Minutes 63-03-25MINUTES OF THE CITY COUNCIL OF THE CITY OF CYPRESS HELD March 25, 1963 The City Council of the City of Cypress met in regular session on March 25, 1963 in the Council Chambers, 9471 So. Walker, Cypress at 7:30 P. M., Mayor Van Dyke presiding. PRESENT: Gordon, Gorzeman, Noe, Wright and Mayor Van Dyke ABSENT: None Also present were: City Manager, Darrell Essex; City Attorney, Rodget Howell; City Engineer, John Toups and City Clerk, Ferne S. Phillips. MINUTES: It was moved by Councilman Wright, seconded by Councilman Noe and unanimously carried, the Minutes of March 11, 1963 be approved as mailed. ORAL COEe4UNICATIONS: There were no oral communications presented at this time. PRESENTATION OF RESOLUTION RE: VOLUNTEER FIRE DEPARTMENT: Mayor Van Dyke announced the City Council had prepared a formal Resolution commending the Volunteer Fire Department for their services to the conmmnity and read Resolution in full, title as follows: RESOLUTION NO. 349 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS COMMENDING THE VOLUNTEER FIRE DEPARTMENT FOR SERVICES PERFORMED. It was moved by Councilman Gordon, seconded by Councilman Noe and unanimously carried, this Resolution be adopted by the following roll call AYES: 5 COUNCILMEN: NOES: 0 -COUNCILMEN: ABSENT: 0 COUNCILMEN: vote: Gordon, Gorzeman, Noe, Wright and Van Dyke None None Mr. A. E. Arnold, Fire Chief for the Volunteer Fire Department accepted the Resolution on behalf of the Fire Department. WRITTEN C(I~MUNICATION FROM KIWANIS CLUB OF CYPRESS RE: MEETING ON STATE CONSMR COUNSEL. A written communication from the Kiwanis Club of Cypress announcing a meeting for general information on the State Consumer Counsel to be held Friday, March 29, 1963 at the Cypress Elementary School Auditorium was presented. It was moved by Councilman Gorzeman, seconded by Councilman Noe and unanimously carried, this c~m.unication be received and filed. PUBLIC HEARING TO CONSIDER PROTESTS IN THE "LINCOLN ANNEXATIOn': The Mayor announced this was the time and place for the public hearing to consider protests in the proposed "Lincoln AnnexatioW' for that property located north of Lincoln, between City limits and Sumner Place as proposed for annexation by Forest Lawn Co., Glendale, Calif., and asked if anyone in the audience wished to speak for or against this annexation. March 25, 1963 Mr. Ugene Blalock, representing Forest Lawn Co., addressed the City Council regarding this annexation. There being no written conmmnications and no oral protests, the Mayor declared the public hearing closed. It was moved by Councilman Gorzeman, seconded by Councilman Gordon and unanimously carried, the following Ordinance be read by title only: ORDINANCE NO. AN ORDINANCE OF THE CITY OF CYPRESS APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "LINCOLN ANNEXATIOI~' TO THE CITY OF CYPRESS AND CLASSIFYING THE PROPERTY "GEM ZONE". It was moved by Councilumn Wright, seconded by Councilman Gordon and unanimously carried, this Ordinance pass its first reading by the following called vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Gordon, Gorzeman, Noe, Wright and Van Dyke None None PUBLIC HEARING 'RE: CONDITIONAL USE PERMIT NO. C-146: The Mayor announced this was the time and place for the public hearing to consider application for the erection of three subdivision directional signs located at the corner of Cerritos and Moody; Walker and Cerritos and corner of Ball and Moody as requested by Columbia Outdoor Advertising, 7591 Acacia Ave., Garden Grove, and asked if anyone in the audience wished to speak for or against this proposed use. There being no written cormnunications and no oral protests, the Mayor declared the public hearing clo~ed. It was moved by Councilman Noe, seconded by Councilman Gorzeman and unanimously caFried, this Conditional Use Permit No. C-146 be approved subject to the following conditions: 1. The permit be granted until the homes are sold but not to exceed two (2) yearS., 2. All new materials be used in construction of sign. No advertising other than Fairway Park be permitted with the exception on the sign located at Moody St. and Ball Rd. state "Future Junior High School Site" rather than "Coming Here SooW'. C-147; COLUMBIA OUTDOOR ADVERTISING: The Mayor announced this was the time and place for the public hearing to consider application for the erection of a subdivision directional sign to be located on the south side of Lincoln, 225' west of Denni, as requested by Columbia Outdoor Adv. Co., 7591 Acacia Ave., Garden Grove, and asked if anyone in the audience wished to speak for or against this proposed use. Mr. Ben Ricbanan, 7591 Acacia Ave., Garden Grove representing the applicant addressed the City Council regarding this proposed use. There being no written c~maunications, and no oral protests, the Mayor declared the public hearing closed. March ZS, 1963 It~ was moved by Councilman~ Gordon, seconded by Mayor Van Dyke this application for Conditional Use Permit be denied. Motion failed to carry. It was then moved by Councilman Wright, seconded by Councilman Gorzeman and carried, this Conditional Use Permit be approved subject to the following conditions: 1. All new materials be used. 2. Permit to expire six (6) months from date of issuance of Building Permit. The following roll call vote was taken: AYES: 4 COUNCII24EN: NOES: 1 COUNCILMEN: ABSENT: 0 COb'NCILMEN:: Gorzeman, Noe, Wright and Van Dyke Gordon None PUBLIC HEARING .RE: ZONE CHANGE Z-71; STARDUST LANDS INC.: The Mayor announced this was the time and place for the public hearing to consider application for amendment to the Zonfng Ordinance to change the zone from A-2 (Heavy Agriculture) to R-1 (Residential One-Family); R-3 (High Density Multiple Family) and C-2 (General Cuumaercial) that property located on the west side of Valley View, 660' north of Cerritos as requested by Stardust Lands Inc., 1665 So. Brookburst Ave., Anaheim, to be known as Zone Change Z-71 and asked if anyone in the audience wished to speak for or against this proposed zone change. Mr. M. Morita addressed the Council concerning his property adjacent to the proposed zone change property. Mr. Richard Owens, representing the Developer addressed the Council regarding the proposed zone change. There being no written communications, and no oral protests, the Mayor declared the public hearing closed. It was moved by Councilman Noe, seconded by Councilman Wright and unanimously carried, to read the following Ordinance by title only: ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING ORDINANCE NO. 90, THE ZONING ORDINANCE, BY CHANGING THE ZONE OF CERTAIN PARCELS OF LAND WITHIN THE CITY TO ZONE R-1 (RESIDENTIAL ONE-FAMILY); R-3 (HIGH DENSITY MULTIPLE FAMILY); AND C-2 (GEHEHAL COMMERCIAL); ZONE CHANGE Z-71 (STARDUST lANDS INC.) CIVIC CENTER REPORT: It was moved by Councilman Noe, seconded by Councilman Gorzemen and unanimously carried, the City Manager and City Attorney be authorized to proceed with further negotiations for acquisition ~or a Civic Center site.
