Minutes 70-12-21MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL HELD December 21, 1970 The adjourned regular meeting of the Cypress City Council was called to order at 7:30 p~m~, on Monday, December 21, 1970, in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor John Kanel presiding. PRESENT: Councilmen Harvey, Kanode, Lacayo, Roberrs and Kenel AB SENT: None Also present ware City Manager/City Clerk Dartell Essex, Deputy City Attorney John Murphy and the following members of the City Staff: Dunlap, Pearthor, Hernandez, Schatzeder, Nudson, Grissom and Savord. PLEDGE OF ALLEGIANCE: At the request of Mayor Fanel, Councilman Harvey led the City Council and audience in the Pledge of Allegiance° ORAL COI~tUNICATIONS: There were no oral communications presented at this tim. It was moved by Councilman Harvey, seconded by Councilman Roberrs and unanimously carried to~add to the agerids as Item No. 5 a, the consideration of remarks which had recently been made by Senator Dennis Carpenter relative to the proposed Jet aircraft airport at the Camp Pondsiren Marine Base. CONTINUATION OFCONSIDERATION OF PROPOSED CHANGES IN THE PLANNING DEPARTMENT STAFFING: The City Manager reviewed a report dated N0vembe*'i~ 'i~6~'~hich outlimed several suggested changes relative to the Planning Department staffing, including the addition of a full-time Planning Technician and a Clerk-typist, and changing the salary of the Development Coordinator,.who was appointed Secretary to the Planning CoMesion by the City Council at its regular meeting of November 23, 1970. It was moved by CounCilman Kenode and seconded by Councilmen Harvey to authorize a change of salary of the Development Coordinator to $16,500 annually. The motion was unanimously carried by the following roll call vote: AYES: NOES: ABSENT: 5 COUNCILMEN: 0 COUNCILMEN: 0 COUNCILMEN: Harvey, Kanode, Lacayo, Roberrs and Kenel None None CONTINUATION OF CONSIDERATION OF REPORT.ON NQ~sE 4B4T~EMENT !NAPARTMENT DEVELOPMENTp: The City Manager reviewed a report dated December 10, 1970, which outlined several alternate methods to control the noise problem within the community, Considerable discussion was held in reference to the effect on various types of developmenn, in the event an overall sound study is undertaken by the City. Following discussion, it was moved by Councilman Kenode and seconded by Councilman Roberrs to request the Planning Coremission to review the problem of noise abate' ment within the community, and to submit a report and recommendatiun to the City Council~ The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Harvey, Kanode, Lacayo, Roberrs and Kanel None None Councilmen Roberrs stated that he would like for the Staff to conduct a study relative to a specific plan which could be implemented at the present time, regarding this matter, to be brought to the City Council for its consideration at its regular meeting scheduled for 3anuary 25, 1971. CONTINUATION OF CONSIDERATION OF REPORT ON POST OFFICE STATUS: The City Manager indicated that since the preparation of the December 10~'i9~ Administrative Report to the City Council from the Office of the City Manager regarding the status of the annexation and zoning of the property on Lincoln Avenue, which has been selected as the site for the new Cypress Post Office facility, the Post Office Department has, as a result of notification from the contractor that should the facility be built in the City there would be a price increase in the contract, infDYmed the contractor that the building will be constructed in the County. The City Manager further indicated that apparently, the main difference in developing the facility in the County rather than the City, is that the property in the County is zoned C-2 and does not require a Conditional Use Permit. He stated That he was not certain as to whether or not drainage fees will be required by the County at this point, and expressed concern that the property must be developed with proper drainage, which can only be accomplished if the property drains into the City's storm drain system. In response to inquiries from Councilman Lacayo, the Staff indicated that the property, upon development, would be required to drain into the City's storm drain system, and further that the requirements of the City to develop the Post Office facility were presented to Post Office officials approximately one year ago~ During discussion of this matter, Councilmen Harvey expressed the opinion that the property owner was responsible for the failure of this property to be annexed to the City, since this could have been accomplished some time ago; while Councilman Roberrs expressed the opinion that the contractor was responsible since he was attempting to reduce the cost of the project by avoiding the requirements proposed by the City of Cypress° -2- City Council Minutes December 21, 1970 Following discussion, it was moved by Councilman Kanode and seconded by Councilman HaP~ey that the City Manager direct a conanunication to the appropriate County Officials, the Post Office Department and the Contractor, suggesting that the construction of the Cypress Post Office facility be deferred until such time as the City is able to resolve the construction problems which have been created by the fact that the property has not been annexed to the City, and therefore is not subject to local requirements, including drainage. The motion was unani- mously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 1 COUNCILMEN: ABSENT: 0 COUNCILMEN: Harvey, Kenode, Lacayo and Kenel ~berts None CONTINUATION OF CONSIDERATION OF ECONOMIc STUDY OF PROPERTY LOCATED SOUTH OF CERRITOS AVENUE: The City Manager presented a report dated December 10, 1970, which stated that the City Council at its regular meeting of NOvember 23, 1970, requested the CityManager to prepare a report regarding the feasibility of conducting an overall economic analysis for the future development of all vacant properties located south of Cerritos Avenue in the City of Cypress. The report indicated that in the near future, both the Planning Commission and City Council will conduct hearings relative to the adoption of a revised Land Use Element of the City's General Plan, which will involve a consideration of the ultimate development of the subject area. The report further indicated that the City Manager has also been advised that a combination of consulting firms, including Economic Research Associates, have been employed by the Harvey family to evaluate the potential development of all of the properties currently owned by the Harvey interests, and that representatives from Economic Research Associates have advised the City Manager that the City will be provided with the results of this economic and land use study upon its completion. The report continued, that since the properties owned by the Harvey family are under study, it is quite unlikely that any development wall take place upon the property until the completion of the studies; therefore, it would not appear urgent at this time to make any final decision regarding the ultimate zoning of the property located between this residential development and the Southern Pacific Railroad tracks. ic was moved by Councilman Roberrs and seconded by Councilman Kanode to receive and file this report. In answer to an inquiry from Councilman Harvey, Mayor Kanel indicated that he had been in contact with the Mayor of Los Alamitos, and that it was his understanding that the City of Los Alamitos is not pleased with the Navy's proposed plans for the Los Alamitos Naval Air Station facility, and that it would take from seven to ten years to implement the plans. At the suggestion of Councilman Harvey, the City Manager indicated that he would direct a comnunication to Congressman Hanna's Office requesting that the City continue to be informed regarding this matter. Councilman Harvey stated that the City was at a very critical point in its development in terms of potential income, and the southern part of the City is going to have a large determination on the future of the City of Cypress relative to its tax base. He further stated that the City should make every effort to obtain any studies or conununications from our elected officials regarding this matter. Discussion was held with regard to the ultimate use of the Los Alamitos Naval Air Station property, whereas Councilman Harvey indicated that he felt a regional park would not be developed on the site, and then stated that the City of Cypress should concern itself with a regional shopping center. 3 Council Minutes December Z1, 1970 Following discussion, the motion was unanimously carried by the following roll call Vote; AYES: NOES: ABSENT: 5 COUNCILMEN: 0 COUNCILMEN: 0 COUNCILMEN: Harvey, Kanode, Lacayo, Roberrs and Kanel None none CONTINUATION OF CONSIDERATION OF SUPPORT FOR THE ESTABLISRMENT OFTHEORANGE COUNTY HUMAN ELATIONS CO}e4ISSlON: The City Manager stated th'at' t~'e' di'~y' Council had placed this matter on the agenda for consideration at its meeting of December 14, 1970, and that the matter had been continued from that meeting dme to the length of uhe meeting° Mayo~ Fanel then reviewed the status of the establishment of the Orange County Muman Relations Coxmmtsslon, stating that it is a very controversial item among the cities, and that many cities will be in opposition to its establishment when the matter comes before the Executive Board of the Orange County League of California Cities in January, 1971o Councilman Roberrs indicated that he felt there are people in Orange County who need help, and that this responsibility should be with the local level of government. It was maved by Councilnmn Roberrs and seconded by Councilmen Lacayo that the Mayor represent the City in strong support of the Orange County Human Relations Commission. Councilteas Kenode indicated that he was somewhat reluctant to vote on this matter as ha had nat had an opportunity to review any information on the subject. I~ was moved by Councilman Kenode and seconded by Councilman Roberrs to table this matter to the next regular meeting of the City Council, scheduled for December 28, 1970~ The motion was unanimously carried by the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Harvey, Kenode, Lacayo, Roberrs and Kanel None None CONSIDERATION OF REMARKS RELATIVE TO THE PROPOSED JET AIRCRAFf AIRPORT AT CAMP PENDLETON MARIE BASE: Councilman Harvey referred to '~rk~ 'm~d~ ~ '~nator Dennis Carpenter and which appeared in several newspapers, regarding the establishment of a Jet aircraft airport at the Camp Pendleton Marine Base, to which Councilman Harvey expressed agreement~ Councilma~ Harvey stated that he was not, however, in agreement with Senator Carpenter's remarks relative to the establishment of a general aviation airport at the Los Alamitos Naval Air Stationll Councilman Harvey suggested that the City Council direct a communication to Senator Carpenter agreeing with his thoughts relative to the location of a Jet airport; however, objecting to his remarks relative to the Los Aiamitos Naval Air Station ~ Councilman Harvey indicated that if the Mary was concerned with changing the direction of its take-off pattern, as a result of conflicts with the landing pattern at the Long Beach Airport, it would seem to him to be inconsistent to continue the use of the facility for aircraft of any type. Mayor Kanel then read an article containing conEnents made by Senator Carpenter to the effect that a portion of the existing runways at the Los Alamitos Naval Air Station should be used for light aircraft. It was moved by Councilmen Harvey, seconded by Councilmal Kenode and unanimously carried to direct a communication to State Senator Dennis Carpenter relative to his remarks concurring with the recommendation of the establishment of a Jet airport located at Camp Pend&eton Marine Base, and opposing his statements recommending the use of the Los Alamitos Naval Air Station facility as a general aviation airport ~ -4- City Couacil Minutes December 21, 1970' EXECUTIVE SESSION: It was moved by Mayor Kanel, seconded by Councilman Roberrs and ananimously carried to go into an Executive Session at 9:08 p.m. for the purpose of discussing a matter of personnel. The meting was called back to order at 11:44 p.m., with all Councilmen present.
