CRA - 63RESOLUTION NO. CRA-63 A RESOLUTION OF THE CYPRESS REDEVELOPMENT AGENCY CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT ON THE REDEVELOPMENT PLAN FOR THE LINCOLN AVENUE REDEVELOPMENT PROJECT AND MAKING CERTAIN FINDINGS. WHEREAS, the Planning Agency of the City of Cypress has reviewed and considered the Draft Environmental Impact Report prepared on the Redevelopment Plan for the Lincoln Avenue Redevelopment Project (the "Redevelopment Plan"); and ' WHEREAS, the Cypress Redevelopment Agency (the "Agency") has reviewed and considered the Final Environmental Impact Report ("Final Environmental Impact Report") on the Redevelopment Plan for the Lincoln Avenue Redevelopment Project; and WHEREAS, pursuant to notice duly given, the Agency and the City Council of the City of Cypress have held a full and fair public hearing on the Redevelopment Plan and Draft Environmental Impact Report. NOW, THEREFORE, BE IT RESOLVED BY THE CYPRESS REDEVELOPMENT AGENCY AS FOLLOWS: SECTION 1. An Environmental Impact Report was prepared for the proposed Lincoln Avenue Redevelopment Project. The Agency hereby certifies that the Final Environmental Impact Report for the Redevelopment Plan as determined herein and incorporated by reference has been completed in compliance with the California Environmental Quality Act of 1970 and state and local environmental guidelines and regulations, and that it has reviewed and considered the Final Environmental Impact Report and the information contained therein. SECTION 2. The Agency has considered the Report to City Council, which is the report and information required by Health and Safety Code Section 33352, and all testimony for and against adoption of the Lincoln Avenue Redevelopment Project. All objections not incorporated into the findings of the Agency herein are hereby overruled. A full and fair public hearing has been held on the Draft Environmental Impact Report on the Redevelopment Plan for the Lincoln Avenue Redevelopment Project, herein incorporated by reference, and the Agency considered all comments received thereon, which comments and responses thereto are contained in the Final Environmental Impact Report. The Agency hereby approves and certifies the said Final Environmental Impact Report as the Final Environmental Impact Report for the adoption of the Redevelopment Plan for the Lincoln Avenue Redevelopment Project. SECTION 3. The Agency further finds: a) That none of the adverse impacts after mitigation will' have a significant effect or result in a substantial, or potentially substantial, adverse effect or adverse change in the environment. b) The Agency makes written findings set forth in Section 4 herein. Based on such findings, the Agency hereby finds that significant environmental effects have been reduced to an acceptable level in that all significant environmental effects have been eliminated or substantially lessened. Based on the foregoing, the Agency finds and determines that the Lincoln Avenue Redevelopment Project will not have a significant effect on the environment. c) That in the event it is determined that significant environmental effects are not mitigated or substantially lessened, the Agency hereby finds it is appropriate to approve and carry out the Lincoln Avenue Redevelopment Project because of the overriding considerations set forth in Section 4 herein. SECTION 4. The Agency hereby finds with respect to the adverse environmental impacts detailed in the Final Environmental Impact Report: a) That the adverse environmental impacts associated with the adoption of the Redevelopment Plan have been considered and recognized by the Agency. b) That comments and responses made during the public hearing of the Agency and City Council have been considered and recognized by the Agency. c) The Agency finds and determines, pursuant to Title 14 of the California Administrative Code, Section 15091(a), that changes or alterations have been required in, or incorporated into, the Project which avoid or substantially lessen the following potentially significant environmental effects: Land Use Impacts and mitigation measures to alleviate impact are discussed on pages 27-35 of the Draft Environmental Impact Report, as amended, which discussion is incorporated herein by reference. Population and Housing Impacts and mitigation measures to alleviate impact are discussed on pages 35-38 of the Final Environmental Impact Report, as amended, which discussion is incorporated herein by reference. - 2 - Traffic and Circulation Impacts and mitigation measures to alleviate ~mpact are discussed on pages 38-46 of the Draft Environmental Impact Report, as amended which discussion as mcorporated herein by reference. Light and Glare Impacts and mitigation measures to alleviate impact are discussed on pages 73-74 of the Draft Environmental Impact Report, as amended which discussion is incorporated herein by reference. -3 - d) That environmental, economic, social and other considerations and benefits derived by development of the project make infeasible project alternatives as follows: No Proiect This alternative would require that the redevelopment action initiated by the City be terminated. If the Plan were terminated, the Project Area would continue to stagnate and decline as blighting conditions would persist without benefit of the mitigation programs proposed by the Redevelopment Plan. The existing levels of blight would be perpetuated, resulting in continued physical and economic deterioration throughout the redevelopment areas. A key objective of the proposed redevelopment program is the provision of new or improved public service infrastructure and public facilities. These needs exist throughout the Project Area. The overall cost of providing such public improvements is well beyond the ability of the private sector acting alone, particularly when one takes into account the relatively low median incomes of Project Area families. Therefore, the Agency rejects this alternative because a no project alternative would not provide the required infrastructure and economic incentives necessary to eliminate blighting and growth-inhibiting conditions within the Project Area. Smaller Project Area This alternative would involve a reduction in the size of the proposed Project Area. Depending upon the properties that would be excluded, this alternative could result in an insignificant change in the impacts associated with the proposed Project. If the project were reduced in size, then the properties that least reflect physical impediments to development or conditions of blight should be eliminated. This alternative would only reduce the severity of the cumulative energy consumption in the short term, and as development proceeded to occur within the excluded areas significant impacts would still result. The Agency rejects this alternative on the premise that the properties currently included in the Project Area are essential to the effective redevelopment of the area. Alternative Use Selection of this alternative would involve a different land use pattern than that designated by the proposed Redevelopment Plan which is based on the City of Cypress General Plan. This alternative could result in environmental impacts that could be either greater or lesser than those associated with the proposed Project. Alternative land uses have been rejected by -4- the Agency, for the present, since the proposed Redevelopment Plan land use pattern represents the City's determination of the most appropriate configuration for the long-term usage of land in the Project Area. Alternative Site The Cypress City Council adopted a survey area on October 9, 1989. The Council's purpose in conducting the survey was to determine whether it would be feasible to create a redevelopment project area from all or part of the survey area. The Survey Area Report indicated that the Project Area contained characteristics of irreversible blight which could not be alleviated by private enterprise acting alone. Therefore, an alternative site would not meet the Agency's objectives of eradicating the blighting conditions within the Project Area. SECTION 5. The Agency hereby adopts the mitigation measures recommended in the EIR and the mitigation monitoring program attached as Exhibit A to this Resolution to monitor the changes which have been adopted or made a condition of project approval as described in Section 4 of this Resolution. SECTION 6. The Executive Director of the Agency, in cooperation with the City Clerk of the City of Cypress, is hereby authorized and directed to file a notice of Determination, pursuant to Title 14 of the California Administrative Code, Section 15094.
