OF THE CITY OF CYPRESS
AT A SPECIAL MEETING
HELD
March 10, 1962
The City Council of the City of Cypress met in special session on
March lO, 1962 at l:OO P. M., in the Council Chambers of the City Hall,
9739 So. Walker, Cypress, California, Mayor Baroldi presiding.
PRESENT: McCarney, Van Dyke and Baroldi
ABSENT: Arrowood and Denni
Also present were City Manager/City Clerk/City Engineer, John M.
Toups, and City Attorney Sheldon Ross.
All members of the City Council having been served with an official
Notice of the Special Meeting, the meeting was called to order at 1:30 P. M.
TRACT 4102~ CON-TECH BUILDING CO.:
The City Manager/City Engineer announced this meeting was called
for the purpose of discussion of soil compaction on the rear yards of
Lots No. 10 through 72 in Tract 4102 as requested by Con-Tech Building Co.
Mr. Toups further explained the rear yards had permanent pasture grass
buried in a trench five feet deep within approximately five feet of the
rear of the houses, and that some degree of settlement could be expected
within the next few years unless some correction is made. This matter was
called to the attention of the Developer in October, 1961, and though a
chemical solution had been applied, the compaction tests still did not
meet the specifications requested by the City. The City Engineer further
stated that future construction of block wall fences, patios, swimming
pools and similar structures might not be satisfactory unless the condition
is corrected at this time.
Mr. Robert W. Garson, Attorney representing Con-Tech Building Co.,
addressed the Council stating his company would be willing to post a
bond in an amount as set forth by the City, to guarantee the compaction
of the rear yards in these specified lots, providing the company could
let the home-owners move into their homes and release the utilities
and Certificates of Occupancy on these certain lots.
After considerable discussion, it was moved by Councilman Van Dyke,
seconded by Councilman McCarney, and unanimously carried, that an
$8,O00.00 Surety Performance Bond be submitted by Con-Tech Building Co.,
guaranteeing within 30 days to re-compact the rear yards of the 56 houses
in question, so that a relative density is 86% weighted average, and a
minimum of not less than 82%, the certificates of occupancy to be issued
to the home-owners with a letter attached setting forth the present
condition of the rear yards, as soon as the bond is submitted to the City,
said bond to be released only by the City Council on satisfactory completion
of work.
Mr. Garson, Attorney for the Developer, and Mr. Jos. Long, Tract
Superintendent for the Con-Tech Building Co., stated this was a
satisfactory agreement, and the Bond would be forthcoming on Monday
morning, March 12, 1962.
