HomeMy WebLinkAboutMinutes 65-05-18 (2)380 MINUTES OF THE CITY COUNCIL OF THE CITY OF CYPRESS AT A SPECIAL MEETING HELD May 18, 1965 The City Council of the City of Cypress met in Special Session on Tuesday, May 18, 1965, at 7:31 p.m. in the City Council Chambers, 5311 Orange Avenue, Cypress, California, all members having been notified as required by law, Mayor Frank P. Noe presiding. PRESENT: Gorzeman, Kanel, McCarney, and Noe ABSENT: Wright Also present were City Manager/City Clerk Darrell Essex, Administrative Assistant Darrell Dalton, and City Attorney James Erickson. CANVASS OF RESULTS OF SPECIAL MUNICIPAL ELECTION HELD ON MAY 11~ 1965: The Mayor mnounced this was the time and place for the City Council to canvass the results of the Special Muncipal Election held on May 11, 1965. The City Clerk presented the City Council with the Tally Sheets and the Result of Votes Cast as prepared by each of the five Election Precinct Boards and the Absentee Ballot Canvass Board for the election. During the canvass it was noted that in Precinct No.3, the total number of votes cast was two more than the total ballots tallied on the tally sheet. The City Manager stated that he had checked this discrepancy with Martin & Chapman Company, Election Suppliers, who advised that since the number of votes cast did not exceed the number of voters who signed the roster, and since the difference did not affect the results of the election, the City Council, as the Canvassing Board, ~ould accept the result of the vote as submitted by the precinct. It was moved by Councilman Kanel, seconded by Councilman Gorzeman, and unanimously carried, the following ResolUtion be adopted: RESOLUTION NO. 588 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, DECLARING THE RESULTS OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON MAY 11, 1965. The City Council of the City of Cypress, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: SECTION 1. That a Special Mur~zipal Election was duly called and regularly held in said City on the llth day of May, 1965, at which election there was submitted to the qualified voters of said City the following measure, to wit: MEASURE: CITY OF CYPRESS--ZONING ORDINANCE REFERENDUM. Shall Ordinance No. 242, changing the zone of territories referred to therein from M-1 (Light Manufacturing) to H-C (Highway Commercial), Zone Change No. Z-121, be adopted to become effective in the City of Cypress? SECTION 2. That the returns of said election ha~e been duly and regularly canvassed by this City Council as provided by law, and all absentee ballots, if any, returned have been canvassed as provided by law. SECTION 3. That the votes of a majority of all the voters voting at said election upon said measure were cast in favor of the measure ~and said Ordinance No. 242 is hereby declared to be in effect in the City of Cypress. SECTION 5. That the City Clerk of this City is hereby directed to enter this Resolution in full in the minutes of this City Council, which entry shall constitute tile City Clerk~s statement of the result of the election. Noe MAYOR STATE OF CALIFORNIA) COUNTY OF ORANGE ) ss I, Darrell Essex, City Clerk of the City of Cypress, DO tIEREBY CERTIFY that the foregoing Rasolution was adopted at a special meeting of the said City Council held on tile 18th day of May, 1965, by the following vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Gorzeman, Kanel, McCarney, and Noe None Wright /s/ Darrell Essex CITY CLERK OF THE CITY OF CYPRESS CONSIDERATION OF RULES OF ORDER FOR THE CITY COUNCIL: The City Manager stated that at the regular meeting of May 10, 1965, the City Council had voted to consider at this meeting an Ordinance adopting Rules of order for the City Council. T~.~swer to an inquiry from Mayor Noe, the City Manager s rated that in his opinion the Ordinance appeared satisfactory as submittdd with the exception of Section 6, which changed the order of business on City Council Agendas. The City Manager stated that it would be preferred to maintain the current agenda~ relative to the order of business. May 18, 1965 Following a brief discussion, it was moved by Councilman Gorzeman, seconded by Councilman McCarney and carried, to read the proposed Ordinance by title only. The vote not being unanimous, the City Council was advised that the Ordinance would then have to be read in full rather than by title only. Councilman Kanel, who had voted in opposition to reading the Ordinance by title only stated thethe would change his vote to a yes vote, but that he would like to have further discussion concerning the Ordinance. The City Clerk read the Ordinance by title o~ly, title as follows: ORDINANCE NO. AN ORDINANCE OF ~IE CITY OF CYPRESS ESTABLISHING RULES OF ORDER FOR THE CONDUCT OF CITY COUNCIL MEETINGS. It was moved by Councilman Gorzeman and seconded by Councilman McCarney, to approve the first reading of this Ordinancel~ with Section 6 indicating the Order of the Agenda as presently used ;by the City Council. Prior to voting on this motion, further discussion was held. Councilman Kanel asked various questions concerning several sections of the proposed Ordinance, all of which were answered by the City Attorney.
