CRA - 12RESOLUTION NO. CRA - 12 A RESOLUTION OF THE CYPRESS REDEVELOPMENT AGENCY APPROVING THE REDEVELOPMENT PLAN FOR THE CIVIC CENTER PROJECT AREA AND CERTIFYING AS TO ITS REVIEW OF THE FINAL EIR WITH RESPECT TO THE REDEVELOPMENT PLAN AND MAKING CERTAIN FINDINGS. WHEREAS, the Cypress Redevelopment Agency (the "Agency") has prepared a Redevelopment Plan for the Civic Center Project Area (the "Redevelopment Plan") and has filed its Report on the Redevelopment Plan with the City Council of the City of Cypress; and WHEREAS, the City Council acting as the Planning Commission of the City of Cypress has approved and forwarded to the Agency its report and recommendation that the Redevelopment Plan is in conformity with the General Plan of the City of Cypress; and WHEREAS, the Agency has adopted and approved a Draft EIR prepared for the adoption of the Redevelopment Plan (the "Draft EIR") and has caused the Draft EIR to be circulated and made available for review and comment by appropriate government agencies and members of the general public; and WHEREAS, pursuant to notice duly given, the Agency and the City Council of the City of Cypress have held a full and fair public hearing on the Redevelopment Plan. NOW, THEREFORE, the Cypress Redevelopment Agency does hereby resolve as follows: Section 1: The Agency hereby approves the Draft EIR and adopts the Draft EIR as the Final EIR with respect to the adoption of the Redevelopment Plan (the "Final EIR"). Section 2: The Agency hereby certifies that the Final EIR for the Redevelopment Project has been completed in compliance with the California Environmental Quality Act, Public Resources Code Sections 21000 et seq., the Guidelines for Implementation thereof, 14 California Administrative Code Sections 15000 et seq., and the CEQA Guidelines established by the Agency. The Agency hereby certifies that it has. reviewed and considered the informa- tion contained therein. Section 3: All steps required by law for the adoption of the Redevelop- ment Plan having been taken and the full and fair public hearing having been held on the Redevelopment Plan, the Agency having considered all oral and written comments and testimony relating thereto, hereby approves said Redev- elopment Plan, copies of which are on file in the City Clerk's Office and by this reference incorporated herein. Section 4: The Agency hereby finds and determines that changes or alterations have been required in, or incorporated into the redevelopment of the Project Area pursuant to the Redevelopment Plan which mitigate or avoid any significant environmental effects thereof as identified and described in the Final EIR. The Agency further finds and determines that several of such changes or alterations are within the responsibility and jurisdiction of public entities other than the Agency which changes have been adopted by such public entities or can and should be adopted by such public entities. Section 5: With respect to those significant environmental effects identified as unavoidable in the Final EIR, the Agency hereby finds and determines that the benefits from redevelopment pursuant to the Redevelopment Plan to the Project Area, the surrounding community and the City of Cypress outweigh any such unavoidable adverse effects. Section 6: The Executive Director of the Agency, in cooperation with the City Clerk, is hereby authorized and directed to file with the County Clerk of the County of Orange a Notice of Determination, pursuant to 14 California Administrative Code Section 15085(h). Section 7: This resolution shall take effect immediately upon its adoption. PASSED AND ADOPTED by the governing body of the Cypress Redevelopment Agency this 12th day of July 1982.
