RESOLUTION NO. 7011
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
AND ACTING AS EX OFFICIO GOVERNING BOARD OF DIRECTORS
OF THE CYPRESS RECREATION AND PARK DISTRICT, APPROVING
THE SIDE LETTER AGREEMENT BETWEEN THE CITY OF CYPRESS AND
THE CYPRESS POLICE OFFICERS' ASSOCIATION REGARDING
CLARIFICATION OF SPECIAL PAY PROVISIONS
WHEREAS, the Cypress Police Officers' Association (CPOA) is an
unincorporated, recognized employee organization within the meaning of Government
Code § 3501(b); and
WHEREAS, the California Public Employees Retirement System (CaIPERS)
conducted an audit of the City's administration of education incentive pay; and
WHEREAS, the findings of the audit required the City to clarify the language in
Article VI of the CPOA Memorandum of Understanding effective July 1, 2019 through
June 30, 2022; and
WHEREAS, the City and the Association established a Side Letter Agreement
with the amended language; and
WHEREAS, all other terms and conditions of the Memorandum of Understanding
between the City of Cypress and the Cypress Police Officers' Association July 1, 2019
through June 30, 2022, shall remain in effect.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cypress, and acting as ex-officio governing Board of Directors of the Cypress
Recreation and Park District as follows:
The Side Letter Agreement, attached hereto, is hereby approved and
incorporated herein by reference, a copy of which is on file in the Office of the City
Clerk.
PASSED AND ADOPTED by the City Council of the City of Cypress, and acting
as ex-officio governing Board of Directors of the Cypress Recreation and Park District,
at a regular meeting held on the 28th day of April, 2025.

SIDE LETTER OF AGREEMENT
BETWEEN THECITY OF CYPRESS
AND THE CYPRESS POLICE OFFICERS' ASSOCIATION
The City of Cypress ("City") and the Cypress Police Officers' Association ("Association")
(collectively, the "Parties") hereby agree to modify the Memorandum of Understanding (MOU)
effective July 1, 2019 - June 30, 2022, as indicated below. As these changes are effective
retroactively and the applicable MOU is expired, these terms shall not be subject to further
negotiations or demand.
1. Article VI SPECIAL PAY PROVISIONS, is hereby amended to modify the following
provision:
Section 5. Educational Pay
A. Educational Incentive Pay
1. Employees shall be eligible for a fixed dollar amount of Educational Incentive Pay for the
following degrees:
Associate Degree $364.91 per month ($168.42 per pay period)
Bachelor's Degree $547.37 per month ($252.63 per pay period)
2. Educational Incentive Pay will only be paid for degrees obtained through colleges or
universities accredited by an organization recognized by the Council of Higher Education
Accreditation that enhance their ability to do their job.
3. All payments under this section are subject to approval by the Police Chief and Human
Resources. Payment to employees shall be based on highest achievement level only.
4. Employees hired prior to 9/13/13 are eligible for Educational Incentive Pay, but will be
capped at the dollar amount attained as of 2/28/16 as listed in the table below. These
amounts are based on the applicable Educational Incentive Pay parameters in effect as
of 2/28/16: 5%for an Associate degree, 7.5%for a Bachelor's degree,for the highest level
achieved only.

5. Employees hired after 9/2/13 or employees hired prior to 9/3/13 that achieve education at
a level higher than attained as of 2/28/16, shall be eligible for Education Incentive Pay as
indicated in the above subsection 1.
6. Employees serving an original probationary period shall be ineligible to receive Education
Incentive Pay.
B. Peace Officer Standards &Training (POST) Pay
1. Employees hired prior to 9/13/13, are eligible Peace Officer Standards&Training (POST)
Pay capped at the dollar amount attained as of 2/28/2016 as listed in the table below.
These amounts are based on the following: 2.5% for an Intermediate POST Certificate,
5% for an Advanced POST Certificate.

Advanced POST Certificate $364.91 per month ($168.42 per pay period)
2. Except as modified herein, or by subsequent written agreement of the Parties, all other
existing terms of the MOU and any applicable Side Letters shall remain unchanged and in full
force and effect as provided thereon.
