Minutes 61-10-16MINUTES OF THE CITY COUNCIL OF THE CITY OF CYPRESS HELD October 16, 1961 The C~ty Council of the City of Cypress met in regular session on October 16, 1961 at 7:30 P- M., in the Council Chambers of the City Hall, Mayor Pro Tem Van Dyke presiding. PRESENT: Afrowood, McCarney and Van Dyke ABSENT: Denni and Baroldi MINUTES: It was moved by Councilman McCarney, seconded by Councilman Arrowood, and unanimously carried, the Minutes of the meeting of September 18, 1961 be approved as mailed. ORAL COMMUNICATIONS: Mr. Otto Busler, 1OOlI St. Elizabeth Circle, Cypress addressed the Council concerning the abatement of the feed yard odors and asked if there was any further action could be taken by the City towards abating these odors. Mr. K. E. Johnson, representing Joseph Sousa, addressed the Council concerning the fence requirements on a Use Variance No. 137 at the south- ea~t corner of Moody and Orange. COUNCILMAN DE~NI arrived at 7:45 P. M. and took his chair on the podjum. Mrs. Crummett, Karen Ave., Cypress addressed the Council concerning the development adjacent to her property. it was unanimously agreed that all of the above matters not on the formal Agenda would be taken up at the end of new business on the Agenda. WR1TT~3 COMMUNICATION FROM WILLIAM VEACH, RE: PERMISSION FOR HELICOPTER SERVICE AT 4114 LINCOLN AVE., CYPRESS: The City Clerk presented a written communication from William Veach, 9~54 Cedar Ave.~ Bellflower, Calif., requesting permission for a business ]icenae to operate a helicopter service on property located at 4114 Ldncoln Ave., Cypress. After further discussion, it was moved by Councilman Afrowood, seconded by Councilman McCarney, and unanimously carried, to take the recommendation of the City Manager and refer th~s matter to the Planning Commission for their next meeting. WRITTEN COMMUNICATION ~XOM THE CALIFORNIA HORSE RACING BOARD RE: PUBLIC NEARIP~G FOR APPLICATION FOR THOROUGHBRED RACING AT LOS ALAMITOS RACE COURSE: The City Clerk presented a written communication from the State of Caldfernia Horse Racing Board informing the City of Cypress of a public hearing to be held on October 17, 1961 regarding the application for thoroughbred horse racing as submitted by the Los A]amitos Race Course, Cypress, California. It was moved by Councilman McCarney, seconded by Councilman Den~, and unanimously carried, that Mr. Robert K. Rogers, City Manager be appointed to attend this public: hearing as a representative of the City of Cypress to endorse the application for thoroughbred rac~ng of the Los A]am~tos Race Course, Cypress, California. October 16, 1961 91 WRITTEN COMMUNICATION ~ROM CITY OF LA MIRADA RE: CIVIL DEF~ENSE SHELTERS: The City Clerk presented a written communication from the City of La Mirada, Calif., regarding Civil Defense Shelters. After discussion, it was moved by Councilman McCarney, seconded by Councilman Arrowood, and unanimously carried, this communication be received and filed. WRITTEN COMMUNICATION FROM THE ORANGE COUNTY WATER DISTRICT RE: WATER RATES: The City Clerk presented a written communication from the Orange County Water District regarding the installation of water meters and urging the Cities of Orange County to support their Resolution now before the Public Utilities Commission of the State of California. Ih was moved by Councilman Arrowood, seconded by Councilman McCarney, and unanimously carried, the following Resolution be read by title only: RESOLUTION NO. 202 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, SUPPORTING THE INSTALLATION OF WATER MP~TERS It was moved by Councilman Denni, seconded by Councilman Arrowood, and unanimously carried, that Resolution No. 202 be adopted by the following roll call vote: AYES: 4 COUNCILMEN: NOEE: 0 COUNCILMEN: ABSENT: 1 COUNCILMAN: Arrowood, Denni, McCarney and Van Dyke None Baroldi WRITTEN COMMUNICATION FROM MRS. JOHN DAKIS~ REGARDING WATER RATES: The City Clerk presented a written communication from Mrs. John Dakis, 5622 Elinora Lane, Cypress, California, objecting to the water rates being charged dn this area. After discussion, it was moved by Councilman Denni, seconded by Councilman Afrowood, and unanimously carried, that the staff investigate the fees charged for water rates and in comparison with surrounding areas, and report to the City Council not later than sixty days. The City Engineer stated his office would a survey and file a report of their findings to the City Council. COPIES OF RESOLUTIONS FROM SURROUNDING AGENCIES REGARDING WATER METERS: The City Clerk presented copies of Resolutions adopted by surrounding agencies supporting the installation of water meters as follows: Associated Chambers of Commerce of Orange County Santa Ana Chamber of Commerce City of Garden Grove City of Anaheim City of Buena Park It was unanimously agreed these copies of Resolutions be received and filed. WRITTEN COMMUNICATION FROM CITY OF GARDEN GROVE RE: FLOOD WATER RUN-OFF AND DRAINAGE ON CITY BOUNDARY LINES: The City Clerk presented a written communication from the Director of Public Works and City Engineer of the City of Garden Grove regarding the flood water run-off and drainage in the area located south of Orange- Wood Avenue and west of Knott Ave., the City Manager reported that Garden Grove believes that all storm water in this area flows directly west, however, our Engineering Department states there is some flow to the south- west which had not been anticipated in the drainage plans for the City of Garden Grove. It was moved by Councilman Denni, seconded by Councilman Afrowood, and unanimously carried, that the Cdty E~ngineer meet with the C~ty Engineer of Garden Grove and work out a solution to thedrainage on th~s area. October 16, 196] WRITTEN COMMUNICATION FROM PETE VAN RUITEN RE: DRAINAGE DITCH AT ORANGE AND BLOOMFIELD: The City Clerk presented written communication from Pete Van Ruiten concerning the drainage ditch at Orange Ave., and Bloomfield Ave., and requesting the City to take the necessary steps to correct this drainage problem. After considerable discussion, it was moved by Councilman Arrowcod, seconded by Councilman McCarney, and unanimously carried, to authorize the City Engineer to make a study of the s~tuation whether to use a pipe or swale for drainage purposes and direct the Cypress County Water District to remove the excess dirt from this ditch. RELEASE OF IMPROVEMENT BONDS FOR TRACT NO. 3911 (STANDARD DEVELOPMENT CORPORATION:) The City Clerk presented a written communication from Standard Development Corporation requesting the release of all improvement bonds ~n Tract No. 3911. It was recommended by the Engineering staff that all improvements were installed and meet the standard specifications. It was moved by Councilman Arrowcod, seconded by Councilman McCarney and unanimously carried, that all improvements bonds for Tract 3911 be re]eased. COhSIDERATION OF DENNI STREET PEDESTRIAN CROSSING IN TRACT 3742 (STANDARD DEVELOPMENT CORPORATION): The City Clerk presented a written communication from Rosenthai Engineering Co., representing Standard Development Corporation, Beverly Hi]is, Calif., requesting that their company be permitted to design Denni Street based on a fllture pedestrian crossing, or that immediate action be tal~en to initiate vacation proceedings for Denni Street between Myra Ave., and Carbon Creek Channel and between Belle Ave., and Carbon Creek Channel. The City Manager recommended the Developer be required to establish the grades as plans were submitted originally and approved. After considerable discussion, it was moved by Councilman Arrowcod, seconded by Councilman Denni and unanimously carried, to deny the request as submitted and bring the grades up to standard specifications for pedestrian access and future vehicular access. SECOND READING ORDINANCE RE: TRA~FIC REGULATIONS: The City Clerk presented the proposed Ordinance regarding Traffic Regulations and the establishment of office of City Traffic Engineer and Traffic Committee, for a second reading. Mayor Van Dyke declared a five minute recess for the Council. Meeting again called to order by Mayor Van Dyke and it was then moved by Councilman Denni, seconded by Councilman Arrowood, and unanimously carried, the following Resolution be read by title on]y: RESOLUTION NO. 206 A RESOLUTION OF TH~j CITY COUNCIL OF THE CITY OF CYPRESS, ALLOWING CERTAIN CLAIMS AND DEMANDS NOS. 4172 THRU 4]?4 AND 4204 THRU 4293. ]t was moved by Councilman Denni, seconded by Councilman McCarney and unanimously carried, this Resolution be adopted by the following roll call vote: AYES: 4 COUNCILMEN: NOES: O COUNCILM~: AB~3[~T: 1 COUNCILMAN: Arrowood, Denni, McCarney and Van Dyke None Baroldi October 16, 1961 AUTHORIZATION FOR INSTALLATION AND MAINTENANCE OF TRAFPIC SAFETY LIGHTING DEVICES ON CERTAIN SECTIONS OF BALL ROAD AND CERRITOS AVE.: The City Manager requested permission for authorization to expend an estimated $845.00 for installation and maintenance of traffic safety lighting devices on certain sections of Ball Road and Cerritos Ave. It was moved by Councilman Afrowood, seconded by Councilman McCarney and unanimously carried, the City Manager be authorized to purchase the necessary traffic safety lighting devices on certain sections of Ball Road and Cerritos Ave., and the maintenance of these devices included. CONSIDERATION OF REQUEST OF SOUTHERN CALIF, EDISON CO., FOR EASEMENT TO INSTALL POLE ON VALLEY VIEW, NORTH OF THE RAILROAD ON CITY PROPERTY AND AUTttORIZATION FOR MAYOR AND CITY CLERK TO SIGN DEED: The City Clerk presented a written communication from the Southern California Edison Co., requesting permission to relocate a pole in City owned property on Valley View, north of the railroad, stating the Edison Company would relocate the pole at their expense at such time as the property ~s developed, and further agreed to pay the City of Cypress on the basis of $35.00 per pole and $50.00 per anchor, making a total considerstdon of $120.00 for an easement covering the pole line. It was moved by Councilman Denni, seconded by Councilman McCarney and unanimously carried, to grant the request of the Southern California Edison as stated, and authorize the Mayor and City Clerk to sign the Deed. RECOMMENDATION OF THE PLANNING COMMISSION TO OBTAIN THE SERVICES OF A PLANNING CONSULTANT FOR THE MASTER PLAN: The C~ty Manager presented a recommendation of the Planning Commission to obtain the services of a Planning Consultant for a limited time, for study on the Master Plan of the City of Cypress. After discussion, it was moved by Councilman Arrowood, seconded by Councilman Denni, and unani- mously carried, that the Mayor appoint a committee of three (3) to select a Planning Consultant after interviews and study, and make a report and recommendation to the City Council on their dec~slon. APPOINTMENT OF DEPUTY CITY CLERK: The City Manager recommended the appointment of Ferne S. Phillips as Deputy City Clerk. It was moved by Councilman Arrowood, seconded by Councdlman Denni, and unanimously carried, that Ferne S. Phillips be appointed as Deputy City Clerk with an increase in compensation of $30.00 per month. The oath of office was administered by Mayor Van Dyke. ENGINEER'S REPORT FOR CYPRESS LIGHTING DISTRICT NO. 2: The City Engineer filed copies of the Engineer's Report dated October 16~ 196I and titled "Cypress Lighting District No. 2" with the City CounciI and Clty Clerk, with the recommendation that the Councd] proceed w~th the proper procedure on the next regular meeting. ORAL COMMUNICATIONS: Mr. James Duncan, South Walker Street, Cypress addressed the Council stating the audience could not hear the discussion of the City Council in their meetings. No action was taken at this time. Mrs. Wm. Schubin, Orange Ave., Cypress addressed the Council concerning Denni Road and the future use of this street. Mr. M. Motira, 5856 Ba]]. Road, Cypress, addressed the Council stating the development of Tract No. ~9]1 (Standard Development) is going to make a drainage problem on his farm. It was unanimously agreed the City Engdneer and Mr. Morita discuss the drainage and the matter to be placed on the Agenda of the next regular Council meeting. October 16, 1961 ABATEMENT OF FEED-YARD ODORS: As previously requested by Mr. Otto Busler, the Council discussed the abatement of the feed yard odors on Walker and Cerritos. It was moved by Councilman Arrowood, seconded by Councilman Denni, and unanimously carried, the City Council direct the City Attorney to file a misdemeanor action on behalf of the City on the abatement of the feed yard if not eliminated within ten (10) days to the satisfaction of the City Manager and City Attorney. CITIZEN'S INQUIRY CONCERNING THE DEVELOPMENT OF TRACTS 3966 AND 4327 IN RELATION TO KAREN AVENUE: Mrs. Crummett, Karen Ave., Cypress addressed the Council concerning a road being developed through to Karen Ave., by the development of Tracts 3966 amd 4327. There was no action taken at this time. EXTENSION OF TIME ON USE VARIANCE NO. 137 AS REQUESTED BY JOSEPH SOUSA: Mr. K. E. Johnson, representing Joseph Sousa in regard to an extension of time on Use Variance No. 137 and fence requirements and stated the Edison Company were considering the condemnation of this property for their use at a future date. After further discussion, it was moved by Councdlman Arrowood, seconded by Councilman Denni, and unanimously carried, that a thirty (30) days extension be granted from the day he is turned down from the Edison Co., or after the next Council meeting whichever is sooner. CITIZEN'S REQUEST FOR CONTROL OF DUST: Mr. Wm. Schubin, 4615 Orange Ave., Cypress addressed the Council requesting the contractor of the sewer lines be contacted to request better control of the dust created by the construction work. The City Engineer John Toups, stated he would call the contractor the following day. ADJOURNMENT: There being no further business to come before the City Council, it was moved by Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the City Council adjourn at 9:50 P- M.
