OF THE CYPRESS CITY COUNCIL
HELD
November 16, 1970
The adjourned regular meeting of the Cypress City Council was called to order
at 7:30 p.m., on Monday, November 16, 1970, in the City Council Chambers,
5275 Orange Avenue, Cypress, California, Mayor John Kanel presiding.
PRESENT: Councilmen Harvey, Kanode, Roberts and Kanel
ABSENT: Councilman Lacayo
Also present were City Manager/City Clerk Darrell Essex, Assistant City Attorney
Len Hampel end the following members of the City Staff: Grissom, Nudsen, Putnam,
Schatzeder and Planning Consultant Larry Wise.
PLEDGE OF ALLEGIANCE.:
Councilman Harvey led the City Council and audience in the Pledge of Allegiance.
It was moved by Councilman Harvey, seconded by Councilman Kenode and unanimously
carried to proceed to Oral Communications at this time.
ORAL COMMUNICATIONS:
Mro Earl Zynda, 4931 Lemon Avenue, Cypress, addressed the Council expressing
concern regarding alleged discrepancies in the method used to conduct the
November 3rd election to fill the vacancy on the Cypress School District Board
of Trustees° Mr. Zynda requested the City Council to correspond with the
Orange County Board of Supervisors requesting that they investigate this matter
prior to declaring the results of that election.
In response to an inquiry from Councilman Harvey, the City Manager advised
that the polling places were selected by the County Clerk. Councilman Harvey
requested that the City Manager request the County Clerk to discontinue the
use of Cypress College as a polling place.
It was moved by Councilman Kenode, seconded by Councilman Harvey and unanimously
carried to place this matter on the agenda at this time.
Mr. Dean Dennis, 4236 Dover Circle, Cypress, addressed the Council stating that
he was a ca~didate for the vacant position on the Board of Trustees and had been
informed by voters that the ballots had been distributed in an indiscriminate
manner, and that it was estimated that as many as 500 people in one precinct
were given improper ballots. Mr. Dennis urged the City Council to take action
on this matter at their earliest convenience.
It was moved by Councilman Kanode and seconded by Councilman Harvey to direct
a communication to the Orange County Board of-~ervisors requesting them to
investigate the alleged election errors prior to the certification of the
election results.
Following discussion the motion was carried by the following roll call vote:

PUBLIC HEARING TO CONSIDER THE ADOPTION OF THE HOUSING ELEMENT OF THE GENERAL
PLAN OF THE CITY OF CYPRESS INITIATED BY THE PLANNING COMMISSION: The Mayor
announced this was the time and place for the Public Hearing to consider the
adoption of the Housing Element of the General Plan of the City of Cypress.
The Mayor declared the Public Hearing open and requested the Staff to present
its report.
The City Manager presented a report dated November 12, 1970, which indicated
that the Planning Commission, at its Public Hearing, reconmmnded adoption of
the Houping~ Element. The report indicated that the Affidavits of Posting and
City Council Minutes November 16, 1970
and publication of the Public Hearing notices on this matter are on file in theg ~ '
~ffice of the City Clerk.
It was moved by Councilman Roberrs, seconded by Councilman Harvey and unanimously
carried to continue this matter ~o~8:15 P.M.
EXECUTIVE SF~SION:
It was moved by Mayor Kan~l, seconded by Councilman Harvey and unanimously carried
to go into an executive session to discuss a personnel matter at 8:02 P.M.
The meeting was called back to order at 8:18 P.M.

CONTINUATION OF PUBLIC HEARING TO CONSIDER THE ADOPTION OF THE. HOUSING ELEMENT
OF THE GENERAL PLAN OF THE CITY OF CYPRESS INITIATED BY THE PLANNING COMMISSION:
Planning Consultant, Mr. Larry Wise, verbally presented a report outlining in
detail the General ObJ strives of the Housing Element of the General Plan, along
with the Housing Plan and Basic Studies and Information sections for City Council
review and information. An official copy of the Housing Element document is on
file in the Office of the City Clerk. Mr. Wise advised the City Council that the
Housing Element is necessary to the General Plan so that there would be all elements
of a master plan in order to receive any Federal Grant Funding on projects in the
City of Cypress. Mr. Wise explained to the Council that this was not an urban
renewal program but rather a well phased program to go into areas with technical
assistance to upgrade their areas.
Councilman Roberrs requested the members of the press in attendance to give coverage
in an objective manner when referring to certain 8=~as of the City that are mentioned
in this Housing Element as areas in need of upgrading.
Mayor Kanel requested public testimony in regard to this Public Hearing. There
being no one from the audience wishing to speak on this item at this time, Mayor
Kanel asked if there were any comraents from the Council.
In response to an inquiry from Councilman Kenode, Mr. Wise stated that information
as to comparisons of rental and occupant-owners of residential properties was
compiled and considered in the study of the Housing Element.
Councilman Harvey conmented that he thought this was a very thorough report, but
felt that certain things about our community are a bit different from others and
questioned some of the areas designated as needing upgrading as areas that are
currently, by attrition, upgrading themselves by people who are moving into the
area with more funds invested in their homes over the previous no-down type of
financing in the area.
COUNCILMAN LACAYO ARRIVED AT 9:18 P.M. AND TOOK HIS PLACE AT THE PODIUM.

At the request of Councilman Robarts, Mayor Kanel declared a recess at 9:21 P.M.
The meeting was called back to order at 9:35 P.M. with all Councilmen present.
In response to an inquiry from Mayor Kanel, the City Manager advised that if this
Housing Element is adopted the Council is obligating themselves to the tentative
program and to work~oward a feasible and practical work program to make some
degree of progress.
Mayor Kanel then again requested if there was anyone in the audience wishing to
participate in discussion on this subJ oct.
Mr. Ronald Toll, 8421 Dennt Street, Cypress, addressed the Council stating that
the anti re Wee t side of Denni is listed as needing improvement in the Housing
Element, and that it was his opinion it was not necessarily for the good of the
people to make certain public improvements, such as curbs, as many of these home-
owners are happy with their properties as they presently are.
Mrs. Marfan Bakke, 5055 Brunswick Drive, Cypress, inquired as to what the first year's
implementation of the program would consist of, and Mr. Putnam responded they would
consider the establishment of a housing authority and that the housing authority

would establish the work program.

In reply to an inquiry from Councilman Harvey, Mr. Wise advised that a Housing Element
is now required under the Planning Act of the State of California in order to
qualify for Federal Grants. He further advised that no criteria had been set forth,
only that in an appropriate period of time the element must be adopted and imple-
mented.
Mrs. _ Ruth Parker, 4662 Ashbury Avenue, Cypress, addressed the Council inquiring
if people would actually receive financial aid as well as financial suggestions
regarding property improvements. Mr. Wise advised that the City would act only
in an advisory capacity informing citizens of financial aid available to them.
He further advised that the City could act further in giving technical help and
assistance to citizens.
In response to an inquiry from Councilman Roberrs, the City Manager advised that
it is anticipated if the Housing Element is adopted that the implementation of
the first year's recom-~ndations could be accomplished by the existing staff.
The City Manager further advised that by the time the City implemented other
phases of the plan that careful consideration would be given to costs. He
further stated that there were no additional fund outlays anticipated in this
fiscal year.
In reply to an inquiry from Mayor Kanel, Mr. Wise advised that the County of
Orange will be working with the cities, as called out in the Planning Act, as
a part of their work program. Councilman Kenode commented that the Southern
California Association of Governments is currently reviewing all plans of
development and that several area-wide plans have been adopted.
In response to an inquiry from Mrs. Alice Frankiewich, 4219 Dover Circle, Cypress,
regarding costs of the program, the City Manager indicated that the proposed
work program as outlined in the Housing Element would involve only minimal cost
to implement since the program involved basically only the offering of advice
and counsel to interested citizens.
RECESS:
Following further discussion of the costs involved in the implementation of the
Housing Element of the General Plan, Mayor Kanel declared a recess at 10:42 P.M.
The meeting was called back to order at 10:48 P.M. with all Councilmen present.
Mayor Kanet asked if there was anyone else in the audience wishing to speak
regarding the Housing Element.
Mrs. Sharron Pritchett, 5776 Stratmore, Cypress, addressed the Council asking
as to what degree the citizens group would be used in this program. The City
Manager responded that citizens would be involved in each neighborh,ood that
actually needed improvement by holding community improvement meetings so that
people could be advised of the funding that is available to them. He further
stated that these homeowners would be encouraged to form their neighborhood
groups.
It was moved by Councilman Roberrs, seconded by Councilman Kenode and unanimously
carried to close the Public Hearing at this time.
In response to an inquiry from Councilman Lacayo, the Assistant City Attorney
advised that in order to vote on the adoption of the Housing Element to the
General Plan, Councilman Lacayo must review, in detail, the information and
testimony which preceeded his arrival to the podium with the Clerk of the
Counctl~
RECESS:
In order to allow Councilman Lacayo the opportunity to review the testimony
and information preceeding his arrival with the Clerk of the Council, Mayor Kanel
declared a recess at 10:55 P.M. The meeting was called back to order at 11:00 P.M.
with all Councilmen present.

Councilman Lacayo stated for the record that he had reviewed all that had been
presented prior to his arrival, and that it was mainly based on the written
material in the pamphlet entitled "The HOusing Element of the General Plan",
which he had thoroughly reviewed prior to the meeting, and therefore respectfully
requested that he be able to vote on this matter.
Councilman Roberts moved to adopt the following resolution by title only, title
as follows:
RESOLUTION NO. 1120
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
ADOPTING THE HOUSING ~LEMENT OF THE MASTER PLAN FOR THE
CITY OF CYPRESS.
Included in this motion, Councilman Robarts requested that the 4th paragraph of
this resolution be modified to read as follows:
"NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED, that the Housing Element
of a Master Plan for the City of Cypress heretofore adopted and certified to the
City Council of the City of Cypress by the Planning Commission thereof, is hereby
adopted as modified."
Councilman Robarts further requested that Item No. 4 on Page 1 of the Housing
Element be modified to read in full as follows:
"It is the City's policy to promote the conservation and rehabilitation of older
neighborhoods°"
Assistant City Attorney Hampal advised the Council that the Legislative Body
could not make any change in the Housing Element until given to the Planning
Commission for their report prior to its adoption unless this deletion in the
Housing Element was a simple matter of terminology, then it would not be re-
quired to again be reviewed by the Planning Commission before adoption by
the City Council.
Following discussion, it was determined that this minor deletion in the Housing
Element was a matter of semantics, and the motion was seconded by Councilman
Kenode! The motion was unanimously carried by the following roll call vote:
