You inquired, “Can code enforcement do anything about their lack of compliance regarding the trash cans? Can we add more specific language to Ordinance 3.10.090 Property Maintenance. The proposed language is below: When placing bins out for collection place them out on the street against the curb on own driveway garage approach so that the containers do not impede pedestrian or disabled accessibility on the public sidewalk or right of way.” Planning analyzed the feasibility of an ordinance requiring (on trash pickup days) the placement of trashcans in the right-of-way (ROW) in front of the trash customer’s residence. Currently, trashcans are permitted within the ROW at 6pm the day before trash day and must be removed 24 hours after pick-up. The Municipal Code is silent on where within the ROW residents place their trashcans because the street is not private property. Planning believes an ordinance designating the location of trashcans within the ROW (for a 24-hour period once a week) would be impossible to enforce. Enforcement would require Code Enforcement to physically witness a resident place cans in an improper location, which is infeasible considering cans can be placed in the ROW any time from 6pm the night before until trash collection the next day. The City could not enforce an ordinance after Valley Vista empties the cans because the resident is no longer responsible for the can’s placement. Similarly, once a resident put a can in the ROW, there is no way to determine who may have moved it. It is our experience that cities should not create ordinances in response to one resident’s complaint; and the city has not received any other similar complaint. If you or Mrs. Kim are aware of other city’s ordinances that effectively address this concern, please share them with us so we can follow-up. What we can do is have Code Enforcement will contact VVS and request it place emptied cans in front of a resident’s property. This will ensure that VVS will return cans to the ROW in front of a residence, even if the resident did not put their cans in the ROW in front of their home. Code Enforcement will also send a notice to all residents on St. Stephens Circle reinforcing trashcan etiquette. Please let me know if you have any questions. Last week I went to visit Ms. Kim and saw that the neighbors trash cans were placed directly in front of her home near his car and the trash guy had to get out of the truck to place the bins correctly. This is a problem because he should place them in front of his driveway. Moreover, I am also concerned about their safety because when I took these pictures a large man came out of the house and looked at me and pointed his hand at his head like he was shooting his head. I drove away and was concerned about my safety as well. Can code enforcement do anything about their lack of compliance regarding the trash cans?
