HomeMy WebLinkAboutOrdinance No. 1218 330 ORDINANCE NO. 1218 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, AMENDING SECTION 2-60 (ELIGIBILITY FOR APPOINTMENT) AND SECTION 2-70 (COMPOSITION) OF ARTICLE 4 (BOARD, COMMISSIONS, AND COMMITTEES) OF CHAPTER 2 (ADMINISTRATION) OF THE CYPRESS MUNICIPAL CODE, CONCERNING THE TRAFFIC COMMISSION WHEREAS, pursuant to Cypress City Charter §800, the City Council of the City of Cypress ("City Council") has the authority to alter the structure, membership, powers, and duties of any and all boards, commissions, and committees established in the City of Cypress ("City") Municipal Code ("CMC"). WHEREAS, pursuant to Cypress City Charter §802, the City Council has the authority to determine the number of members and length of term of office for the City's boards, commissions, and committees. WHEREAS, the City's Traffic Commission is currently made up of five members. WHEREAS, the City desires to increase the number of commissioners and modify eligibility requirements for appointment to enhance the commissioner recruitment process to balance future recruitments, thereby promoting continuity in government administration. WHEREAS, the City Council desires to amend CMC Sections 2-60 and 2-70 to attain the foregoing objectives. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY ORDAINS AS FOLLOWS: Section 1. Recitals Incorporated. The City Council finds the foregoing Recitals are true and correct and are incorporated herein by this reference. Section 2. Amendment to CMC Section 2-60. Section 2-60 of the City of Cypress Municipal Code shall be amended as follows (ctrikethrough represents deleted language while bold italics represents added language): "Section 2-60. Eligibility for appointment. Residency. Applicants must be residents of the City of Cypress and must be a -e. - -e e - - e - , and must remain as residents during their entire term of office. An exception is made for student members of a-yo th appointed body who are not yet of voting age. Public employment conflicts. Applicants shall not hold any full- or part-time office or employment with the City of Cypress or the Cypress Recreation and Park District and shall not serve on more than one commission, committee or board at the same time. Nepotism. Applicants shall not be directly related by blood or marriage to anyone on the appointing body." Section 3. Amendment to CMC Section 2-70. Section 2-70 of the City of Cypress Municipal Code shall be amended as follows ( kethreugh represents deleted language while bold italics represents added language): "Section 2-70. Composition. The commissions and standing committees are composed of the following number of members. Members are appointed by the city council as terms expire and/or as vacancies occur. 331 Reporting to city council: Traffic commission, seven five members Reporting to city council in its capacity as board for the parks and recreation district: Recreation and community services commission, seven members Senior citizens commission, seven members Committees reporting to and serving under the recreation and community services commission: Youth standing committee, seven members" Section 4. Severability. If any section, subsection, sentence, clause, paragraph, or phrase of this Ordinance or any part thereof is for any reason held to be invalid or otherwise unenforceable by any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have enacted each and every section, subsection, sentence, clause, paragraph, or phrase thereof, irrespective of any determination of validity. Section 5. Effective Date. This Ordinance shall take effect 30 days after its adoption. Section 6. Certification. The City Clerk shall certify as to the passage and adoption of this Ordinance and shall cause the same to be published and posted at the designated locations in the City of Cypress.
