CRA 92-09-14 MINUTES OF A MEETING OF THE CYPRESS REDEVELOPMENT AGENCY HELD September 14, 1992 Agency Chairman Partin called the meeting of the Cypress Redevelopment Agency to order at 12:03 a.m. on Monday, September 14, 1992 in the Cypress City Council Chamber, 5275 Orange Avenue, Cypress, California PRESENT:Agency Members Age, Bowman, Kerry, Nicholson and Partin ABSENT: None MINUTES: It was moved by Agency Member Bowman and seconded by Agency Member Kerry to approve the Minutes of July 13, 1992. The motion unanimously carried by the following roll call vote: AYES:5 AGENCY MEMBERS: Age, Bowman, Kerry, Nicholson and Partin NOES:0 AGENCY MEMBERS: None ABSENT: 0 AGENCY MEMBERS: None CONSIDERATION OF CONTINUED CONSULTANT SERVICES: The Deputy Executive Director presented the staff report dated August 11, 1992, which advised that the firm of GRC, Copenhaver, Inc. had been hired by the Redevelopment Agency to assist in the start-up and implementation of the three Redevelopment Project Plans, as well as the Housing Set Aside programs. The staff consultant to the Agency had completed the implementation of the organization plan and is now preparing for a workshop with the Agency. Since the original contract with GRC, Copenhaver, Inc. has expired, it is necessary to enter into an interim contract for time and materials. This will allow the consultants to continue to assist Agency staff in the evaluation of the proposed senior housing developers and in the daily operations of the Agency and provide the consultants with the continued authorization to prepare for the upcoming workshop. Agency Member Bowman expressed reservations about the kind of advice that is being obtained from the consultants. So, Agency Member Kerry suggested that Item No. 37, CONSIDERATION OF CLAIM FOR RENTAL ASSISTANCE PAYMENT AND MOVING EXPENSES REIMBURSEMENT - DON AND KATHLEEN TURNBULL, 5401 ORANGE AVENUE, CYPRESS be discussed at this time and hearing no objection, Agency Chairman Partin so ordered. The Public Works Director presented the staff report dated September 4, 1992, which referred to a memo from GRC Copenhaver, Inc., to the Executive Director of the Cypress Redevelopment Agency relative to the relocation of tenants living at the recently acquired properties at 5401 Orange Avenue. The memo detailed the relocation process as it applied to the subject tenants and explained the procedures utilized to determine the relocation benefits which require Redevelopment Agency approval. Agency Member Bowman questioned why, when the City first acquired the properties, the rent on the units weren't increased to the market rate at that time and why the rest of the rents haven't been raised if the City is going to be obligated for these expenses. Agency Member Kerry stated that the tenants have After further discussion on Redevelopment law and its interpretation, the Deputy Executive Director advised that the consultants are compiling a housing plan and a relocation format. Agency Chairman Partin suggested that perhaps the consultants can conduct a workshop for the Council. Agency Member Kerry would like additional information, in memo form, on the this piece of property and the one that will be coming before Council very soon. It was moved by Agency Member Bowman and seconded by Agency Member Kerry to authorize an appropriation of $5,700.00 from the fund balance of the Redevelopment Agency General Fund to Program No. 4297-35-194-06 and approve the claim of Don and Kathleen Turnbull, 5401 Orange Avenue, for rental assistance and moving expense reimbursement in the amount of $5,700.00 but the funds are not to be released unless the City is legally required to pay prior to the next Council meeting. The motion unanimously carried by the following roll call vote: AYES:5 AGENCY MEMBERS: Age, Bowman, Kerry, Nicholson and Partin NOES:0 AGENCY MEMBERS: None ABSENT: 0 AGENCY MEMBERS: None Regarding CONSIDERATION OF CONTINUED CONSULTANT SERVICES, the Deputy Executive Director provided some background information on the relocation plan and the properties acquired. After additional discussion, the City Attorney advised that when the property is acquired ' the individual renting decides to move and whether it is a voluntary or involuntary move, they are entitled to relocation expense. Every new renter signs an agreement and they know they are renting from a redevelopment agency so the relocation is not paid to each tenant, just the one first relocated. Agency Member Bowman voiced his objection to the idea of paying under market rent, moving and then receiving a relocation bonus. It was moved by Agency Member Bowman to continue this item to September 28, 1992. The Planning Director explained that, in that event, there is no money available because the funds, which is based on time and materials, has already been expended. Agency Member Bowman amended his motion to authorize $30,000 payable to GRC Copenhaver, Inc. and continue payment of the remainder of the funds until September 28. The Planning Director mentioned the projects that the consultants were engaged in for the Agency, i.e, Senior Housing, request for qualifications on a brochure for the City, developer negotiations, relocations and Housing Set Aside programs. Agency Chairman Partin moved to authorize staff to enter into a contract with GRC Copenhaver, Inc. in a time and materials basis, for an amount not to exceed $60,000.
