A special meeting of the Cypress City Council was called to order at 3:00 p.m. by Mayor Morales in the Executive Board Room, 5275 Orange Avenue, Cypress, California. CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL— EXISTING LITIGATION Pursuant to Government Code Section 54956.9(d)(1) Californians Aware v. City of Cypress Case No. 30-2022-01260088-CU-CR-CJC Orange County Superior Court CONFERENCE WITH LEGAL COUNSEL— EXISTING LITIGATION Pursuant to Government Code Section 54956.9(d)(1) Southwest Voter Registration Education Project v. City of Cypress Case No. 30-2022-01270865-CU-CR-CJC Orange County Superior Court Mayor Morales recessed the meeting at 3:03 p.m. Mayor Morales reconvened the meeting at 3:31 p.m. REPORT OF CLOSED SESSION The City Attorney reported that the City Council met in Closed Session regarding the two items listed on the agenda. First item listed on the agenda, Conference with Legal Counsel — Existing Litigation, the matter of Californians Aware v. City of Cypress and the second item, Conference with Legal Counsel — Existing Litigation, the matter of Southwest Voter Registration Education Project v. City of Cypress. The City Attorney further reported that the City Council held discussions and received an update on each item and no further reportable action was taken. 298 NEW BUSINESS Item No. 1: Receive and File Public Comments Submitted for the July 29, 2022 Special City Council Meeting The City Clerk reported that no public comments were submitted. No action was taken. Item No. 2: Approve a Resolution Creating an Ad Hoc Subcommittee to Advise the City Attorney and City Manager Regarding Litigation from the Southwest Voter Registration Education Project, Et Al. and Authorize the City Manager to Retain Special Legal Counsel to Respond to the Complaint The City Attorney provided a report on this item. The Mayor stated his recommendation that the Mayor and Mayor Pro Tern serve as the ad hoc subcommittee members to advise the City Attorney and City Manager regarding litigation from the Southwest Voter Registration Education Project, et al. City Council discussion ensued. A motion was made by Council Member Peat, and seconded by Council Member Minikus, to adopt a resolution creating an ad hoc subcommittee, consisting of Mayor Morales and Mayor Pro Tern Hertz-Mallari, to advise the City Manager and City Attorney regarding litigation from the Southwest Voter Registration Education Project, et al.; and authorize the City Manager to retain special legal counsel to respond to the complaint.
