CRA-82 A RESOLUTION OF THE CYPRESS REDEVELOPMENT AGENCY APPROVING THE FUNDING FOR PUBLIC IMPROVEMENTS RELATED TO THE LINCOLN AVENUE STREETSCAPE PROGRAM AND MAKING THE FINDINGS REQUIRED THEREFOR IN ACCORDANCE WITH HEALTH AND SAFETY CODE SECTION 33445 WHEREAS, the Cypress Redevelopment Agency ("Agency") is a public body, corporate and politic, organized and existing under the California Community Redevelopment Law (Health & Safety Code ~33000 et seq.) ("CRL"); and WHEREAS, the City Council of the City of Cypress ("City" or "City Council," as appropriate) previously, and in accordance with applicable law, adopted an ordinance approving the Redevelopment Plan for the Lincoln Avenue Redevelopment Project ("Plan" or "Project Area" as appropriate"), as such Plan may from time to time have been amended in accordance with applicable law; and WHEREAS, in furtherance of the Plan, the Agency desires to pay for the installation and construction of the publicly owned improvements and facilities identified in Exhibit "A" attached hereto and incorporated herein (the "Public Improvements") along an approximately three (3) mile portion of Lincoln Avenue between Coyote Creek Bridge and Valley View Street (the "Improvement Area") as part of the Lincoln Avenue Streetscape Program; and WHEREAS, the primary portion of the Improvement Area is located within the territorial boundary of the City within the Project Area; and WHEREAS, a small portion of the Improvement Area of approximately two hundred (200) feet in length along Lincoln Boulevard, between the City of Cypress/City of Buena Park boundary on the west and Valley View Street on the east, lies within the City of Buena Park (the "Buena Park Area"); and WHEREAS, the CRL, specifically Health and Safety Code Section 33445, authorizes the Agency, with the consent of the City Council, to pay for all or part of the value of the land for and the cost of installation and construction of any building, facility, structure or other improvement which is publicly owned either within or without the Project Area, upon the Agency and City Council making certain finding as set forth in Section 33445 and which findings are set forth hereinbelow; and WHEREAS, the authorization contained in Section 33445 includes the authority of the Agency to pay for the publicly owned improvements physically located within the Buena Park Area upon the Agency's adoption of this Resolution, the City Council's adoption of its consenting Resolution, and upon the Buena Park City Council adopting a resolution making the finding that no other reasonable means of financing the publicly owned improvements located within the Buena Park Area are available to the City of Buena Park; and WHEREAS, on September 22, 1998, the Buena Park City Council adopted a resolution making the finding that no other reasonable means of financing the publicly owned improvements located within the Buena Park Area are available to the City of Buena Park; and WHEREAS, all actions required of the Agency with respect to this Resolution have been taken in accordance with all laws applicable thereto; NOW, THEREFORE, the Cypress Redevelopment Agency resolves as follows: Section 1.The Agency hereby finds and determines as follows: A. That the Agency's payment for the cost of the Public Improvements are of benefit to the Project Area, in that (i) Lincoln Avenue is the major commercial corridor for the Project Area and for the City as a whole and is currently characterized by haphazard visual identity and lack of visual and streetscape cohesiveness, the absence of which detrimentally affects the economic and physical desirability, attractiveness, and usefulness of the Project Area's main focus area; (ii) the Public Improvements are designed to provide an enhanced visual image and strong urban design statement, thereby articulating a vision for the Project Area as an attractive, high quality, pedestrian friendly, mixed use activity center that accommodates both commercial and residential mixed use neighborhoods linked by common pedestrian and streetscape design elements; (iii) the installation and construction of public improvements, including reconstruction of streetscape features along Lincoln Avenue, is expressly identified as needed public improvements in the Plan and as necessary to the fully implement redevelopment in the Project Area; and (iv) the portion of the Improvement Area located within the Buena Park Area is necessary for inclusion in order to provide a cohesive and complete streetscape element along Lincoln Avenue within the Project Area, in that the failure to include the Buena Park Area would mean the failure to carry the streetscape improvement and theme to the main arterial intersection of Lincoln Avenue and Valley View Street, thereby preventing the Project Area from having an effective point of entry to enhance the Lincoln Avenue corridor and undermining the concepts set forth in clauses (i) and (ii) above and the effort to implement redevelopment in the Project Area as stated in clause (iii) above. B. That no other reasonable means of financing the Public Improvements are available to the community other than Agency financing, in that (i) the City's general funds are devoted to necessary police, fire, recreation, and other essential public health, safety, and welfare expenditures and are unavailable for this project, (ii) the City's capital improvement funds are allocated to other critical improvement projects within the City and are unavailable for this Project; and (iii) other sources of funding, including Lighting District funds, Measure M funds, AB2766 funds, and traffic mitigation fees, are unavailable for the Project. C. That the Agency's payment for the cost of the Public Improvements will assist in the elimination of one or more blighting conditions, in that (i) the Report to Council prepared in connection with the adoption of the Redevelopment Plan identified inadequate public facilities, including necessary streetscape rehabilitation, as a condition of blight within the Project Area, (ii) Attachment No. 4 to the Plan identifies, consistent with the Report to Council, public improvement needs in the Project Area contributing to the blighting condition which the Agency's payment for the Public Improvements is designed to address; and (iii) the inadequate street, sidewalk, traffic, and streetscape environment along Lincoln Avenue have a detrimental impact on the safety and movement of pedestrians and traffic and the economic and physical desirability, attractiveness, and usefulness of the principal commercial corridor within the Project Area. D. That the Agency's payment for the cost of the Public Improvements are consistent with the Agency's Implementation Plan adopted pursuant to Health and Safety Code Section 33490, in that assisting in the financing of streetscape improvements is identified as a potential project for alleviating blighting conditions within the project area. Section 2.The Agency's funding of the Public Improvements listed on Exhibit "A" for the Lincoln Avenue Streetscape Program, in an amount not to exceed $ 890,000, is hereby approved. -2- Section 3.The Agency's Executive Director is authorized and directed to take such actions and sign such agreements and documents as necessary to implement the purposes of the Agency's resolution on behalf of the Agency, including but not limited to one or more cooperation agreements with the City of Buena Park as may be necessary to address the construction and maintenance of the portion of the Public Improvements to be located within the Buena Park Area.
