A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
PROVIDING FOR THE DEFENSE BY COUNTY COUNSEL OF ACTIONS
BROUGHT AGAINST THE CITY FOR REFUND OF PROPERTY TAXES
OR RECOVERY OF PROPERTY TAXES PAID UNDER PROTEST.
WHEREAS, the collection of property taxes for the City of Cypress is performed
by the Tax Collector for the County of Orange; and
WHEREAS, the City Council desires the office of the County Counsel for said
county to defend all actions brought against the city for the refund of property
taxes or the recovery of property taxes paid under protest; and
WHEREAS, Sections 5103 and 5138 of the California Revenue and Taxation Code
authorize any city for which county officers collect taxes to provide for the
defense by county counsel of actions brought against the city for the refund
of property taxes or recovery of property taxes paid under protest, in which
event it shall be the duty of such counsel to defend such actions.
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby provided that all actions brought against the City of
Cypress for the refund of property taxes or the recovery of property
taxes paid under protest shall be defended by the office of the County
Counsel for the County of Orange.
2. The city clerk is hereby directed to send a certified copy of this
resolution to the office of the County Counsel for the County of
Orange.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 13th day of February, 1973.
