Minutes 70-08-31 (8:05 a.m.)MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL HELD August 31, 1970 The adjourned regular meeting of the Cypress City Council was called to order at 8:05 a~m~, on Monday, August 31, 1970, in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor John Kanel presiding. PRESENT: Councilmen Harvey, Kenode, Roberrs and Kanel ABSENT: Councilman Lacayo Also present were Administrative Assistant Gone Poetthor, City Attorney James E. Erickson, and the following members of the City Staff: Dunlap, Putnam, Schatzeder, Nudeon and Grissom. CONSIDERATION 0F_ADOPTINq AN ORDINANCE FIXINq THE ~/NIQ~P~L TAX I~TE FOR THE FISCAL YEAR 1970-71: The Administrative Assistant presented a report dated August 20, 1970, which indicated that each year following the receipt of the assessed valuation of the City transmitted by the County Auditor-Controller, the City Council is required to adopt an Ordinance which establishes the City tax rate for the current fiscal year. The report outlined the assessed valuation figures for the City for the 1970-71 fiscal year, and indicated that based on a tax rate of $1 per $100 assessed valuation and utilizing a 5% delinquency factor, which was the basis used for calculating revenues from property taxes in zhe 1970-71 fiscal year budget, the City would receive $598,943 from this soureel The report further indicated that since the final assessed valuation figures were somewhat higher than those anticipated in the budget, the projected '~evenues from property taxes will be $60,843 over the budget projection. It was report- ed that this additionelrevenue will offset the $55,665 principal and interest payment due in 1971 for the Drainage Bond issue, which is now being paid from General Fund sources without an additional tax levy. The report continued, that the additional amo~n~ will also partially offset the losses in revenue which appear to be likely in =he ~urrent fiscal year due to the slowdown which has occurred in the construction ~f single family residential units in the City. The report stated that the Ordinance Ilxing the City of Cypressw tax rate must be submitted to the County Auditor's office no later than Monday, August 31, 1970o Councilman Harvey stated that he felt the reasons which were presented in the report for retaining the present assessed valuation were not sufficient, and had been ~n=icipated at the time of the budget discussions° He further stated that he had noticed in a recent newspaper, that the City of Cypress had one of the highest percenzage increases in assessed valuation in Orange County~ Councilman Harvey indicated that he had proposed that some of the money received as a result of last yearYe increase be returned to the taxpayers; but that he had not been successful° It was moved by Councilman Harvey and seconded by Councilman Roberrs that this year's tax rate be reduced to the extent necessary to return the unanticipated revenues to the taxpayers of the City. RECESS~ Mayor Kanel 4eclared a recess at 8:20 a.m~, in order to allow time for the computation of the exact figure. The meeting was called back to order at 8:30 a.m., with the following Councilmen present: PRESENT: Councilmen Harvey, Kenode, Roberrs and Kanel ABSENT: Qouncilman Lacayo In response to inquiries from Councilman Roberrs, the Finance Director explained what was included in the local secured roll, the public utility roll, and the unsecured City Council Minutes August 31, 1970 roll ~ He then explained the method of computing the tax rate in order to generate the projected revenue of $538,100, which, he stated, would require a tax levy of 89~ 84 cents per $100 assessed valuetion o At this time, the Administrative Assistant urged the Cotmoil to consider maintaining the $1 per $100 assessed valuation tax rate for the 1970-71 fiscal year stating that the budget requests which were presented to the City Council would have been some- what higher had the property tax projections been more accurate. He pointed out that many important projects, primarily in the Police and Public Works Departments, had been eliminated only because it was felt they could not be financed from anticipated revenues. He also explained that the additional revenue. received as a result of the increased valuation would be needed to offset projected building revenues which would probably not be realized this year and the loss of State-remitted per capita revenues due to the Federal Census population estimate which would be lower than that used by the State in the past. Councilman Roberts indicated that the City is very fortunate to have dedicated persons on the City Staff whose very nature is to do the best Job they can for the cizizensl He coneanted that the nature of their task is that they sometimes wish to do more for the City than the City can really afford, however. DIscussion ensued relative to the over-all revenue picture and the basis for determining the estimated revenues for the 1970/71 fiscal year budget. Following discussion, Councilman Harvey and Councilman Roberrs agreed to withdraw their motionl. It was moved by Councilman Harvey and seconded by Councilman Robarts to read the following Ordinance, establishing the tax rate for the 1970-71 fiscal year at 95¢ per $100 assessed valuation, by title only.. The Mayor declared the Public Hearing open° it was moved by Councilman Roberrs, seconded by Councilman Harvey and unanimously carried to continue the consideration of this Public Hearing to 8:00 p.m., August 31, 1970~ EXECUTIVE SESSION: It was moved by Councilman Roberrs, seconded by Councilman Harvey and unanimously carried to go into an Executive Session at 9:00 a~m~, with members of the City Council and the City Attorney, to discuss a personnel matter.
