Minutes 70-04-24MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL HELD April 24, 1970 An adjourned regular meeting of the Cypreas City Council was called to order at 7:30 p.m. on Friday, April 24, 1970, in the City Council Chambers, 5275 Orange Avenue, Mayor Delno G. Kanode presiding. PRESENT: Councilmen Bowen, Kanel, Harvey, Noe and Kanode ABSENT: None Also present were City Manager/City Clerk Darrell Essex, City Attorney James E. Erickson and the following members of the City Staff: Dunlap, Poertner, Grissom, Savord and Nudson. ORAL COMMUNICATIONS: Mr. Jack Leneker, 4504 Middlebury Circle, Cypress, addressed the Council relating his observations in the past two elections which indicated that those council can- didates who most actively supported the bond issues received the largest negative votes during the elction. CONSIDERATION OF CITY CLERK'S CERTIFICATE OF CANVASS OF ELECTION RETURNS: The City Manager presented a report dated April 16, 1970 indicating that the City Clerk con- ducted a canvass of the election returns of the April 14, 1970 General Municipal Election and Special Bond Election in the City Council Chambers on Wednesday, April 15, 1970 at 10:00 a.mo, and transmitting the City Clerk's Certificate of the Canvass of the election returns for these elections. The City Manager indicated that since the recount in five election precincts had resulted in a change in the total votes per candidate than was originally reflected on the tally sheets from these precincts, an additional Certificate had been pre- pared by the City Clerk's Office incorporating the corrected vote counts for the council candidates into the original precinct results and this Certificate is attached to the proposed Resolution reciting the facts of the General Municipal and Special Elections and referred to as Exhibit "C." It was moved by Councilman Bowen and seconded by Councilman Noe to accept the City Clerk's Certificate of Canvass of election returns of the General Municipal Election and Special Bond Election and to authorize the Certificate, incorporating the corrected votes from the recount of the council candidate votes in Precincts 7, 9, 11, 13 and 16, to be used as an exhibit to the Resolution reciting the fact of the election returns. The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Bowen, Harvey, Kanel, Noe and Kanode None None CONSIDERATION OF RESOLUTION RECITING FACT OF GENERAL MUNICIPAL ELECTION: It was moved by Councilman Harvey and seconded by Councilman Noe to adopt the following Resolution by title only, title as follows: RESOLUTION NO. 1061 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF CYPRESS ON THE 14TH DAY OF APRIL, 1970, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. The City Council of the City of Cypress, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: SECTION 1o That a special election was duly called and regularly held in said City on the 14th day of April, 1970, at which election there was submitted to the qualified voters of said City the following proposition, to-wit: Shall the City of Cypress incur a bonded indebtedness in the principal sum of $1,250,000 for the acquisition and construction by said City of a certain municipal improvement, to-wit: the acquisition of land and the development thereof for public parks and the development of existing park sites, including equipment, landscaping, lighting, walks, parking and other works, property or structures necessary or convenient for any of the foregoing and all expenses incidental to or connected with the authorization, issuance and sale of the bonds? SECTION 2~ That the returns of said election have been duly and regularly canvassed by this City Council as provided by law, end all absentee ballots, if any, returned have been canvassed as provided by lawo SECTION 3= That the votes cast in the precindts established for said~election upon said proposition and for and against said proposition, the absentee votes, if any, cast upon said proposition and for and against said proposition, and [he total votes cast at said election for and against said proposition and upon said proposi- tion 2re as follows: YEs. KiNODE MAYOR OF THE CITY OF CYPRESS CITY CLERK OF THE CITY OF CYPRESS - 3 - City Council Minutes April 24, 1970 The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Bowen, Harvey, Kanel, Noe and Kenode None None INSTALLATION OF NEWLY-ELECTED COUNCILMEN AND REORGANIZATION OF CITY COUNCIL: At this time the City Clerk presented newly-elected Councilmen Robert Co Harvey, Otto Jo La- :ayo and Henry M. Roberrs, Jr. with Certificate~ of Election as members of the City ]ouncil and administered the oaths of office to each of them. Mayor Kenode then called former Councilmen Richard L. Bowen and Frank Po Noe to the podium and presented each of them with Community Service Plaques° Former Councilman Noe expressed his appreciation to the citizens of the City for the opportunity to serve on the City Council for eight years° Former Councilman Bowen also expressed his pleasure in having served on the City Council and indicate~ ~at he would be willing to offer his services to the citizens of the community and to the City Council in other types of com~nunity service° The City Manager expressed the staff's appreciation for having had the opportunity to work with these two former Councilmen° Councilmen Kanel and Harvey and Mayor KarLode expressed their pleasure in having worked with former Councilmen Bowen and Noe and thanked them for their contributions to the community as members of the City Council~ : Newly-elected Councilmen Harvey, Lacayo and Roberrs expressed their appreciation to all those persons who supported them and indicated their desire to effectively repre- sent the citizens of Cypress° Mayor Kanode then turned the gavel over to City Clerk Darrell Essex to preside over ~he selection of Mayor. · t was moved by Councilman Roberts that Councilman Kanel be nominated for the position of Mayor° Councilman Harvey re-stated his opposition to the annual rotation of the position of Mayor and indicated that for this reason, he would wish to nominate Councilman Kanode for a second term as Mayor° It was moved by Councilman Harvey, seconded by Councilman Roberts and unanimously carried to declare the nominations for the position of Mayor closed. The City Clerk indicated that the election could be held either by secret ballot or by the voting machine system° The following vote was taken for the position of Mayor: : For Councilman John Kanel 3 COUNCILMEN: Kanel, Roberrs and ~acayo For Councilman Delno Go Kanode 2 COUNCILMEN: Harvey and Kanode The City Clerk turned the meeting over to Mayor Kanel who requested that the City Council recess into a Personnel SeSsion, prior to electing the Mayor Pro-tem. It was moved by Councilman Harvey and seconded by Councilman Kanode to go into an ~xecutive session for the purpose of discussing personnel matters at 7:58 p.m. The Meting was called back to order at 8:11 pom., with all City Councilmen present° Mayor Kanel then indicated that he would do his best to satisfactorily perform the duties of Mayor and to represent the City Council at various functions. He further stated that the present City Council would like to express its complete support to the present administration, staff members and City Manager Darrell Essex° Mayor Kanel then asked for nominations for the position of Mayor Pro-tem. - 4- City COuncil Minutes April 24, 1970 Councilman R~berts nominated Councilman Lacayo for the position of Mayor Pro-tem. It was moved by Councilman Roberrs and secdnded by Councilman Kanode that nominations for Mayor Pro-tom be closed and that the Council cast a unanimous vote for Councilman Lacayo since only one nomination was made~ The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCILMEN: NOES~ 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Harvey, Kenode, Lacayo, Roberrs and Kanel None None CONSIDERATION OF CXTY COUNCIL APPOINTMENTS: Upon the request of Mayor Kanel, it was moved by Councilman Harvey~ seconded by Councilman Kenode and unanimously carried to defer consideration of City Council appointments until the regular City Council meeting of April 27, 1970o ORAL COMMUNICATIONS: There were no oral communications presented at this time° Councilman Kenode indicated that Friday, May 1, 1970 is "Law Day" and encouraged every citizen to participate in acknowledging this event° In response to an inquiry from Councilman Kenode, the City Manager advised that the Board of Supervisors approved without an election the withdrawal of the City of La Palma from the Cypress Park and Recreation District and suggested that the City Council may wish to discuss the impact of this action at a future City Council meeting° M~yor Kanel re~d excerpts from his cements which were printed in the Santa Aria Register rsgarding the election and the need for the City Council to unify and to move the City ~orwardo At this time Councilman Kenode stated that it is his policy not to give comments to the press outside of the Council Chambers since he feels that any statement he makes should be made in an open meeting with the public in attendance° There being no ~urther business to come before the City Council, it was moved by Councilman Kenode, seconded by Councilman Roberrs and unanimously carried to adjourn the meeting at 8:20 pllmo ATTEST: CITY eL~RK F/TH~ C ~Y C[ CYPRESS 0 I MA OR OF TME CXTYO' 'C FRESS
