Resolution No. 6911 317 RESOLUTION NO. 6911 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, DELEGATING TO THE CITY MANAGER CERTAIN OVERSIGHT RESPONSIBILITIES FOR THE OFFICE OF THE CITY CLERK WHEREAS, the City Charter of the City of Cypress, at Section 500, specifies that the City Clerk shall be appointed by the City Council; and WHEREAS, the City Charter of the City of Cypress, at Section 500, specifies that the City Clerk shall serve at the pleasure of the City Council; and WHEREAS, the City Council desires to delegate certain of its oversight functions with respect to the City Clerk to its City Manager in the interest of efficiency of governmental operations, lack of collective time to perform such oversight function, and because the City Manager is charged, pursuant to City Charter § 601 and the Cypress Municipal Code § 2-12, 2-15, 18-4, and 18-6, with regulating the day-to-day operations of the City of Cypress, and its employees, under the Cypress Council-Manager form of government; and WHEREAS, the City Council desires to provide input to the City Manager on the annual written performance evaluation of the City Clerk and to receive a copy of the annual written performance evaluation of the City Clerk. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY FIND, DETERMINE, RESOLVE AND ORDER AS FOLLOWS: 1. The foregoing recitals are true and correct. 2. The City Manager of the City of Cypress is hereby delegated all day-to-day personnel oversight responsibility for the City Clerk, including, but not limited to, supervising the City Clerk's performance of the duties of the office as set forth in City Charter§ 501, supervising the administration of the City's personnel rules and regulations to the extent the same apply to the City Clerk, supervising the payroll, benefits, leave accruals and usage, and other salary functions of the City to the extent the same apply to the City Clerk, and to perform such other oversight responsibilities as the City Council may assign from time-to-time. 3. The City Manager of the City of Cypress is hereby charged with the responsibility of preparing, and then forwarding to the City Council, an annual written performance evaluation of the City Clerk. 4. The City Council may request a closed session evaluation of the City Clerk following an affirmative written request of a minimum of two Council Members. 5. The City Council expressly retains the authority, pursuant to City Charter § 500, over the appointment, tenure, and removal of the City Clerk, and nothing in this resolution shall be deemed to constitute an abrogation of the same. This Resolution shall be effective upon its adoption. The City Clerk shall certify the adoption of this Resolution.
