RESOLUTION NO. 6874
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS, AND ACTING AS EX-OFFICIO BOARD OF DIRECTOR
OF THE CYPRESS RECREATION AND PARK DISTRICT
AMENDING AND RESTATING RESOLUTION NO. 6748
ESTABLISHING A MASTER SCHEDULE OF FEES RELATED TO
FEES AND CHARGES FOR CERTAIN CITY AND RECREATION AND
PARK DISTRICT SERVICES AND ACTIVITIES
WHEREAS, the City Council of the City of Cypress, also acting as the ex-officio
Board of Directors for Cypress Recreation and Park District, hereby finds, determines and
declares as follows:
WHEREAS, pursuant to the provisions of the California Constitution, the laws of
the State of California, and City ordinances, the City of Cypress is authorized to adopt
and implement rates, fees and charges for certain municipal services, provided the same
do not exceed the estimated reasonable cost of providing such services; and
WHEREAS, the City, and Cypress Recreation and Park District, has heretofore
adopted resolutions establishing various schedules of rates,fees and charges for services
provided by the various City departments, including, but not limited to, rates, fees and
charges for the processing of applications, issuance of certain kinds of permits and related
public services; and
WHEREAS, for the convenience of the public it is desirable to gather in a single
document a comprehensive list of certain fees and service charges imposed by the City
for City and Cypress Recreation and Park District services; and
WHEREAS, the document, known as the Master Fee Schedule is attached to this
resolution as Exhibit A and is made a part hereof by this reference; and
WHEREAS, in amending and restating Resolution No. 6748, a Master Fee
Schedule, the Recreation and Community Services Department analyzed the cost to
administer the various programs, activities and applications for which the City proposes
to charge new or increased fees or service charges. The proposed new and increased
fees or charges do not exceed the estimated cost of service for which the fees or charges
are levied; and
WHEREAS, California Government Code Sections 66016, 66018, and 66020
require a properly noticed public hearing to be conducted prior to the adoption of a
resolution for new or increased rates, fees and/or charges for which no other specific
notice procedure is provided by law; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred.
NOW, THEREFORE, the City Council of the City of Cypress, California, does
hereby resolve and establish fees as follows:
1. The rates, fees and charges set forth in Exhibit A (the "Master Fee
Schedule") are hereby approved and adopted and shall be in full force and effect
commencing February 15, 2022. Said rates, fees and charges shall supersede and
replace any prior rates, fees and/or charges for the same service or program previously
established by the City Council.
2. The user fees set forth in Exhibit A and effective February 15, 2022 shall be
adjusted annually in accordance with the March Consumer Price Index(CPI)for All Urban
Consumers for the Los Angeles-Long Beach-Anaheim area. Such CPI adjustments shall
be effective July 1 for all subsequent years, effective July 1, 2022.
3. All provisions of previously adopted resolutions establishing or revising, or
that are otherwise inconsistent with, any of the rates, fees or charges identified in the
Master Fee Schedule including Exhibit A, attached hereto, are hereby repealed.
