Resolution No. 6757M RESOLUTION NO. 6757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DELEGATING APPEALS TO THE CITY MANAGER AND AUTHORIZING THE CITY MANAGER TO ADJUST CERTAIN PAST DUE BUSINESS LICENSE AMOUNTS. WHEREAS, Chapter 15 of the Cypress Municipal Code establishes and defines licensing requirements for individuals and entities conducting business in the City of Cypress, including but not limited to, the methods for calculating annual tax and penalties (if any) owed to the City; and WHEREAS, the City's business licensing requirements are not regulatory and require individuals and entities conducting business in the City to self-report and independently apply for, and obtain, a license to be in compliance; and WHEREAS, the City Council commissioned an audit of the business license system by an independent third -party which identified a variety of unlicensed individuals and entities in the City; and WHEREAS, these unlicensed individuals and entities may owe the City business taxes and penalties; and WHEREAS, the City values its relationships with the business community, and understands working together as partners is essential to the long-term economic success of both parties, and unanticipated taxes and penalties may be a financial hardship; and WHEREAS, Section 22 of Chapter 15 of the Cypress Municipal Code provides that any individual or entity may appeal business license matters to the City Council fora hearing; and WHEREAS, delegating any such appeals to the City Manager, along with the authority to adjust certain past due business tax and penalty amounts is, in certain circumstances, expeditious and in the best interest of the City and its business community. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Cypress, hereby delegate authority to the City Manager to receive appeals and adjust the following: 1. Past due penalty amounts due from individuals and entities identified as not being in compliance by the City's third -party auditor; and Past due penalty and business tax amounts due from individuals and entities directly engaged by the City to provide a service between FY 2016-17 and FY 2018-19; and 3. Past due penalty and business tax amounts due from individuals and entities providing contract classes to the Cypress Recreation and Parks District between FY 2016-17 and FY 2018-19. All appeals for adjustment of amounts owed must be requested by noncompliant individuals and entities in writing within 90 days of receipt of the third notice from the City or its designee, and such appeal requests do not guarantee an adjustment will be approved or granted.
