2019-07-18336 SPECIAL MEETING CYPRESS CITY COUNCIL July 18, 2019 A special meeting of the Cypress City Council was called to order at 3:47 p.m. by Mayor Berry in the Executive Board Room, 5275 Orange Avenue, Cypress, California, with Council Member Morales participating via teleconference from 411 West 4th Street, Santa Ana, CA 92701, and Council Member Yarc participating via teleconference from 3610 Rice Street, Lihue, HI 96766. ROLL CALL Cypress City Council, also acting as the Ex -Officio Governing Board of Directors of the Cypress Recreation and Park District PRESENT Mayor Stacy Berry Mayor Pro Tem Rob Johnson Council Member Paulo Morales (teleconferencing; joined at 3:51 p.m.) Council Member Jon Peat Council Member Mariellen Yarc (teleconferencing) STAFF PRESENT City Manager Peter Grant City Attorney Anthony Taylor ORAL COMMUNICATIONS (Limited to 30 minutes — three minutes per speaker, unless extended by the City Council) Beth Swift, Buena Park, spoke regarding the Buena Park Navigation Center. CLOSED SESSION The City Attorney reported that the City Council would be meeting in Closed Session regarding Conference with Legal Counsel — Existing Code Section 54956.9(a) & (d)(1), Orange County County, et al., Case No. SA CV 18 -0155 -DOC (JDEx), At 3:53 p.m., the Mayor recessed the meeting. At 4:35 p.m., the Mayor reconvened the meeting. Litigation, pursuant to Government Catholic Worker et al. v. Orange U.S. District Court, Central District. The City Attorney reported that the City Council met in Closed Session regarding Conference with Legal Counsel — Existing Litigation, pursuant to Government Code Section 54956.9(a) & (d)(1), Orange County Catholic Worker et al. v. Orange County, et al., Case No. SA CV 18 -0155 -DOC (JDEx), U.S. District Court, Central District. He stated that a motion was made by Mayor Pro Tem Johnson, seconded by Council Member Peat, to confirm participation in settlement agreement and MOU, subject to all cities in MOU participating without a cap on navigation center costs, and providing City Manager authority to complete settlement. The motion was carried with four yes votes and one no vote by Council Member Yarc.
