HomeMy WebLinkAboutOrdinance No. 1219 332 ORDINANCE NO. 1219 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, AMENDING SECTION 21A-19 (PURCHASING SYSTEM) OF THE CYPRESS MUNICIPAL CODE ESTABLISHING UPDATED PURCHASING AUTHORITY LIMITS WHEREAS, California Constitution Article XI Section 5 grants charter cities supreme authority in the area of municipal affairs; and WHEREAS, every year the City of Cypress ("City") develops, approves, and implements a Capital Improvement Program ("CIP"), established for the construction, rehabilitation, and replacement of public improvements; and WHEREAS, Section 21A of the Cypress Municipal Code ("CMC") establishes regulations regarding contracting and purchasing policies of the City and specifically outlines the current authority, powers, and duties of City Council, City Manager, and purchasing officer with respect to the City's purchasing system; and WHEREAS, the City updated the contract limits in June 2025 to $161 ,000 for the construction, improvement, repair, or maintenance of public works and $77,000 for professional services contracts related to public works projects; and WHEREAS, pursuant to CMC Section 21A-12, the City's formal contract procedure provides contract award authority to City Council; and WHEREAS, the City Council desires to streamline administrative processes for routine, recurring capital projects and improve project delivery timelines and contain costs; and WHEREAS, the City Council of the City of Cypress desires to amend Section 21A to attain the foregoing objectives. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY ORDAINS AS FOLLOWS: Section 1 . Recitals Incorporated. The City Council finds the foregoing Recitals are true and correct and are incorporated herein by this reference. Section 2. Amendment to CMC Section 21A-19. Section 21A-19 of the City of Cypress Municipal Code shall be amended as follows (strikethrough represents deleted language while bold italics represents added language): "Section 21A-19 Contracts for public works. Every project involving an expenditure of more than $100,000 $161,000 for the construction, improvement, repair, or maintenance of public works shall be let in accordance with the procedures set forth in the Charter of the City of Cypress. Such projects involving an expenditure of $100,000 $161,000 or less may be affected by the use of city forces or let through informal bid procedures applicable to the purchase of supplies and equipment. For professional services contracts under $507,000 $77,000 related to public works projects, the city manager is authorized to enter into contract. Contracts in excess of$50,000 $77,000 shall be approved by city council, except as specifically authorized in this section. These limits shall be updated annually before July 1 of each year, based on the cost index for construction costs in Los Angeles area as published by ENGINEERING NEWS- RECORD, New York, New York, by resolution of city council. The City Manager may administratively approve public works contracts for projects specifically identified in Year One of the Seven-Year CIP approved by City Council resolution, if the projects are within the approved budgeted amount and do not require supplemental appropriations. 333 Section 3. Severability. If any section, subsection, sentence, clause, paragraph, or phrase of this Ordinance or any part thereof is for any reason held to be invalid or otherwise unenforceable by any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have enacted each and every section, subsection, sentence, clause, paragraph, or phrase thereof, irrespective of any determination of validity. Section 4. Effective Date. This Ordinance shall take effect 30 days after its adoption. Section 5. Certification. The City Clerk shall certify as to the passage and adoption of this Ordinance and shall cause the same to be published and posted at the designated locations in the City of Cypress.
