A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CYPRESS,
CALIFORNIA, APPROVING A REPLACEMENT HOUSING PLAN FOR THE
WALKER/ORANGE PROPERTY LOCATED WITHIN THE AMENDED CIVIC CENTER
REDEVELOPMENT PROJECT AREA, CITY OF CYPRESS, CALIFORNIA
A. Recitals.
(i) The Cypress Redevelopment Agency, City of Cypress,
California (the "Agency"), in accordance with the Amended Civic
Center Redevelopment Plan (the "Redevelopment Plan") has been
assembling an approximately six (6) acre site located within the
Civic Center Project Area (the "Project Area") at the northwest
corner of Walker Street and Orange Avenue (the "Property") for
the purpose of causing a future redevelopment project, which
project will require the demolition of twenty-one (21) dwelling
units available for occupancy by persons and families of low and
moderate income.
(ii) The Community Redevelopment Law of the State of
California (Health and Safety Code Section 33000 et seq.) (the
"Community Redevelopment Law") provides that whenever dwelling
units housing persons and families of low or moderate income are
destroyed or removed from the low- and moderate-income housing
market as a part of a redevelopment project, the redevelopment
agency shall, within four (4) years of such destruction or
removal, rehabilitate, develop or construct or cause to be
rehabilitated, developed or constructed, for rental or sale to
persons and families of low or moderate income, an equal number
of replacement dwelling units at affordable rents within the
redevelopment project area or within the territorial jurisdiction
of the agency, in accordance with all of the provisions of
Sections 33413 and 33413.5 of said Community Redevelopment Law.
(iii) The Community Redevelopment Law further requires that
the Agency shall prepare, and adopt by resolution, a replacement
housing plan (the "Replacement Housing Plan") which sets forth
the Agency's plan for replacing those units which will be removed
from the low- and moderate-income housing market.
(iv) Consistent with the Community Redevelopment Law and
the Redevelopment Plan, the Replacement Housing Plan sets forth
the Agency's plan for the construction of an equal number of
replacement dwelling units at affordable housing cost within the
territorial jurisdiction of the Agency within four (4) years
following the date for destruction of the affordable dwelling
units to be destroyed by the Agency for the future redevelopment
project, and satisfies all other applicable requirements of the
Community Redevelopment Law and the Redevelopment Plan.
(v) In accordance with the Community Redevelopment Law a
finding has been made that the replacement housing proposed in
the Replacement Housing Plan does not require the approval of
voters pursuant to Article XXXIV of the California Constitution,
or that such approval has been obtained.
(vi) In accordance with the Community Redevelopment Law
the Replacement Housing Plan was made available for the review of
Project Area Committee members (the "PAC"), other public agencies
and the general public for a reasonable time period.
(vii) All legal prerequisites to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, THE CYPRESS REDEVELOPMENT AGENCY DOES HEREBY
RESOLVE AS FOLLOWS:
1. This Agency hereby finds that all of the facts set forth
in the Recitals, Part A, of this Resolution are true and correct.
2. This Agency hereby finds that the Replacement Housing
Plan is in accordance with the Community Redevelopment Law and
the Redevelopment Plan.
3. This Agency hereby specifically finds that the
replacement housing proposed in the Replacement Housing Plan does
not require the approval of voters pursuant to Article XXXIV of
the California Constitution.

5. The Secretary of the Redevelopment Agency of the City of
Cypress shall certify to the adoption of this Resolution.
PASSED AND ADOPTED by the governing body of the Cypress
Redevelopment Agency on the 12th day of February 1990.
