A RESOLUTION OF THE CYPRESS REDEVELOPMENT AGENCY ADOPTING OWNER
PARTICIPATION RULES FOR PROPERTY OWNERS, OPERATORS OF BUSINESSES,
AND BUSINESS TENANTS FOR THE CIVIC CENTER, L INCOLN AVENUE, AND LOS
ALAMITOS RACE TRACK AND GOLF COURSE REDEVELOPMENT PROJECT AREAS,
AND TO APPLY TO THE AREA PROPOSED TO BE ADDED TO THE LINCOLN AVENUE
REDEVELOPMENT PROJECT AREA AND TO THE PROPOSED CYPRESS MERGED
AND AMENDED REDEVELOPMENT PROJECT
WHEREAS, the Cypress Redevelopment Agency ("Agency") previously adopted separate
Owner Participation Rules pursuant to Health and Safety Code Section 33345 in conjunction with
the adoption of each of the Redevelopment Plans for the Civic Center (Original and Amendment
Area), Lincoln Avenue, and Los Alamitos Race Track and Golf' Course ("CART") Redevelopment
Project Areas; and
WHEREAS, the Agency has initiated the process to (1) amend the Lincoln Avenue
Redevelopment Plan to add territory ("Added Area") to the Lincoln Avenue Project Area, (2) merge
for financial reasons the three Redevelopment Plans (including; the Added Area), pursuant to the
merger provisions of the Community Redevelopment Law (Health & Safety Code § 33000 et seq.),
and (3) adopt a single updated, amended, and restated Redevelopment Plan for the Cypress Merged
and Amended Project Area; and
WHEREAS, Health and Safety Code Section 33345 requires that prior to the adoption of the
proposed amendment to add the Added Area to the Lincoln Avenue Project Area, the Agency adopt
new Owner Participation Rules to be applicable to the Added Area if such amendment to add the
Added Area is later adopted by the City Council after a joint public hearing with the Agency to
consider such amendment; and
WHEREAS, the three separate Owner Participation Rules currently applicable to each of the
three existing Project Areas are fifteen years old and require updating; and
WHEREAS, instead of adopting new Owner Participation Rules applicable to just the
Added Area and maintaining the three separate and outdated Owner Participation Rules applicable
to the Civic Center, Original Lincoln Avenue, and CART Project Areas, it is prudent to adopt a
new, single set of Owner Participation Rules to be applicable to (a) all three Project Areas, (b) the
Added Area, if the amendment to add the Added Area is later adopted, and (c) the proposed
Redevelopment Plan for the Cypress Merged and Amended Project Area ("Merged Plan"), if such
merger and the Merged Plan are later adopted; and
WHEREAS, Agency staff and consultant have prepared such updated "Owner Participation
Rules for Property Owners, Operators of Businesses, and Business Tenants" in accordance with
Health and Safety Code Section 33345 to implement the operation of owner participation in the
three existing Project Areas, the Added Area (with the rules to be applicable if the amendment to
add the Added Area is later adopted), and the merger and Merged Plan (with the rules to be
applicable to the Merged Plan if the Merged Plan is later adopted); and
WHEREAS, pursuant to the requirements of the current Owner Participation Rules which
the proposed new Owner Participation Rules would supersede, Agency staff provided timely written
notice to the Agency Board that such new Owner Participation Rules would be considered for
adoption at the Agency meeting of February 14, 2005; and
WHEREAS, all actions required to be taken precedent to the adoption of this Resolution
have been duly and regularly taken in accordance with applicabef; law.
NOW, THEREFORE, the Cypress Redevelopment Agency DOES HEREBY RESOLVE
as follows:
SECTION 1. The Owner Participation Rules for Property Owners, Operators of
Businesses, and Business Tenants for the Civic Center Redevelopment Project Area, Lincoln
Avenue Redevelopment Project Area (and including the Addecl Area if the amendment to add the
Added Area is later adopted), and Los Alamitos Race Track and Golf Course Redevelopment

Project Area, and also applicable to the Cypress Merged and Amended Project Area (if the
proposed merger and Merged Plan are later adopted), attached hereto as Exhibit 1 and by
reference made a part hereof, is hereby approved and adopted.
SECTION 2. The Agency Executive Director is hereby authorized and directed to make
the Owner Participation Rules adopted hereby available for public review and inspection to any
person requesting same in the same manner and subject to the same rules as other public Agency
documents.
ADOPTED AND APPROVED by the Cypress Redevelopment Agency of the City of
Cypress at a regular meeting held on the 14`h day of February, 2005.
