RESOLUTION NO. 6760
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
FINDING THE BID SUBMITTED BY ONYX PAVING COMPANY INC. TO BE THE
LOWEST RESPONSIBLE BIDDER FOR THE "CITY OF CYPRESS RESIDENTIAL
STREET RESURFACING IMPROVEMENTS CDBG PROJECT (PROJECT 253)";
FINDING A SUBMITTED PROTEST LETTER TO BE WITHOUT MERIT; AND
AWARDING THE BID TO ONYX PAVING COMPANY INC. PURSUANT TO THE
PROCEDURES AND TERMS OF SUCH PROJECT
WHEREAS, the City of Cypress issued formal bid documents to request bidders
for a project called the "City of Cypress Residential Street Resurfacing Improvements
CDBG Project(Project 253)", which shall be referred to as"Project 253" in this Resolution
and such bid documents are incorporated herein by this reference;
WHEREAS, the City received several bids for Project 253, including a bid by Onyx
Paving Company Inc. ("Bidder");
WHEREAS, the City received a letter dated November 14, 2019, from Pavement
Coatings Co., Inc., protesting any award of Project 253 to Bidder on the basis that Bidder's
bid did not "list a subcontractor to perform the Type I and II Rubber Polymer Modified
Slurry Seals", because Bidder was required to list all subcontractors "providing labor in
excess of 0.5% of [Bidder's] total bid amount or $10,000, whichever is less" ("Protest
Letter");
WHEREAS, the City received a letter dated November 20, 2019, incorporated
herein by this reference, from Bidder stating that they did not list a subcontractor as
alleged in the Protest Letter, because the Bidder will perform such work with its in-house
forces;
WHEREAS, based upon the foregoing and the written and oral information
presented to the City Council at its meeting of January 13, 2020, (including such
information presented by City staff and members of the public), the City Council desires
to find that the Protest Letter is without merit, that the Bidder is the lowest responsible
bidder, and that Project 253 shall be awarded to Bidder.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The recitals set forth above are true and correct and incorporated
herein by this reference.
SECTION 2. Based upon the foregoing and the written and oral information
presented to the City Council at its meeting of January 13, 2020, (including such
information presented by City staff and members of the public), the City Council hereby
finds as follows:
A. The Protest Letter is without merit.
B. The Bidder is the lowest responsible bidder pursuant to applicable law.
SECTION 3. Based upon the foregoing and the written and oral information
presented to the City Council at its meeting of January 13, 2020, (including such
information presented by City staff and members of the public), the City Council hereby
awards Project 253 to the Bidder as the lowest responsible bidder pursuant to applicable
law.
SECTION 4. The City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions.

RESOLUTION NO. 6761
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
ESTABLISHING A NEIGHBORHOOD PRESERVATION PROGRAM AD HOC
SUBCOMMITTEE
WHEREAS, the City Council's Strategic Plan includes an objective to create a
Neighborhood Preservation Program; and
WHEREAS, the Neighborhood Preservation Program will help preserve and
enhance single family neighborhoods within the City of Cypress; and
NOW, THEREFORE, that the City Council of the City of Cypress resolves as follows:
Section 1. Establishment
An Ad Hoc Subcommittee is hereby established for the purpose supporting the
development of the Neighborhood Preservation Program. Council Members shall be
appointed by the Mayor and confirmed by the City Council.
Section 2. Duties of the Subcommittee
The Ad Hoc Subcommittee shall have the following duties:
A. Work with staff to advise and assist with the development of the program.
Section 3. Composition
The Ad Hoc Subcommittee shall consist of two Council Members. Staff support
shall be designated by the City Manager.
Section 4. Duration of the Subcommittee
The Ad Hoc Subcommittee shall expire at such time as the report recommending
the Neighborhood Preservation Program has been presented to the City Council, and
shall not last longer than July 30, 2020.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 13th day of January 2020.
