HomeMy WebLinkAboutResolution No. 7026 395 RESOLUTION NO. 7026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING THE SEVEN-YEAR CAPITAL IMPROVEMENT PROGRAM (CIP) FOR FISCAL YEARS 2025-26 THROUGH FISCAL YEAR 2031-2032 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS THAT: WHEREAS, California Constitution Article XI Section 5 grants charter cities supreme authority in the area of municipal affairs; and WHEREAS, the City of Cypress desires to maintain and improve the City's infrastructure; and WHEREAS, it is important for the City to develop a long-range plan showing its capital improvement needs in priority order and setting forth a plan for financing those needs; and WHEREAS, the City Council finds and determines that the CIP is consistent with the Cypress General Plan and is exempt from the California Environmental Quality Act(CEQA) pursuant to CEQA Guidelines Section 15061(b)(3); and WHEREAS, California Government Code Section 830.6 provides public entities with limitations on liability of public property where public entities exercise appropriate discretion in the planning and design of public improvements, otherwise known as "design immunity." In order to invoke this affirmative defense, public entities must demonstrate discretionary approval of a design before construction. Such discretionary approval may be satisfied where the legislative body or specifically delegated designee exercises discretionary authority to approve the plan or design of the improvement prior to the construction of the improvement; and WHEREAS, the City Council desires to streamline administrative processes for routine, recurring capital projects and improve project delivery timelines and contain costs; and WHEREAS, the City Council wishes to implement a pilot program authorizing the City Manager administrative approval authority for projects specifically identified in Year One of the proposed Seven-Year CIP; and WHEREAS, in accordance with the requirements of the Charter of the City of Cypress, California, the City of Cypress is required to adopt a resolution to approve the Seven-Year CIP. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, does hereby: 1. Approve the Seven-Year CIP for FY 2025-26 through FY 2031-32, incorporated herein by reference. 2. Authorize the City Manager to approve plans and specifications and administratively approve public works contracts for the following projects in Year One of the proposed Seven-Year CIP, provided the projects are within the approved budgeted amount and do not require supplemental appropriations: • STREETS —Arterial Street Rehabilitation • STREETS — Residential Street Resurfacing • PARKWAYS —Annual Concrete Rehabilitation • FACILITIES — City Hall HVAC Rehabilitation • FACILITIES — Maintenance Yard Vehicle Lift Replacement • FACILITIES — Police Department Shooting Range Improvements • PARKS — Park Playground Surfacing Sealing & Repairs • PARKS — Parking Lot Seal Coat 396 3. Authorize the City Manager to record Notices of Completion upon the City Engineer's acceptance of the work.
