The Cypress City Council conducted this meeting via webinar/teleconference in accordance with California Governor Newsom's Executive Orders N-29-20 and COVID- 19 pandemic protocols. REPORT OF WORKSHOP AGENDA/CLOSED SESSION The City Attorney reported due to lack of a quorum the City Council did not hold a discussion regarding the first Closed Session item listed on the agenda, THREAT TO PUBLIC SERVICES OR FACILITIES, pursuant to Government Code Section 54957 for consultation with Cypress Police Department Chief of Police. Regarding the second Closed Session item, Conference with Legal Counsel—Anticipated Litigation, Significant exposure to litigation — one potential case, regarding a claim of California Voting Rights Act violation from Southwest Voter Education Project, immediately upon convening the Closed Session a motion was made by Mayor Peat and seconded by Mayor Pro Tern Morales, to continue the discussion until all Council Members could attend the closed session in person. The City Attorney reported that the motion was unanimously carried by the following roll call vote: AYES: 5 COUNCIL MEMBERS: Hertz, Marquez, Minikus, Morales and Peat NOES: 0 COUNCIL MEMBERS: None ABSENT: 0 COUNCIL MEMBERS: None PRESENTATIONS Claudia Keller, Orange County Hunger Alliance, gave a presentation on Hunger Action Month. The Chief of Police introduced Officer Christopher Reihanifam and Police Service Dog Bono with handler Officer Terry Mermer. Orange County Supervisor Katrina Foley, District Two, reported on current projects and presented an Arts-Related Small Business and Nonprofit Grant to the City. 146 ORAL COMMUNICATIONS (Limited to 30 minutes — three minutes per speaker, unless extended by the City Council) Chase Wickersham, Newport Beach, spoke in support of Agenda Item No. 13. Bobby McDonald, Anaheim, spoke in support of Agenda Item No. 13. CONSENT CALENDAR All matters listed on the Consent Calendar are to be approved with one motion unless a Council Member requests separate action on a specific item. Council Member Morales stated that Agenda Item No. 11, the Warrant Register, includes electronic fund transfer no. 9839 for$795.96 for a reimbursement he receives as a retired employee of the City of Cypress. He indicated that in voting for any motion to approve the Warrant Register, he would not be voting on electronic fund transfer no. 9839 for the reason disclosed. It was moved by Mayor Pro Tem Morales, and seconded by Council Member Hertz, to approve Consent Calendar Items No. 1 through 11. Item No. 2: Introduce and/or Adopt All Ordinances and Resolutions Presented for Consideration by Title Only and to Waive Further Reading Item No. 3: Approve Minutes—Meetings of September 13, 2021 and September 14, 2021 Recommendation: Approve as submitted. Item No. 4: Award a Contract for the Neighborhood Preservation Pilot Program Recommendation: Award a contract to Willdan Engineering in an amount not to exceed $175,000 for the neighborhood Preservation Pilot Program. Item No. 5: Approve Continuing Appropriations, Revenues and Transfers from FY 2020-21 to FY 2021-22 Recommendation: 1. Authorize the appropriation of$3,399,687 in FY 2021-22 for the carryover of items from FY 2020-21, as detailed in Attachment A; and 2. Authorize the appropriation of$4,683,403 in FY 2021-22 for the carryover of items encumbered at June 30, 2021, as detailed in Attachment B; and 3. Authorize the continuation of operating transfers totaling $4,675,045 and estimated grant revenue totaling $587,414 from FY 2020-21 to FY 2021-22, as detailed in Attachment C to support carryover appropriations. 147 Item No. 6: Approve Cypress Recreation and Park District Continuing Appropriations from FY 2020-21 to FY 2021-22 Recommendation: 1. Appropriate $7,550,018 in FY 2021-22 for items encumbered at June 30, 2021; and 2. Appropriate $493,157 in FY 2021-22 for the carryover of continuing appropriations. Item No. 7: Approve Supplemental Appropriations and Increases to Estimated Revenues for FY 2020-21 Recommendation: 1. Approve FY 2020-21 supplemental appropriations of $587,764 and increase estimated revenues by $744,064 for the City; and 2. Approve FY 2020-21 supplemental appropriations of $7,800 for the Cypress Recreation and Park District. Item No. 8: Proclaim the Month of September 2021 as Hunger Action Month Recommendation: Proclaim the month of September 2021 as Hunger Action Month. COUNCIL MEMBER REPORTS AND REMARKS Council Member Minikus: No report. Council Member Marquez: Thanked Chief Lauderback for his work with the Cypress High School Football team. 149 Council Member Hertz: Thanked the Recreation and Community Services Department for their work on recent events, including the Symphony on the Go concert at Veterans Park the Cypress Art League. Reminded residents about upcoming events in the month of October. Mayor Pro Tern Morales: Spoke regarding the Hunger Action Month presentation and shared that he volunteered with HOPE food distribution program and expressed the importance of continued work in this area. Mayor Peat: Announced the State of the City will be held on Wednesday, October 6 at 5:00 p.m. on the Civic Center Green. Stated the Cypress Community Festival will take place on October 8 and 9, the Cypress Run will take place on October 16, and the Mayor's Prayer Gathering will be held on October 28. Attended the Symphony on the Go concert at Veterans Park. Announced the City will be hosting a breakfast event for all the Mayor's from Orange County Second District. CITY MANAGER REMARKS The City Manager provided information on the State of the City event. Spoke regarding the Symphony on the Go and expressed appreciation to staff for their hard work. Stated there will be a Special City Council meeting held on October 4 at 4:30 p.m. to continue the Closed Session discussion regarding the anticipated litigation item. The City Council will take a tour of Lexington Park on October 11, 2021. The City Attorney provided an update on AB361, regarding virtual public meetings, that will take effect after October 1, 2021.
