REPORT OF CLOSED SESSION / WORKSHOP The City Attorney reported that the City Council met in Closed Session and held a discussion regarding the first item listed on the agenda, Conference with Labor Negotiator concerning the employee group Cypress Employees' Association, Cypress Maintenance Employees' Association. He stated the City Council received on update and no further reportable action was taken. Regarding the second Closed Session item listed on the agenda, namely Conference with Legal Counsel — existing litigation, the matter of Southwest Voter Registration Education Project v. City of Cypress. The City Attorney stated the City Council received a briefing on the status of the matter and no further reportable action was taken. Regarding the third Closed Session item listed on the agenda, namely Conference with Legal Counsel — anticipated litigation, he stated the City Council would recess back into Closed Session following the open session. ORAL COMMUNICATIONS ON AGENDA ITEMS None. CONSENT CALENDAR All matters listed on the Consent Calendar are to be approved with one motion unless a Council Member requests separate action on a specific item. Mayor Pro Tem Minikus stated that Agenda Item No. 8, the Warrant Register, includes electronic fund transfer No. 13844 for $294.34 as reimbursement for medical coverage he is entitled to receive as a CaIPERS annuitant. He indicated that in voting for any motion to approve the Warrant Register, he would not be voting on electronic fund transfer No. 13844 for the reason disclosed. Council Member Marquez requested to pull Agenda Item No. 4. A motion was made by Council Member Peat, and seconded by Council Member Marquez, to approve Consent Calendar items No. 1 through 3 and 5 through 8. RESOLUTION NO. 6948 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS AUTHORIZING SUBMITTAL OF INDIVIDUAL GRANT APPLICATIONS FOR ALL GRANT PROGRAMS FOR WHICH THE CITY OF CYPRESS IS ELIGIBLE Item No. 5: Approve an Amendment to the Custodial Services Contract for City Facilities Recommendation: Approve a $4,844 contract amendment with United Maintenance Systems for custodial services at City Facilities for the period of November 2023 through July 2024. Item No. 6: Award Contract for Shade Structure Replacement at Eucalyptus, Project 364 Recommendation: 1. Approve Plans and Specifications for Shade Structure Replacement at Eucalyptus Park, Project 364; and 2. Award a contract to R.E. Schultz Construction, Inc. for $72,610, and authorize a contingency of$10,800. Item No. 7: Receive and File Investment Report for the Month Ended September 30, 2023 Recommendation: Receive and file the attached investment report. Item No. 8: Receive and File Register of Warrants, Transfers, and Wires Issued for Period of September 9, 2023 through October 6, 2023 Recommendation: Receive and file the attached payment register summarized below for the period of September 9, 2023 through October 6, 2023 • Electronic Funds Transfers 13734 through 13876 • Warrants 63460 through 63669 • Payroll Transfers W1511 through W1512 PUBLIC HEARINGS Item No. 9: Approve an Ordinance Amending the Municipal Code to Implement the Housing Element and Comply with State Housing Laws Mayor Mallari asked Council Members to disclose any communication with anyone relevant to the item. Mayor Mallari opened the Public Hearing and invited members of the public to speak on this item. 461 Bob Youngsma, Cypress, spoke regarding the applicability of the Ordiance to the Los Alamitos Race Course property. Edwin Kraemer, Cypress, spoke regarding incentives and guidance for multi-family and ADU developments. Mayor Mallari closed the Public Hearing. A motion was made by Mayor Pro Tem Minikus, and seconded by Council Member Burke, to approve first reading, by title only, of an Ordinance amending selected provisions of Appendix I (zoning) of the Cypress Municipal Code related to multi-family housing development and design standards, multi-family permitting procedures, and accessory dwelling units in support of Housing Element implementation; and find the action exempt from the California Environmental Quality Act. The City Attorney introduced the first reading of the Ordinance. A motion was made by Council Member Marquez, and seconded by Council Member Peat, to approve annual task order for solid waste consulting services. ADJOURNMENT — IN MEMORY CYPRESS RESIDENT CHLOE GORZEMAN Mayor Mallari recessed the meeting into Closed Session at 7:15 p.m. to resume discussion of the Closed Session items as previously reported by the City Attorney. Mayor Mallari reconvened the meeting at 8:15 p.m. No reportable action was taken in Closed Session.
