MINUTES OF THE CITY COUNCIL
OF THE CITY OF CYPRESS
AT A SPECIAL MEETING
HELD
January 30, 1961
The City Council met in special session on Monday, January 30, 1961
at 7:30 P.M., Mayor Baroldi presiding.
PRESENT: Arrowood, Denni, McCarney, Van Dyke and Baroldi
ABSENT: None
Also present were: City Manager Fred D. Harber, City Attorney, William
Camil and City Engineer John Toups.
SERVING OF NOTICE:
The City Clerk reported that each Councilman had been duly served with
an official notice of the special meeting to be held on this date by delivery,
on Friday, January 27, 1961.
SECOND READING ORDINANCE RE: CEM DISTRICTS:
The requested amendment to the Zoning Ordinance affecting set-back
requirements were considered in conjunction with street widening and improve-
ments of streets that would be affected by such change. The City Manager
stated as his recommendation that set-back requirements should not be modified
unless the perimeter streets were fully widened and improved to City standards
and adequate provision be made for run-off water to get around the property
and into the Moody Creek Flood Control Channel, that the development of
applicant's property made these improvements necessary and the cost of
same should be born by developer.
Mr. Ugene Blalock representing Forest lawn addressed the Council with
three proposals as follows:
Forest lawn to dedicate 21' on Sumner, 25' on Crescent and deposit
$5200.00 with the City of Cypress as a cash settlement in full
satisfaction for all demands for street and drainage requirements.
2. Forest lawn to dedicate 30' on Sumner, 25' on Crescent and not
do any street or drainage work.
Leave streets and set-back requirements as they presently are.
After general discussion, it was moved by Councilman McCarney, seconded
by Councilman Denni and unanimously carried, that this Ordinance not pass
its second reading. The following roll call vote was as follows:

PUBLIC HEARING RE: "CYPRESS NO. 1 LIGHTING DISTRICT":
The Mayor announced that this was the time and place for the public
hearing in regard to Cypress No. i Lighting District and asked if anyone
in the audience wished to speak. There being no written protests filed,
and no oral protests presented, the Mayor declared the public hearing
closed. It was unanimously agreed the following Resolution be read by
title only:

RESOLUTION NO. 148
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF
ORANGE, STATE OF CALIFORNIA, CONFIRMING THE REPORT OF THE CITY ENGINEER
OF SAID CITY, DATED JANUARY 7, 1961, PREPARED PURSUANT TO RESOLUTION NO.
138 OF SAID COUNCIL AND REFERRED TO IN RESOLUTION NO. 139 OF SAID COUNCIL,
AND THE PLAN, SPECIFICATIONS, ESTIMATE AND ASSESSMENTS CONTAINED IN SAID
REPORT: ORDERING THE INSTALLATION OF THE STREET LIGHTING SYSTEM: ORDERING
THE MAINTENANCE OF AND THE FURNISHING OF ELECTRIC CURRENT TO LIGHT SAID
STREET LIGHTING SYSTEM: LEVYING THE AFOREMENTIONED ASSESSMENTS: AND
FORMING THE LIGHTING DISTRICT REFERRED TO IN RESOLUTION OF INTENTION NO.
140 AND RESOLUTION APPOINTING TIME AND PLACE FOR HEARINGS NO. 141, ALL
IN ACCORD WITH DIVISION 14, PART 1, STREETS AND HIGHWAYS CODE, STATE OF
CALIFORNIA, AS AMENDED, REFERRED TO AS THE "STREET LIGHTING ACT OF 1919".
It was moved by Councilman Denni, seconded by Councilman Van Dyke,
and unanimously carried, that this Resolution be adopted by the following
roll call vote:

It was unanimously agreed the following Resolution be read hy title
only:
RESOLUTION NO. 149
A RESOLUTION OF THE CITY OF CYPRESS, COUNTY OF ORANGE, STATE OF
CALIFORNIA, DETERMINING THAT THERE IS ONLY ONE CONTRACTOR PRACTICALLY
CAPABLE OF MAKING THE INSTALLATION OF, SUPPLYING MAINTENANCE FOR, AND
FURNISHING ELECTRIC CURRENT FOR THE LIGHTING OF THE STREET LIGHTING
SYSTEM ORDERED TO BE INSTALLED BY RESOLUTION N0. 148 OF SAID COUNCIL
ALL IN ACCORD WITH AND PURSUANT TO PROVISIONS OF DIVISION 14, PART t,
STREETS AND HIGHWAYS CODE, STATE OF CALIFORNIA, AS AMENDED, REFERRED
TO AS THE "STREET LIGHTING ACT OF 1919".
It was moved by Councilman Denni, seconded by Councilman McCarney,
and unanimously carried, that this Resolution be adopted by the follow-
ing roll call vote:

FIRST READING ORDINANCE RE: ADMISSION TAX:
Mr. Frank Vessels addressed the Council objecting to the proposed
Ordinance on Admission tax. Discussion was held concerning the proposed
Ordinance afte~ which it was moved by Councilman McCarney, seconded by
Councilman Denni and unanimously carried, that the Ordinance be read by
title only:
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF CYPRESS, PROVIDING FOR THE LEVY AND
COLLECTION OF AN ADMISSION TAX AND PENALTIES FOR VIOLATION THEREOF.
It was moved by Councilman Van Dyke, seconded by Councilman Arrowood,
that this Ordinance be denied. Motion failed to carry.
It was then moved by Councilman McCarney, seconded by Councilman
Denni, and carried, that this Ordinance pass its first reading by the
following roll call vote:

It was moved by Councilman Denni, seconded by Councilman Van Dyke and
unanimously carried, that this Ordinance be read by title only.
ORDINANCE NO. 82
AN ORDINANCE OF THE CITY OF CYPRESS LICENSING THE TRANSACTION OF
BUSINESSES, TRADES, PROFESSIONS, OCCUPATIONS AND SERVICES IN THE
CITY OF CYPRESS FOR THE PURPOSE OF RAISING REVENUE AND PROVIDING
A PENALTY FOR THE VIOLATION THERE~DF, AND REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE.
It was moved by Councilman Denni, seconded by Councilman McCarney,
and unanimously carried, that this Ordinance pass its second reading
and be adopted by the following roll call vote:

ADJOURNMENT:
There being no further business to come before the Council, it was
moved by Councilman Arrowood, seconded by Councilman McCarney, and
unanimously carried, that this meeting adjourn at 9:00 P.M.
