impossible to attract commercial development to an area which lacks proper population density and also ,mpractical for an industrial operation to exist without commercial and residential support Mr Jabbour did not favor total industrial development since he felt it would require promotional expense by the City and tax incentives being offered to prospective tenants He also noted the exorbitant expense of arterial highway improvements which the City would nave to bear as another promotional expense Mr Jabbour stated that the property owner had indicated that, if an equitable development plan i9 not approved the property could well remain an agricultural reserve for another ten or fifteen years Mr Jabbour recommended that the staff obtain further data from the Defence Department regarding the operation rf the air station Mr Norman Osborne 5792 Karen Cypress California, stated that while serving in the Navy he had seen several aircraft crashes and he did not feel residences should be developed under flight patterns. Mr Joe Hardcastle, 4588 Blanca, Cypress California spoke in opposition to high taxes resulting from lack of a tax base and he encouraged industrial development of the Harvey property He stated he felt little sympathy for people who may or may not find jobs in the proposed development or for the developer or property owner who has refused to sell the property to industrial developers while aware of the problems associated with its development Mr Hardcastle stated the City government should represent the interests of its citizens and not those of the developer or property owner and he felt it was in the City' best interest that the property be developed industriaii Planning Commission Minutes January 17 1974 Mr R E Burke 10725 Lynn Circle, Cypress California stated that when he purchased his home, which was located close to the air station he was told by the developer that no planes would be flying over his home and that the air station would gc out of existence He suggested that prospective homeowners on the Harvey property be given written notice by the developer of the number of daily flights over their homes Mr Burke stated he favored the mixture of land uses proposed in the plan Mr Don Cummings 6596 Walnut Street, Cypress California asked if the staff was going to pursue the request for independent information regarding future flights at Los Alamitos He stated that his home bordered the Harvey property and that the agricultural use caused a fly problem RECESS Chairman Warren declared a recess at 9.30 p.m. The meeting was reconvened at 10.45 p m with all Commissioners present Mrs Chris Lester 6319 Dominica Cypress California stated that although advised by Los Alamitos that no flights would be over her home she has seen helicopters directly over her yard flying at a low altitude She expressed concern over the noise impact of the flights and pointed out that noise and safety factors would have the same impact on industrial develop- ment as on residential Mrs Olivia Nutter 6339 Dominica, Cypress California inquired if the noise impact of aircraft would be compounded by truck noise generated by any industrial development Mr Aukerman was given an opportunity to respond to all of the speakers Comma io e Ha t ga`n requested that the secretary direct a communication to Federal authorities in order to obtain a firm poli_:on on the future use of the Los Alamitos Air Station It was moved by Commissioner Hart seconded by Commissioner Mullen and unani- mously carried to continue the public hearing regarding the amendment to the General Plan - Master Pian of Development for _he Harvey Property to the January 31 1974 special Planning Commission meeting ORAL COMMUNICATIONS Chairman Warren asked if anyone wished to addres.b ne Commission concerning any matter not cn the agenda The Planning Darector announced that he had ssneduled a pupil hearing for January 31 for consideration of a _cnditional use permit -equested by a Veterans group who wished to locate a meeting place in the City ADJOURNMENT It was moved by Commissioner Hart seconded fly Commissioner Mullen and unani- mously carried to adjourn the meeting at 11:05 p m to Thursday January 31 1974 at 7.30 p m ATTEST SECRETA SION CHAIRMAN OF THE PLANNING COMMISSION
