They’re not going to appeal to the supremes after all — advocates talked them out
of it.
Here’s an excerpt from the Disability Rights Bar Assn’s morning listserv. You
gotta grab and celebrate victories like this, otherwise it’s going to feel pretty grim
waking up every day to the headlines about Ukraine hell and Biden’s inability to
get voting rights enacted.
I want to also make note that advocates managed to talk another case out of
Supreme Court consideration late last year, so thus far the strategy is working to
keep all disability rights cases away from this Supreme Court, which would
promptly take the opportunity to interpret laws as narrowly as humanly possible.
We lived through a Supreme Court ADA backlash more than a dozen years ago,
and had to return to Congress for a fix. This time there’s no returning to Congress
for a fix, so everyone is hell bent on avoiding the Supremes at all costs for the
foreseeable future until Dems are fully in control of the other two branches of
government.

I woke up to Paul’s email and leapt out of bed with
optimism I haven’t had in a while. This was such an
amazing community effort led by Paul Grossman and
Claudia Center. I am in awe of their ability to rally the
troops, organize concerted and effective action, and get
key players to use their capital. All the while, they were
so cool and collected (while I’m half bald just from
watching)! I want to arrange a trip out to San Francisco
just so I can take them out to an over-the-top dinner
and gush praise to them. But until that can happen –
