Minutes 61-11-20MINUTES OF THE CITY COUNCIL OF THE CITY OF CYPRESS HELD November 20~ 1961 The City Council of the City of Cypress met in regular session on November 20, 1961 at 7:30 P. M., in the Council Chambers of the City Hall, Mayor Baroldi presiding. PRESENT: ArrowoDd, McCarney, Van Dyke and Baroldi ABSENT: Denni Also present were: City Manager Robert K. Rogers, City Attorney Sheldon Ross and C~ty Engineer, John Toups. MINUTES: ]t was moved by Councilman McCarney, seconded by Councilman ArrowoDd, and ananimously carried, the Minutes of October 16, 1961 be approved as ma~led. COUNCILMAN DENNI arrived at 7:35 P. M., and took his chair on the podrum. ORAL COMMUNICATIONS: Nr. Calvin Meekhoff, 9731 So. Walker St., Cypress, California repre- senting the Citizens for Better Government read a written communication addressed to Councilman Denni, requesting his resignation from the City Council. Councilman Denni stated he did not plan to resign from the City Council. CONSIDERATION OF PLANNING COMMISSION RECOMMENDATION TO DECLARE A MORATORIUM ON ALL REZONING MATTERS IN THE CITY OF CYPRESS: The City Manager presented a recommendation from the Planning Commission to the Cfity Council to declare a moratorium on all rezoning matters in the City of Cypress until such time as a Master Plan Study has been made and surveys completed. The City Attorney advised the Council the present Zoning Ordinance would prohibit a moratorium, unless it ~s amended. The Planning Consultant Selection Committee of %he City of Cypress (Mayor Baroldi and Councilman Van Dyke) reported they had interviewed several applicants for PLanning Consultant prior to this meeting, and therir selection would be that Hahn, Wise, Barber, Koebig & Koebig conduct th~ studies and surveys for a Master Plan. The City Manager explained the 701 Program of the Feder~d Government that would cover the cost of the Master Plan up to two-thirds of the total cost and stated the firm recommended, had experience in completing applications for Federal Arid. £t was moved by Councilman Arrowood, seconded by Councilman Van Dyke and carried, that the City of Cypress appoi nt the firm of Hahn, Wise, Barber, Koebrig & Koebig as the City Planning Consultants, subject to the working oat off the monetary arrangements and on the condition they will be available for s,Jvisory service in the interim. UV-161~ RAYMOND SPEHAR: The Mayor announced this was the time and place for the public hearing to consider an appeal of a Planning Commission decision to grant a Variance to permit commercial development in an A-2 Zone, that property located on the southwest corner of Cerritos and Miller Rd., Extension, as requested by Raymond Spehar, 1532 Beacon Ave., Anaheim, California to be known as Use Variance No. UV-161, and appealed by Hubert Slegers, 10351 S. Miller, Cypress, Calif. and asked if there was anyone in the audience that wished to speak. for or against this Use Variance. The City Clerk reported there were two written communications received pertaining to this Use Variance, from H. J. Slegers, Cypress, Calif. and Kenneth Bordner, Cypress, Calfif. Mr. Dennis Murphy, 8002 Miller, Buena Park, representing Mr. Raymond Spehar addressed the Council speaking for the development to include a steak house with cocktail bar, a package liquor store and drive-in cleaners. Mr. H. J. Slegers, 10531 Valley View, Cypress addressed the Council protesting the granting of this Variance due to the small children living in the neighborhood and the increase of traffic created by the establish- ments proposed. Mr. Kenneth Bordner, 5562 Bishop, Cypress, Calif. addressed the Council protesting the granting of this Variance due to the traffic conditions, lack of parking facilities and stated in his openrich, it would be considered "spot zoning". Mr. Turner, no address given, addressed the Council as the proposed owner of the retail liquor store, and stated he discussed this proposed development with the adjacent property owners and their only objection was to the sale of liquor, however, he felt it was not in violation of any law to conduct a retail liquor sales store. MAYOR BAROLDI announced that he would not be voting on this Use Variance as he is an adjacent property owner. It was moved by Councilman Arrowcod, seconded by Councilman McCarney, and unanimously carried, that Use Variance No. UV-161 be approved subject to the following conditions: 1. Adequate parking as set forth in the Zoning Ordinance. 2. All conditions of City Ordinances and Building Codes. 5. A five foot masonry wall on the Rancho Line. Dedication of all streets adjoining, a minimum of 60' on Miller, in accordance with the Master Plan of Highways. 5. Improvement of Cerritos Ave. 6. Sidewalks for the full width. ?. Surety Bond to be submitted in the amount of ~5,000. for the bridge across the Flood Control Channel. Mayor Pro Tem Van Dyke announced this was the time and place for the public hearing to consider an amendment to the Zoning Ordinance to rezone from A-2 (Heavy Agriculture) to R-1 (Residential One-Family) 6,000 so. ft. that property located south of and adjacent to Cerritos Ave., to the east of Miller Street and west of and adjacent to Holder Street as requested by Baroldi Farms, 6716 Cerritos Ave., Cypress, Calif. to be known as Zone Change Z-24. The Mayor asked if anyone in the audience wished to speak for or against this proposed Zone Change. The City Clerk reported there were no written communications filed concerning this Zone Change. Mr. Merrill Butler, representing Butler-Harbour, Inc., the developers for this proposed Zone Change, addressed the Council and stated they planned to build residential units on this property under the FHA and VA Housing Program. Mr. Thomas Baroldi, 6716 Cerritos Ave., Cypress addressed the Council stating they had deleted 300' from the southerly part of this Droperty adjacent to the railroad as recommended by the C~ty staff. Mr. Pete Vanderpool, 6882 Orangewood, Cypress, addressed the Council stating he understood this property would be zoned Industrial, after attending a study session of the Planning Commission on the Master Plan. The City Manager explained this was the first preliminary study session and no final action or decisions had been determined on any property in the City, insofar as the Master Plan was concerned. There being no further oral comments, and the City Clerk reported there were no written protests filed, the Mayor declared the public hearing closed. It was moved by Councilman McCarney, seconded by Councilman Denni, and unanimously carried, the following Ordinance be read by title only: ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIl. The Mayor announced this was the time and place for the public hearing to consider an amendment to the Zoning Ordinance to fezone from A-2 (Heavy Agriculture) to R-1 (Residential One-Family) that area of approximately 26 acres, located on the west side of Moody Street between Lincoln and Orange Ave., as requested by Arie and Berdena Rynsburger, Simon J. and E]ice Schipper~ William J. and Ruth Schipper and Chester L. and Henrietta Berg, 9271 Moody Street, Cypress, to be known as Zone Change Z-26. The City Clerk reported there were no written protests filed. The Mayor asked if anyone in the audience wished to speak for or against proposed zone change. November 20, 1961 10o Mr. Sherman Wh~tmore, Newport Beach, Catif. representing the Developer for th~s proposed property addressed the Council stating they planned to build residential homes on this property. Mr. Vern Lawrence, 5627 Meridian Los Angeles, Ca]if. addressed the Council and stated he owned the five acres adjacent to this property and would like to rezone his property at some fiiture date, if this zone change is accepted. There being no further oral comments, the Mayor declared the public hearing closed. Sherman Whitmore, Newport Beach, Calif., addressed the Council representing the Developer, stating they proposed a neighborhood shopping center on this ten acre site. The Mayor announced this was the time and place for the public hearing to consider an amendment to the Zoning Ordinance to change the Zone from A-2 (Heavy Agriculture) to R-1 (Residential One-Family) approximately 49 acres, located on the northeast corner of Ball Road and Moody Street, as requested by Harold and Elva Marie Struikman, 5151 Ball Rd., Cypress, to be known as Zone Change Z-31. Mr. Clay Revis, 12112 Brookhurst, Garden Grove, addressed th~ Council speaking for the development as proposed residential. Mr. I)~ck Owens, representing the Developer, Robert H. Grant Co., addressed the Council.stating they felt this would be a good area for residential due to the fact it is adjacent to other residential units. City Engineer, John Toups, explained the complete Master Plan of Drainage. The City Manager reported that due to the recent rains this would not be necessary, but he recommended that we appoint a Fire Warden to make a survey of the City and burn or abate the nuisances created by the drought, arid decrease the fire hazards. It was moved by Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, this written communication from the City of Santa Ana, be received and filed. It was moved by Councilman Van Dyke, seconded by Councilman Arrowood, and unanimously carried, that the County of Orange be instructed to proceed with the fire hazard abatement and that the County Fire Warden be appointed enforcement officer for the City of Cypress. A WRITTEN COMMUNICATION FROM MRS. BETTY ELIAS; RESIGNATION F~OM CIVIL DEFt~SE: The City Clerk presented a written communication from Mrs. Betty Elias, CyDre~s, California resigning her appointment as Civil Defense Women's Co-Ordinator Alternate. It was moved by Councilman Afrowood, seconded by Councilman McCarney and unanimously carried, this communication be received and filed and the resignation accepted with regret. November 20, 1961 WRITTEN COMMUNICATION FROM STATE OF CALIFORNIA, DIVISION OF HIGHWAYS RE: MAJOR CITY STREETS: The City Clerk presented a written communication from the Division of Highways, State of California, approving certain City Streets as Major City Streets. was unanimously agreed this communication be received and f~led. SECOND READING ORINANCE RE: TRAINING OF LAW ENFORCEMENT OFFICERS: It was moved by Councilman Afrowood, seconded by Councilman McCarney and unanimously carried, this Ordinance be read by title on]y: ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS ACCEPTING THE REQUIREMENTS OF SECTION 13522 OF THE PENAL CODE RELATING TO TRAINING OF LAW ENFORCEMENT OFFICERS. It was moved by Councilman Arrowood, seconded by Councilman McCarney, and unanimously carr~ed, this Ordinance be adopted. The C~ty Manager recommended anyone having complaints should file them w~th the Public Utility Commission as ~nd~vidual home owners. CITY ENGINEER'S REPORT RE: DRAINAGE ON MORITA PROPE~{TY & TRACT 3911: The City Clerk presented City Engineer John Toups report on the drainage on the Motira property adjacent to Tract No. 3911. Mr. Toups stated he would be having a meeting with the Engineers of the Development adjacent to Mr. Morita's property and untdl that time, no final decision had been me de regarding this drainage. CITY ENGINEER'S REPORT RE: DRAINAGE ON ORANGE AVE. & BLOOMFIELD AS REQUESTED BY PETE VAN RUITEN: The C~ty Clerk presented a report prepared by Assistant City Engineer Rona]d Nottingham regarding the drainage on Orange Ave., and Bloomfield, recommending approximately 60' of 22 inch by 13 inch corrugated metal pipe arch and reconstruct pavement as required not to exceed ~330.00. It was moved by Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, that the recommendation of the Engineer be approved. WETZLER: The City Clerk presented a revised Tentative Tract Map No. 4103 as requested by Robert L. Wetzler, for that area north of Ball Road on the west s~de of Walker and south of Orange Ave. After discussion of the propoaed map, it was moved by Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, that Tentative Tract Map No. 4103, Revised, be approved subject to the following conditions: '!. A six foot block wall fence to be constructed on the north ~;]de of the development, and a six foot chain link fence along the southerly boundary line of the proposed Tract. P. A concrete block wall fence six foot, to be constructed !m the easterly 200' of Lot 4.7 and Lot A and along the southerly (lines of Lots 48, 49, ~O and 51 and on the easterly 154' of Lot 1. 5. That the offsite drainage be constructed to the satisfaction of the C~ty Engineer, and all easement required to be obtained by the Subdivider. 4. Lots 4 and 48 be widened to the required 65 foot minimum lot width for corner lots. 5. Lot A be an irrevocable offer of dedication to the City of Cypress. The City Attorney advised Mr. Schubin he would check into the local and State laws on this matter.
