Resolution No. 4458 44s --- � 257 RESOLUTION NO. 4458 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF SECTION 13.4-3.A. OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW A SATELLITE DISH ANTENNA LESS THAN TEN (10) FEET FROM ANOTHER STRUCTURE. VARIANCE NO. 95-2 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of Section 13.4-3.A. of the Zoning Ordinance of the City of Cypress to allow satellite dish antenna to remain less than ten (10) feet from a residential structure located at 9538 Naples Drive, within the PC-25A Planned Community Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: (a) The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant/property owner of privileges enjoyed by the owners of other properties in the same zone. (b) The granting of the variance as conditioned will not constitute the granting of a special privilege inconsistent with the limitations on other properties in the vicinity classified in the same zone. (c) The granting of the variance as conditioned will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. (d) Locating the antenna in conformance with the required specifications would obstruct the antenna's reception window or otherwise excessively interfere with reception, and such obstruction or interference involves factors beyond the applicant's control; or the cost of meeting the specifications of the specified regulation is excessive, given the cost of the antenna. (e) The granting of the variance, as conditioned, will require the applicant to provide certification by a registered engineer that the antenna installation is in conformance with applicable City Building Code regulations. (f) The antenna, as conditioned, is consistent with neighboring improvements, uses, and architectural character. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Variance No. 95-2, subject to the following conditions: 1. The applicant/property owner shall obtain the necessary permits for the satellite dish antenna in accordance with the requirements of the Building Division of the City of Cypress. 2. The applicant and antenna installer shall comply with applicable provisions of the 1991 Uniform Building, Plumbing and Mechanical Codes, 1990 National Electrical Code, California Code of Regulations, Title 24, and the Code of the City of Cypress. Structural calculations (two sets, wet-signed and stamped) shall - 1 - 258 be submitted to the Building Division for plan check prior to issuance of a building permit for the antenna. 3. The applicant shall provide landscaping along the north, south, and east property lines, to the satisfaction of the Planning Director, to soften any visual impact of the satellite dish.
