HELD
September 4, 1962
The City Council of the City of Cypress met in adjourned session
in the Council Chambers, 9471 South Walker Street, Cypress, California
on Monday, September 4, 1962 at 7:30 P- M., Mayor Van Dyke presiding.
PRESENT: 4 COUNCILMEN: Gordon, Noe, Wright and Van Dyke
ABSENT: 1 COUNCILMAN: Gorzeman
Also present were: City Manager, Darrell Essex; City Clerk,
Ferne S. Phillips and Assistant City Engineer, Ronald Nottingham.
APPOINTMENT OF CITY ATTORNEY:
It was moved by Councilman Noe, seconded by Councilman Wright and
unanimously carried, that Mr. Rodger Howell of the firm of Rutan,
Lindsay, Dahl, Smedegaard, Howell and Tucker, Santa Aria, California
be retained as the City Attorney for the City of Cypress to serve at
the pleasure of the City Council.

MINUTES:
It was moved by Councilman Wright, seconded by Councilman Noe, and
unanimously carried, the Minutes of August 20, 1962 be approved with the
correction as follows: "~ page 8, under the title of resignation of
City Attorney" the motion should read "Received and accepted".
ORAL COMMUNICATIONS:
There were no oral communications presented at this time.
WRITTEN COMMUNICATION FROM ORANGE COUNTY PLANNING COMMISSION RE: NOTICE
OF PUBLIC HEARING ON USE VARIANCE PERMIT:
A written communication from the Orange County Planning Commission
giving notice of a Use Variance Permit resuest on the north side of Lincoln
Avenue 540' west of Holder Street to construct additional apartment units
was presented.
It was moved by Councilman Noe, seconded by Councilman Wright, and
unanimously carried, this communication be received and filed.
WRITTEN COMMUNICATION FROM ORANGE CO~4TY FLOOD CONTROL DISTRICT RE:
PF~RMISSION FOR STORM DRAIN INLET:
A written communication from the Orange County Flood Control District
regarding permission for Storm Drain Inlet to Flood Control District was
presented.
It was moved by Councilman Wright, seconded by Councilman Noe, and
unanimously carried, this request be granted.

CONSIDERATION OF APPLICATION FOR ZONE CHANGE z-~7~ MRS. AGNES PIER:
Consideration of application for amendment to the Zoning Ordinance to
fezone from A-2 (Heavy Agriculture) to R-1 (Residential One-Family) that
property located on the southwest corner of Knott and Cerritos of approximately
37 acres as requested by Mrs. Agnes Pier, 2831 N. St. James Place, Altadena,
California and known as Zone Change Z-37 was presented, as continued from a
previous meeting and discussion was held on the matter of leaving a 300' strip
as a buffer along the railroad track.
It was moved by Councilman Noe, seconded by Councilman Wright, and
unanimously carried, the following Ordinance be read by title only:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING
ORDINANCE NO. 90, THE ZONING ORDINANCE BY CHANGING THE ZONE OF A
CERTAIN PARCEL OF LAND WITHIN THE CITY TO ZONE R-1 (RESIDENTIAL
ONE-FAMILY) Z-37.
It was moved by Councilman Noe, seconded by Councilman Wright, this
Ordinance pass its first reading by the following called vote:

Motion failed to carry.
Mr. K. Carlson of Voorhees, Trindle & Nelson, representing the Developer,
addressed the Council concerning the proposed development of this property.
After discussion, it was then moved by Mayor Van Dyke, seconded by Councilman
Noe, and carried, to re-open en-~ideration of Zone C~a~ge 2-37.
It was moved by Councilman Noe, seconded by Councilman Wright and carried,
the above Ordinance recommending approval of Zone Change Z-37 pass its first
reading by the following roll call vote:

WRITTEN COMMUNICATION ~ROM FOSTER & KLEISER SIGN COMPANY AND PACIFIC OUTER
ADVERTISING COMPANY RE: BUSINESS LICENSE FEES FOR BILLBOARDS:
A written communication from Foster & Kleiser Sig~ Company and Pacific
Outdoor Advertising Company regarding business license fees for billboards
within the City of Cypress was presented.
Mr. J. W. Matkins, representative of Foster & Kleiser Sign Co., addressed
the Council requesting reduction of business license fees in the City.
Mr. j. Kingry, representative of Pacific Outdoor Advertising Company,
addressed the Council requesting reduction of business license fees in the City.
After discussion, it was moved by Councilman Wright, seconded by
Councilman Gordon, and unanimously carried, the City Attorney be directed
to prepare an Ordinance amending the Business License fees for billboards
to be established as an annual fee of $35.00 plus $25.00 per billboard.

FIRST READING ORDINANCE RE: REGULATION OF TAXI-CAB PERMITS:
It was moved by Councilman Noe, seconded by Councilman Wright and
unanimously carried, that the following Ordinance be read by title only:
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF CYPRESS REGULATING THE USE AND OPERATION
OF TAXICABS OR LIMOUSINES UPON THE PUBL'IC STREETS OF THE CITY OF
CYPRESS; PROVIDING FOR DRIVER'S PERMITS AND AUTHORIZING THE CITY COUNCIL
TO HOLD PUBLIC HEARINGS AND TO GRANT OR DENY APPLICATIONS FOR OWNERS'
CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY; REGULATING THE
RATES OF FARES TO BE CHARGED tYDR THE USE OF TAXICABS AND LIMOUSINES;
PROVIDING A PENALTY FOR VIOLATING ANY OF THE PROVISIONS OF THIS
ORDINANCE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH.
It was moved by Councilman Noe, seconded by Councilman Wright, and
unanimously carried, that this Ordinance pass its first reading by the

CORRECTION OF RESOLUTIONS NOS. 297 AND 29p:
The City ~unager addressed the City Council on certain typographical
and mathematical errors in Resolution No. 297 and Resolution No. 299 con-
cerning levying the assessments of Cypress Lighting District No. I and
Cypress Lighting District No. 2..
It was moved by Councilman Noe, seconded by Councilman Wright, and
unanimously carried, to correct these typographical and mathematical errors
in the above mentioned Resolutions. The following roll call vote was taken:
