A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
RESCINDING RESOLUTION NO. 1267 AND DECLARING THAT PRO-
CEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE
CITY OF CYPRESS TO ANNEX TO SUCH CITY CERTAIN UNINHABITED
TERRITORY DESCRIBED THEREIN AND DESIGNATED AS "ANNEXATION
NO. 72-2" SETTING FORTH ITS REASONS FOR DESIRING ANNEXATION
AND GIVING NOTICE OF THE TIME AND PLACE SUCH CITY COUNCIL
WILL HEAR WRITTEN PROTESTS AGAINST SUCH ANNEXATION.
BE IT RESOLVED by the City Council of the City of Cypress as follows:
Section 1. That, pursuant to the provisions of the Annexation of Uninha-
bited Territory Act of 1939, proceedings have been initiated by the City Council
of the City of Cypress, on its own motion, to annex to the City of Cypress all
that uninhabited territory situated in the County of Orange, State of California,
herein designated as "Annexation No. 72-2" and described as follows:
A parcel of land situated in the County of Orange, State of California,
and being a portion of Lot 32 and Lot 33 of Tract No. 542 as shown on
a map recorded in Book 18, page 10 of Miscellaneous Maps, in the office
of the County Recorder of said Orange County, described as follows:
Beginning at a point in the existing corporate boundary of the City of
Cypress as established by the Taylor Annexation, said point being distant
S 89° 41' 30" W, 60.00 feet from the northeast corner of said Annexation,
said point also being the intersection of the south line of said Tract
No. 542 and the east line of said Lot 33 of said Tract.
THENCE (1) S 89° 41' 30" W, 120.00 feet along said south line and
corporate boundary to the west line of said Lot 32.
THENCE (2) departing from said corporate boundary, N 0° 25' 45" W
139.50 feet, along the west line of said Lot 32, to the north line of
the southerly 139 .50 feet of Lot 32.
THENCE (3) N 89° 41' 30" E, 60.00 feet, along said north line to the
west line of Lot 33.
THENCE (4) S 0° 25' 45" E, 19.50 feet along said west line to the north
line of the southerly 120.00 feet of Lot 33.
THENCE (5) N 89° 41' 30" E, 60.00 feet along said north line to the
east line of Lot 33.
THENCE (6) S 0° 25' 45" E, 120.00 feet along said east line, to the
point of beginning in said corporate boundary of the City of Cypress.
Containing .22 acre of land,more or less.
Section 2. That the City Council of the City of Cypress desires to annex
said uninhabited territory to the City of Cypress for the following reasons:
The territory is contiguous to the City of Cypress; its proposed annexation
will contribute to and facilitate the orderly growth and development of both
the City of Cypress and the territory proposed to be annexed; its proposed
annexation will facilitate and contribute to the proper and orderly layout,
design and construction of streets, gutters, sidewalks, sanitary and street
sewers and drainage facilities, both within the City of Cypress and the
territory proposed to be annexed; and its proposed annexation will provide
and facilitate a proper overall planning and zoning of lands and subdivisions
of lands in the City of Cypress and in said uninhabited territory in a manner
most conducive to the welfare of said City of Cypress and said uninhabited
territory.
";WrEe4tion 3. That the Local Agency Formation Commission of Orange County,
California, on April 26, 1972, approved "Annexation No. 72-2 -"
Section 4. That September 11, 1972, at the hour of 8:00 p.m. , in the Council
Chambers of the City Hall of the City of Cypress, County of Orange, State of
California, located at 5275 Orange Avenue, Cypress, California, is hereby
fixed as the time and place when and where any owners of real property within
such territory proposed to be annexed, having any objections to such proposed
annexation, may appear before the City Council of the City of Cypress and show
cause why such uninhabited territory should not be so annexed to the City of
Cypress. Such protest must be in writing and may be filed at any time prior
to final adjournment of such hearing on protests. The protest shall state
the name of the owner of the property affected and the street address or other
description of property sufficient to identify it on the last equalized
assessment roll.
Section 5. That since there is no newspaper of general circulation pub-
lished within the City of Cypress, the City Clerk of the City of Cypress hereby
is authorized and directed to post a copy of this Resolution not less than
twenty (20) days before the hearing in at least three (3) conspicuous places
within such territory proposed to be annexed. The City Clerk of the City of
Cypress further is authorized and directed tc cause said notice to be published
in a newspaper of general circulation published outside the City of Cypress, but
within the County of Orange in accordance with Section 35311 of the Government
Code of the State of California. The City Clerk of the City of Cypress further
is authorized and directed to cause written notice of such proposed annexation
to be mailed at least twenty (20) days prior to the date set for such hearing,
to each person to whom land within such territory proposed to be annexed is
assessed on the last equalized assessment roll available on the date the
proceedings were initiated, at the address shown on said assessment roll,
or as known to the City Clerk, and to any person who has filed his name and
address and the designation of such lands in which he has any interest, either
legal or equitable, with said City Clerk. The City Clerk of the City of
Cypress further is authorized and directed to cause written notice to be
given to such other persons as legally may be entitled thereto in the manner
provided by law.

meeting held on the 24th day of July, 1972,
