Resolution No. 7009 349 RESOLUTION NO. 7009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS CERTIFYING SPECIAL ASSESSMENTS FOR COLLECTING DELINQUENT CITY NUISANCE ABATEMENT COSTS FOR NUISANCE VIOLATIONS OF THE MUNICIPAL CODE WHEREAS, the City Council has adopted Cypress Municipal Code("CMC") sections 13-20(a-d), authorizing the City to keep a record of expenses, including administrative and legal costs, incurred by the City in its removal of the nuisance and provide notice to the Property Owner of the costs owed to the City, with an opportunity to appeal the assessment of a lien of City's abatement costs of the property-related nuisance violations of the CMC; and WHEREAS, under CMC section 13-20(d), the City may enter a special assessment against the parcel of property in order to collect the cost of abatement, and transmit it to the County assessor and tax collector for inclusion on tax rolls; and WHEREAS, to compel code compliance, the City may seek to abate the nuisance and collect the costs incurred by means of a special assessment against the property where a property-related violation occurred as part of the nuisance abatement procedures authorized by Government code section 38773.5 and CMC section 13-20(d); and WHEREAS, the City Council desires to certify certain-property related nuisance abatement costs as delinquent and have them collected as a special assessment against the real property involved, for collection in the same manner as ordinary municipal ad valorem taxes, as provided in Section 38773.5 of the Government Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. The foregoing recitals are true and correct and are hereby incorporated within this Resolution. Section 2. The special assessment designated in "Exhibit A," which is attached and incorporated herein by this reference, are hereby certified as being delinquent fines, penalties, and abatement costs owing to the City of Cypress and qualified for collection as special assessments under CMC section 13-20(d). Section 3. The City Council, as part of the City's nuisance abatement, program orders that these delinquent fines, penalties, and costs of abatement be collected as special assessments against the respective properties shown in "Exhibit A" pursuant to the provisions of CMC section 13-20(d) and Government Code section 38773.5. Section 4. The City Council of the City of Cypress orders a copy of this resolution to be transmitted to the Orange County Treasurer-Tax Collector, who shall enter the amounts of the respective assessments against the respective parcels of land as they appear in the current assessment roll, and shall collect said assessments at the same time in the same manner as ordinary municipal ad valorem taxes, as provided in Section 38773.5 of the Government Code. Section 5. The costs against any parcel of land listed in Exhibit "A" attached hereto shall be deemed discharged and released upon payment for said parcel of the property taxes for the above-referenced fiscal year.
