2022-12-12 343 REGULAR MEETING CYPRESS CITY COUNCIL DECEMBER 12, 2022 6:00 P.M. A regular meeting of the Cypress City Council was called to order at 6:07 p.m. by Mayor Morales in the Council Chambers, 5275 Orange Avenue, Cypress, California. Pursuant to Government Code section 54953(b), this Regular City Council Meeting included teleconference participation by Mayor Pro Tem Anne Hertz-Mallari from Cypress City Hall, 5275 Orange Avenue, Cypress CA 90630 ROLL CALL Cypress City Council, also acting as the Ex-Officio Governing Board of Directors of the Cypress Recreation and Park District Mayor Paulo Morales Mayor Pro Tern Anne Hertz-Mallari (via teleconference) Council Member Frances Marquez Council Member Scott Minikus Council Member Jon Peat STAFF PRESENT City Manager Peter Grant City Attorney Fred Galante Director of Finance and Administrative Services Matt Burton Director of Public Works Doug Dancs Director of Recreation and Community Services Jeff Draper Chief of Police Mark Lauderback Planning Director Alicia Velasco City Clerk Alisha Farnell Office Assistant Christina Dizol PLEDGE OF ALLEGIANCE Council Member Jon Peat led the Pledge of Allegiance. INVOCATION Pastor Mike McKay, Cypress Neighborhood Church, led the Invocation. ORAL COMMUNICATIONS (Limited to 30 minutes — three minutes per speaker, unless extended by the City Council) Katie Shapiro, Cypress, thanked Mayor Morales and Council Member Peat for their service on the City Council and congratulated David Burke, Scott Minikus, and Bonnie Peat on their election. Bob Youngsma, Cypress, congratulated new Council Members on their election. SPECIAL ORDER OF BUSINESS Item No. 1: Adopt Resolution Declaring the Results of the November 8, 2022 General Municipal Election The City Clerk provided a report on this item. It was moved by Mayor Pro Tem Hertz-Mallari, and seconded by Council Member Peat, to adopt a Resolution declaring the results of the November 8, 2022 General Municipal Election. The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCIL MEMBERS: Marquez, Minikus, Peat, Hertz-Mallari and Morales NOES: 0 COUNCIL MEMBERS: None ABSENT: 0 COUNCIL MEMBERS: None 344 RESOLUTION NO. 6919 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, DECLARING THE RESULT AND SUCH MATTERS AS PROVIDED BY LAW Item No. 2: Recognition of Outgoing Council Members Elizabeth Lavezzari, representing Senator Josh Newman, presented a Certificate of Recognition to outgoing Mayor Paulo Morales and Council Member Jon Peat. Senator Janet Nguyen presented a Certificate of Recognition to outgoing Mayor Paulo Morales and Council Member Jon Peat. Liliana Jimenez, representing Assemblywoman Sharon Quirk-Silva, presented a Certificate of Recognition to outgoing Mayor Paulo Morales and Council Member Jon Peat. Item No. 3: Remarks by Outgoing Council Members Mayor Pro Tem Hertz-Mallari thanked Mayor Morales and Council Member Peat for their service on the City Council. Council Member Peat and Mayor Morales spoke regarding their service on the City Council and thanked staff and the community for their dedication to Cypress. Mayor Morales recessed the meeting at 6:44 p.m. Mayor Pro Tern Hertz-Mallari reconvened the meeting at 6:57 p.m. Item No. 4: Oath of Office for Newly-Elected Council Members The City Clerk Administered the Oath of Office and presented Certificates of Election to newly-elected Council Members David Burke, Scott Minikus, and Bonnie Peat. Item No. 5: City Council Reorganization The City Clerk opened the nominations for Mayor. A motion was made by Council Member Minikus, seconded by Council Member Peat, to nominate Mayor Pro Tern Hertz-Mallari for the office of Mayor. Mayor Pro Tern Hertz-Mallari was unanimously elected Mayor by the following roll call vote: AYES: 5 COUNCIL MEMBERS: Burke, Marquez, Minikus, Peat and Hertz-Mallari NOES: 0 COUNCIL MEMBERS: None ABSENT: 0 COUNCIL MEMBERS: None The City Clerk opened the nominations for Mayor Pro Tern. It was moved by Mayor Hertz-Mallari and seconded by Council Member Peat, to nominate Council Member Minikus to the office of Mayor Pro Tern. A substitute motion was made by Council Member Burke, and seconded by Council Member Marquez, to nominate Council Member Marquez to the office of Mayor Pro Tern. The substitute motion failed by the following roll call vote: AYES: 2 COUNCIL MEMBERS: Burke and Marquez NOES: 3 COUNCIL MEMBERS: Minikus, Peat and Hertz-Mallari ABSENT: 0 COUNCIL MEMBERS: None 345 The original motion passed by the following roll call vote: AYES: 3 COUNCIL MEMBERS: Minikus, Peat and Hertz-Mallari NOES: 2 COUNCIL MEMBERS: Burke and Marquez ABSENT: 0 COUNCIL MEMBERS: None Item No. 6: Remarks by Newly-Elected Council Members Council Members Burke, Minikus and Peat provided comments. CONSENT CALENDAR All matters listed on the Consent Calendar are to be approved with one motion unless a Council Member requests separate action on a specific item. A motion was made by Mayor Pro Tern Minikus, seconded by Council Member Marquez, to approve the Consent Calendar item No. 7. The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCIL MEMBERS: Burke, Marquez, Peat, Minikus and Hertz-Mallari NOES: 0 COUNCIL MEMBERS: None ABSENT: 0 COUNCIL MEMBERS: None Item 7: Approve the 2023 City Council Meeting Schedule Recommendation: Approve the 2022 City Council meeting schedule. END OF CONSENT CALENDAR ORAL COMMUNICATIONS (Five minutes per speaker, unless extended by the City Council) Rachel Strong, Cypress, spoke regarding Strong Ballet Academy Nutcracker performance and congratulated Council Members.
