Minutes 61-09-18MINUTES OF THE CITY COUNCIL OF' THE CITY OF CYPRESS HELD SEPTEMBER 18, 1961 The City Council of the City of Cypress met in regular session in the Council Chambers of the City Hall at 7:30 P. M., on September 18, 1961, Mayor Baroldi presiding. PRESENT: ABSENT: Arrowood, Denni, McCarney and Baroldi Van Dyke Also present were: City Manager, Robert K. Rogers, City Attorney Sheldon Ross and City Engineer John Toups. MINUTES: It was moved by Councilman McCarney, seconded by Councilman Arrowood, and unanimously carried, the Minutes of August 21, 1961 be approved as mailed. ORAL CO!~4UNICATIONS: Mr. Richard Tafella, 10002 Athenia Circle, Cypress, addressed the Council as representative and Vice President of the Cypress Civic League, Cypress, requesting the assistance of the City Council in ob- taining information concernins the formation of a Park and Recreation District in the City of Cypress. After considerable discussion it was moved by Councilman Denni, seconded by Councilman Afrowood, and unanimously carried, the City adopt a formal Resolution urging coopera- tion to the citizens investigation of the advantages and disadvantages of creating a Park and Recreation District. The following Resolution was read by title only: RESOLUTION NO. 197 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS ~URGING GOVERMNTAL AGENCIES TO MAKE AVAILABLE TO A CITIZENS COMMITTEE OF THE CITY OF CYPRESS INFORMATION CONCERNING THE FORMATION OF A PARK AND RECREATION DISTRICT. After discussion, it was moved by Councilman Arrowood~ seconded by Councilman Denni, and unanimously carried, this culm,~nication be tabled until a full report has been received from the legal division of the League of Cities. It was moved by Councilman Afrowood, seconded by Councilman Denni, and unanimously carried, that Ordinance no. 106 be adopted by the following roll call vote: AYES: 4 COUNCILMEN: Arrowood, Denni, McCarney and Baroldi NOES: 0 COUNCILMN: None ABSENT: 1 COUNCILMAN: Van Dyke September 18, 1961 85 RELEASE OF STREET IMPROVEMENTS BONDS ON TRACTS 3910 AND 3949~ (STANDARD DEVELOPMENT CORPORATION): The City Manager presented his recommendation to release the street improvement bonds on Tracts 3910 and 3949 as all work has been completed in accordance with City specifications. It was moved by Councilman Denni, seconded by Councilman Afrowood, and unanimously carried, that Street Improvement Bonds on Tracts 3910 and 3949 as submitted by Standard Development Corporation, Beverly Hills, California be released. It was unanimously agreed this matter be continued until the next regular meeting of the City Council and the City Engineer to inspect the improvements on Tract 3911 and report to the Council his recon~nendations. ACCEPTANCE OF AUDITOR'S REPORT DATED JUNE 30, 1961: It was moved by Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the Auditor's report dated June 30, 1961 be received and filed. FIRST READING ORDINANCE RE: TRAFFIC REGULATIONS: The City Clerk presented an Ordinance regarding Traffic Regulations for the City of Cypress with recommendations from the Chief of Police for the necessity of this Ordinance. It was moved by Councilman Afrowood, seconded by Councilman McCarney and unanimously carried, the following Ordinance be read by title only: ORDINANCE NO. AN ORDINANCE OF THE CITY OF CYPRESS REGULATING TRAFFIC UPON PUBLIC HIGHWAYS; ESTABLISHING THE OFFICE OF CITY TRAFFIC ENGINEER AND ESTABLISHING A TRAFFIC COMMITTEE. After discussion, it was moved by Councilman McCarney seconded by Councilman Afrowood, and carried, that Tentative Tract No. 4327 be approved subject to the following conditions: 1. Nearman Street to have a minimum of 22' oi paving. 2. All slopes between rear yards to be entirely on lower property. 3. A 5' block wall fence to be constructed on the westerly boundary of this Tract. e Additional street dedications on Karen and Newman to be as designated on a map marked Exhibit "A" parcels "A" and "B"; as on file in the office of the City Clerk. The following roll call vote was taken: AYES: 3 COUNCILMEN: Afrowood, McCarney and Baroldi NOES: 0 COUNCILMEN: None ABSENT: 1 COUNCILMAN: Van Dyke ABSTAINED: 1 COUNCILMAN: Denni September 18, 1961 CONSIDERATION OF TENTATIVE TRACT MAP NO. 4103; ROBERT WETZLER: The City Clerk presented Tentative Tract Hap No. 4103, Robert Wetzler, for consideration at this time, with the recommendation of the Planning Cormuission for approval. A written ct~nication from Ray Hercado, representing the Nat Neff Engineering Co., was read in full, objecting to the conditions set forth by the Planning Cotmnission in their recommendation for approval, pertaining to fences surround- ing the proposed subdivision. The City Engineer stated the proposed grades as shown, are below reconnnended minimums the curve radii as shown is below recommended minimum, lot #50 does not have the minimum depth required and Grindlay Street will be constructed half width only; however, he felt these could be worked out with the City Engineering staff and the Engineer for the Subdivider. After considerable discussion, it was moved by Councilman Denni, and seconded by Councilman Afrowood, unanimously carried, that Tentative Tract Map No. 4103 be approved subject to the following conditions: 1. A six foot block wall fence ~o be constructed on the north side of the development, and a six foot~haln ~imtefence along the southerly boundary line of the proposed Tract. 2. A concrete block wall fence six foot to be constructed on the easterly 200' of Lot 47, along the southerly line of lots 48, 49 and 50 and on the easterly 154' of Lot 1. 3. That the offsite drainage be constructed to the satisfaction of the City Engineer, and all easements to be acquired by the Subdivider. 4. Rome Street with Lots 48 and 49 to be moved southerly as far as practicable, subject to the approval of the City Engineer. The following roll call vote was taken: AYES: 4 COUNCILM~N: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMAN: Arrowood, Denni, McCarney and Baroldi None Van Dyke WRITTEN COMMUNICATION FROM ROSENTHAL ENGINEERING CO., RE: TENTATIVE TRACT NO. 3742, (STANDARD DEVELOPMENT CORPORATION:} The City Clerk presented a written communication from Rosenthai Engineering Co., representing Standard Development Corporation, Beverly Hills, Calif., requesting permission for Denni Street to be designed with a future pedestrian crossing, or action taken to initiate vacation proceedings for Denni Street between Myra Avenue and Carbon Creek Channel and between Belle Ave., and Carbon Creek Channel. After discussion with the City Engineer and Rosenthai Engineering, it was moved by Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the Cith Engineer write a detailed report on this matter and submit it to the City Council within ten days for study prior to the next Council meeting. PUBLIC IMPROVEMENT PLANS FOR TRACT 3966: The City Manager introduced discussion stating the public improve- ments plans as submitted on Tract 3966 are not in accord with the Master Plan of Drainage 1-B and 2-A with the comment that there are two alternatives for the solution of the drainage from this Tract. (1) Approximately 4 acres could drain southerly on Walker or (2) If required, the Subdivider could build a drainage easement and meet the Master Plan of Drainage requirements. September 18, 1961 After detailed study of the maps and discussion, it was moved by Councilman Denni, seconded by Councilman Arrowood, and unanimously carried, the drainage and grading plans be approved subject to the approval of the City Engineer. DISCUSSION OF WITHDRAWAL FROM LIGHTING DISTRICT FOR TRACT NO. 3966: The City Manager introduced discussion of the withdrawal from the present Lighting District that covers Tract No. 3986 and form a new District to be known as Cypress Lighting District No. 2. The City Attorney presented each Councilman with a copy of the procedure required to form a new Lighting District. No action was taken at this time. APPOINTMENT OF CO-ORDINATOR FOR WOMENS' ACTIVITIES IN CIVIL DEFENSE PROGRAH: The City Manager recommended an appointment be made for a Co- ordinator for womens' activities for the Civil Defense Program and submitted two names of volunteer's for this appointment. It was moved by Councilman Arrowood, seconded by Councilman Denni, and unanimously carried, that Mrs. Patricia Goods, 10311 Lorraine Lane, Cypress be appointed as the Civil Defense Co-ordinator and Mrs. Betty Elias, 10272 Lorraine Lane, Cypress be appointed as her alternate. WRITTEN CO~ff4UNICATION FROM PETE VAN RUITEN RE: DRAINAGE DITCH ON ORANGE AVE: The City Manager read in full, a written communication from Pete Van Ruiten regarding the drain ditch on the north side of Orange Avenue at the junction of Orange and Bloomfield, and stated this communication was received at 5:30 P. M. today, therefore, the City Engineer had not had sufficient time to look into the matter. It was unanimously agreed, the c~m,~unication be continued until the next meeting of the Council. WRITTEN COMMUNICATION CO~ff4ENDING CHIEF O. C. FOSTER: The City Manager read in full a letter from Roy E. Reynolds, Norwalk, Caltf., coinmending the Police Chief, O. C. Foster on his efforts in a recent "theft from auto" occurance that took place in the City of Cypress. ORAL CO~4UNICATIONS: Mr. William Schubin, 4615 Orange Avenue, Cypress addressed the Council as to the Master Plan for the City and what progress had been made on it. The City Manager explained what had been accomplished at the two study sessions that had been held, and that no final action had been taken by the City at this time. Mr. Richard Tafella, 10002 Athenia Cir., Cypress addressed the Council requesting the City take some action to get the weeds cleared from the vacant property in the Brentwood Subdivision, that had been reserved for a park site.
