RESOLUTION NO. 6775
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
CALIFORNIA, RECOMMENDING ALL COMMERCIAL LANDOWNERS,
LANDLORDS, COMMERCIAL LENDERS AND UTILITY PROVIDERS
ABIDE BY GOVERNOR NEWSOM'S EXECUTIVE ORDERS
N28-20 AND N37-20
WHEREAS, on March 16, 2020, the Governor issued Executive Order N28-20,
suspending state law limitations on local jurisdictions that impose restrictions on evictions
and authorizing local governments, including the City of Cypress, to create limitations on
residential and commercial evictions; and
WHEREAS, on March 27, 2020 the Governor issued Executive Order N37-20
protecting residential renters impacted by the COVID-19 emergency; and
WHEREAS, the stated purpose of Executive Orders N28-20 and N37-20 is to
minimize the impact of COVID-19 on California; and
WHEREAS large commercial landowners and landlords in Cypress have indicated
they are committed to honoring the spirit and intent of Executive Orders N28-20 and N37-
20 and mitigating the effects of COVID-19; and
WHEREAS large commercial landowners and landlords in Cypress, including
Warland Investments Company and Cypress Land Company, have taken meaningful
proactive steps to support commercial tenants; and
WHEREAS, the City believes stability amongst commercial tenancies is conducive
to public health.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED, that the City Council of
Cypress DOES HEREBY RESOLVE as follows:
SECTION 1. To strongly encourage, and expect, all commercial landowners and
landlords in the City of Cypress to abide by the provisions of the Governor's Executive
Orders, to specifically refrain from evictions, foreclosures or rent increases, and to work
collaboratively with their tenants.
SECTION 2. To strongly encourage, and expect, all financial institutions holding
commercial mortgages, including banks, credit unions, government-sponsored
enterprises, and institutional investors to abide by the provisions of the Governor's
Executive Orders, and to implement an immediate moratorium on foreclosures of
commercial properties when the foreclosure or foreclosure -related eviction arises out of
a substantial or material decrease in income or cash flow or a substantial or material
increase in out-of-pocket expenses caused by or resulting from, directly or indirectly,
COVID-19, or by any local, state, or federal government response to COVID-19, and to
work collaboratively with borrowers.
SECTION 3. To strongly encourage, and expect, all utility providers servicing
commercial properties in the City of Cypress to abide by the provisions of the Governor's
Executive Order, and to specifically refrain from service and utility disconnections.
SECTION 4. This Resolution shall go into effect immediately upon its adoption and
shall remain in effect until the City Council proclaims the termination Cypress' local
emergency or May 31, 2020, whichever occurs first, unless an extension is deemed
necessary by further action of the City Council.
PASSED AND ADOPTED by the City Council the City of Cypress at a regular
meeting held on the 13th day of April 2020.
