A special meeting of the Cypress City Council was called to order at 2:04 p.m. by Mayor
Morales in the Council Chambers, 5275 Orange Avenue, Cypress, California.

Steven Mauss, Cypress, spoke about civility between Council Members.
Malini Nagpal, Cypress, expressed support for Council Member Marquez.
Troy Tanaka, Cypress, expressed support for Council Member Marquez.
ITEMS FROM CITY COUNCIL MEMBERS
Item No. 1: Direct Council Member Marquez to Comply with the California Public
Records Act
Mayor Morales provided a report on this item.
City Council discussion ensued.
A motion was made Council Member Peat, and seconded by Council Member Minikus,
to direct Council Member Marquez to immediately provide the City Clerk with a complete
response to the request by Fortis, LLP under the Public Records Act; direct Council
Member Marquez to immediately provide the City Attorney with a complete response to
questions from Fortis, LLP regarding her claim of attorney client privilege for city-held
records requested by Fortis, LLP under the Public Records Act; direct the City Clerk to
release all records for which Council Member Marquez claimed attorney client privilege
with personal legal counsel by Monday, June 13 at 9:00 AM if Council Member Marquez
has not provided a complete written legal justification in response to Fortis, LLP; direct
Council Member Marquez to immediately provide the City Clerk with records requested
by Californians Aware under the Public Records Act; and direct Council Member Marquez
to adhere to all Public Records Act requests deadlines from city management.
The motion was carried by the following roll call vote:

Item No. 2: Require Council Members to Adhere to Public Records Act Response
Deadlines Established by City Management
Mayor Morales provided a report on this item.
A motion was made by Council Member Minikus, and seconded by Council Member Peat,
to require Council Members to adhere to Public Records Act response deadlines
established by City Management.
The motion was unanimously carried by the following roll call vote:

Item No. 3: Authorize the City Manager to Retain Special Legal Counsel to Assist
in Responding to Public Records Act Requests

A motion was made by Mayor Pro Tem Hertz-Mallari, and seconded by Council Member
Peat, to authorize the City Manager to retain special legal counsel to assist in responding
to Public Records Act requests.

Item No. 4: Place a Resolution on the June 13, 2022, City Council Agenda
Censuring Council Member Marquez for Violating the Laws of the State of
California by Failing to Respond to Public Records Act Requests, Failing to
Respond to Public Records Act Requests in a Timely Manner, and Disclosing
Confidential Information from Closed City Council Session(s); Violating the
Charter; Violating the Code of Ethics; and Violating the Civility, Conduct and
Governance Policy
Mayor Morales provided a report on this item.
City Council discussion ensued.
A motion was made by Council Member Peat, and seconded by Council Member Minikus,
to add the attached Resolution 1 to a future agenda for City Council consideration.
The motion was carried by the following roll call vote:

NOES: 1 COUNCIL MEMBERS: Marquez

A motion was made by Council Member Peat, and seconded by Council Member Minikus,
to place Resolution 1 on the agenda of the regular City Council meeting on June 27, 2022
for consideration.

ADJOURNMENT
A motion was made by Council Member Peat, seconded by Council Member Minikus,
and unanimously carried 5-0, to adjourn the meeting at 3:40 p.m. The next meeting will
be an adjourned Regular Meeting will be held on Monday, June 1 20 2, beginning at
5:30 p.m. in the Executive Board Room.
