A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
RELATING TO ENVIRONMENTAL IMPACT STATEMENTS.
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES FIND, DECLARE, AND RESOLVE AS
FOLLOWS:
A. Situations where building permits only are required.
It is hereby found and determined that the following categories of con-
struction cannot have a significant impact on the environment:
1, In any single-family residential zone.
(a) Additions to existing single-family residential structures and
garages, which additions, without requirement of a variance,
comply with requirements of the zoning ordinance and all other
applicable ordinances;
(b) Fences, patios, swimming pools and other incidental structures
which, without requirement of a variance, comply with require-
ments of the zoning ordinance and all other applicable ordinances;
(c) Single-family construction and appurtenant facilities on any lot
in a recorded subdivision where there are completed single-family
residences on fifty percent (50%) or more of the lots in that
subdivision, which new construction will, without requirement
of a variance, comply with requirements of the zoning ordinance
and all other applicable ordinances.
2. In any commercial or multiple residential zone.
Construction of a building and appurtenant facilities on a lot
in a recorded subdivision where there are permanent structures
within the subdivision on seventy-five percent (75%) or more of
the lots, and where no variance or conditional use permit or
other permit under the zoning ordinance is in effect or required,
which will comply with requirements of the zoning ordinance and
all other applicable ordinances, and which does not have an
estimated construction cost for building permit purposes in
excess of $200,000.00,
3. In all zones.
Construction pursuant to a subsidiary permit (e.g. , plumbing,
electrical) where the principal permit has heretofore issued.
The Building official is instructed to process and issue building
permits within the foregoing classifications where the same meet
all code requirements, Before other building permits are issued,
the same shall be referred to the City Council prior to issuance.
As to such other requested permits, if the City Planner or any staff
acting in that capacity determines that the same may have a substantial
impact on the environment, an environmental impact statement shall
be furnished to the Council ,
B. Situations where the applicant believes that the effect of his development
is trivial and where an entitlement to use is required.
Situations of this type would include situations where
(1) The applicant believes that the effect of his development on the
environment is trivial and
(2) (a) A zone change is required or
(b) A conditional use permit is required or
(c) A variance is required or

(d) A zoning determination is required or
(e) A tentative tract map is required or
(f) A final tract map is required or
(g) Architectural review is required or
(h) A building permit (for a use other than described in Part A)
is required.
The City Council expects that many permits or other entitlement to use
will be sought by individuals whose development will probably have a
trivial effect on the environment. In situations where the applicant
does feel that his development will have a trivial effect on environ-
ment the applicant will be required to submit to the City together
with his application, the "Short Project Environmental Evaluation
Form", an official copy of which is on file in the Office of the City
Clerk with additional copies available through the Planning Department.
The Planning Director will then review the "Short Project Environmental
Evaluation Form" to determine its accuracy. The appropriate city agency
making the decision with respect to the particular application (e.g.,
the City Council, the Planning Commission, the Zoning Administrator,
or the Building Official) will then, prior to making a decision on
the application, consider and evaluate the "Short Project Environmental
Evaluation Form" and the comments of the Planning Director. Prior
to the issuance of the permit or other entitlement to use in question,
the appropriate city agency (e.g., the City Council, the Planning
Commission, the Zoning Administrator, or the Building Official) shall
make a finding to the effect that the applicant's development will
have a trivial effect on the environment if the appropriate city
agency so decides.
C. Situations where full environmental impact statement is required.
In situations where the applicant believes that the development
proposed will have a significant effect on the environment the
applicant shall prepare and submit to the city an environmental
impact statement complying with the provisions of law. In
situations where the appropriate city agency (e.g., the City Council,
the Planning Commission, the Zoning Administrator, or the Building
Official) believes that the environmental impact of the proposed
development is significant (i.e. non-trivial), then an environmental
impact statement shall be submitted to the appropriate city agency
whether or not the applicant agrees that the proposed development
has a significant impact upon the environment. The environmental
impact statement shall be considered by the appropriate city agency
prior to any action upon the application and environmental impact
statement shall comply with the requirements of law.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 10th day of October, 1972.
