RESOLUTION NO. 6774
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
AND ACTING AS EX -OFFICIO GOVERNING BOARD OF DIRECTORS OF
THE CYPRESS RECREATION AND PARK DISTRICT, RATIFYING A
PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY BY
THE DIRECTOR OF EMERGENCY SERVICES
WHEREAS, Section 8A-5 of the Cypress Municipal Code designates the City
Manager as the City's Director of Emergency Services; and
WHEREAS, Section 8A-6 of the Cypress Municipal Code authorizes the Director of
Emergency Services, if the City Council is not in session, to proclaim the existence of a local
emergency when the City is affected or likely to be affected by a public calamity; and
WHEREAS, Section 8A-6 of the Cypress Municipal Code requires the City Council
to ratify the proclamation of the existence of a local emergency within seven days thereafter
or the proclamation shall have no further force or effect; and
WHEREAS, Government Code Section 8550, et seq., including Section 8558(c),
authorize the City Council to proclaim a local emergency when the City is threatened by
conditions of disaster or extreme peril to the safety of persons and property within the City
that are likely to be beyond the control of the services, personnel, equipment, and facilities
of the City; and
WHEREAS, conditions of disaster or of extreme peril to the health and safety of
persons and property have arisen both internationally and within the United States as a
result of the introduction of the novel coronavirus (COVID-19), a novel communicable
disease; and
WHEREAS, COVID-19 has spread globally, infecting more than 179,000 persons
and killing more than 7,400 individuals; and
WHEREAS, due to the expanding list of countries with widespread transmission of
COVID-19, and increasing travel alerts and warnings for countries experiencing sustained
or uncontrolled community transmission issued by the Centers for Disease Control and
Prevention (CDC), COVID-19 has created conditions that are likely to be beyond the
control of local resources and require the combined forces of other political subdivisions
to combat; and
WHEREAS, the President of the United States, the Governor of the State of
California, and the County of Orange have declared that national, state, and local health
emergencies exist; and
WHEREAS, the Governor of the State of California has released statewide
guidance, urging the highest risk population (individuals 65 years or older or those with
compromised immune systems), to self -isolate at home; and
WHEREAS, the City's ability to mobilize local resources, coordinate interagency
response, accelerate procurement of vital supplies, use mutual aid, and seek future
reimbursement by the State and Federal governments will be critical to successfully
responding to COVID-19; and
WHEREAS, the actual occurrence of the disaster under Government Code Section
8685.2 that exceeded the capacity of the City occurred starting on March 18, 2020 when
additional City resources were needed to respond to additional public demands related
to COVID-19 and including the Orange County Health Care Agency's March 17, 2020
Order of the Local Health Officer.
WHEREAS, on March 18, 2020 the Director of Emergency Services proclaimed the
existence of a local emergency as authorized by Section 8A-6 of the Cypress Municipal

Code and Government Codes Section 8630. A true and correct copy of said proclamation
is attached hereto and incorporated herein by this reference.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED, that the City Council of
the City of Cypress does hereby ratify the Proclamation of the Existence of a Local
Emergency by the Director of Emergency Services and that this local emergency shall
continue to exist until the City Council proclaims its termination at the earliest possible date
that conditions warrant.
IT IS FURTHER RESOLVED AND ORDERED, that a copy of the Proclamation of
the Existence of a Local Emergency by the Director of Emergency Services be forwarded
to the Director of California Governor's Office of Emergency Services requesting that the
Director find it acceptable in accordance with State law; that the Governor of California,
pursuant to the Emergency Services Act, issue a proclamation declaring an emergency in
the City of Cypress; that the Governor waive regulations that may hinder response and
recovery efforts; that response and recovery assistance be made available under the
California Disaster Assistance Act; and that the State expedite access to State and Federal
resources and any other appropriate federal disaster relief programs.
PASSED AND ADOPTED by the City Council of the City of Cypress, and acting
as ex -officio governing Board of Directors of the Cypress Recreation and Park District, at
a regular meeting held on the 23rd day of March, 2020.
