HomeMy WebLinkAboutMinutes 71-05-24MINUTES OF A REGULARMEETING OF THE CYPRESS CITY COUNCIL HELD May 24, 1971 The regular meeting of the Cypress City Council was called to order at 4:12 p,m., on Monday, May 24, 1971, in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor Robert Harvey presiding. PRESENT: Councilmen Kanel, Roberrs and Harvey ABSENT: Councilmen Kanode and Lacayo Also present were City Manager/City Clerk Dartell Essex, City Attorney James E. Erickson and the following members of the City Staff: Dunlap, Grissom, Poetthat and Nudson. MINUTES: It was moved by Councilman Roberrs, seconded by Councilman Kanel and unanimously carried to consider the Minutes of May 10, 1971 at the adjourned meeting of the City Council scheduled for June 7, 1971. It was moved by Councilman Roberrs, seconded by Councilman Kanel and unanimously carried to consider Item No. 15 on the agenda at this time. It was moved by Councilman Kanel, seconded by Councilman Roberrs and unanimously carried to continue the consideration of Item No. 15 on the agenda to the next regular meeting of the City Council scheduled to be held on June 14, 1971. The City Manager stated that the Police Chief had requested a continuance of Item No. 8 on the agenda. It was moved by Councilman Kanel, seconded by Councilman Roberrs and unanimously carried to place the consideration of Items No. 8 and 9 on the agenda at this time. It was moved by Councilman Fanel, seconded by Councilman Roberrs and unanimously carried to continue the consideration of Items No. 8 and 9 on the agenda to the next regular meeting of the City Council. At the request of the City Manager, it was moved by Councilman Fanel, seconded by Councilman Roberrs and unanimously carried to place the consideration of a claim which was submitted by F. Gordon Chytraus, Attorney representing Frank D'Orsi and Patricia Salazar for an alleged accident which occurred. on February 27, 1971, on the agenda at this time. It was moved by Councilman Kanel, seconded by Councilman Roberrs and unanimously carried to deny the subject claim, and to refer the matter to the City's insurance carrier for the appropriate disposition. E)~CFfIVE SESSION: It was moved by Councilman Roberrs, seconded by Councilman Kanel and unanimously carried to go into an Executive Session at 4:15 p.m., to discuss a matter of personnel. The meeting was called back to order at 5:59 p.m., with the following Councilman present: PRESENT: Councilmen Kanel, Roberrs and Harvey ABSENT: Councilmen Kanode and Lacayo RECESS: It was moved by Councilman Kanel, seconded by Councilman Roberts and unanimously carried to recess at 6:00 p.m. to 7:30 p.m. City Council Minutes May 24, 1971 CALL TO ORDER: The meeting was called back to order at 7:40 p.m., in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor Robert Harvey presiding. PRESENT: Councilmen Kanel, Lacayo, Roberrs and Harvey ABSENT: Councilman Kenode Also present were City Manager/City Clerk Dartell Essex, City Attorney James E. trickson, and the following members of the City Staff: Dunlap, Schatzeder, Hernandez, Savord, Grissom and Nudson. PLEDGE q~ .ALLEGIANCE: At the request of Mayor Harvey, Councilman Roberrs led the City Council and audience in the Pledge of Allegiance. The City Manager then reviewed the various actions which the City Council had taken during the afternoon session. At this time, Mayor Harvey requested the newly appointed Recreation and Park Commissioners to step forward, and after introducing each member, administered the Oath of Office. ORAL CODDIUNICATIONB: ~, Robert Newberry, 5043 Evergreen Avenue, Cypress, addressed the City Council expressing concern over the fact that adequate screening has not been installed over the windows of the Tara Hill Apartment recreation building, which results in an invasion of privacy to the adjacent R-1 residents, as their homes and yards are easily viewed by those utilizing the apartment recreation building. FAr. Newberry indicated that the developers had agreed to use an opaque substance as a screening device. In response to an inquiry from Councilman Lacayo, the City Attorney advised that this matter was not the subject of any treatment in the Conditional Use Permit itself, and that there are two things which can now be done to resolve this matter; the first being to request the developer to include opaque substances or whatever is necessary, and the other would be to begin a proceeding to modify the Conditional Use Permit to require the installation of the appropriate window treatment. It was moved by Councilman Kanel, seconded by Councilman Lacayo and unanimously carried to place this matter on the agenda for consideration at this time, Councilman Lacayo moved to place this matter on the agenda for the next regular meeting of the City Council, and to direct the City Manager to meet with the concerned homeowners residing adjacent to the Tara Hill apartments, and to submit to the City Council at its next regular meeting, various proposals as to effective methods of screening the windows of the recreation building. At the request of Councilmen Roberts, Councilman Lacayo withdrew his motion. It was then moved by Councilman Kanel and seconded by Mayor Harvey that the City Manager and the City Attorney direct a communication to the developers of the Tara Hill Apartment complex, requesting that the windows of the recreation building be fully screened within a three week period of time, with the under- standing that if this is not accomplished, proceedings will be initiated to modify the Conditional Use Permit. Coumcilman Lacayo stated that the adjacent property owners should be informed as to what is being done relative to this matter, The motion was unanimously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Kanel, Lacayo, Robarts and Harvey None Kenode -2 - City Council Minutes May 24, 1971 CONSENT CALENDAR: The Mayor announced that all matters listed on the agenda un'a'er' "C'dN'S'~NT' CALENDAR" were to be considered by the Council as routine and enacted by one motion approving the Recommendation on the Administrative Report concerning the matter. It was moved by Councilman Roberrs, seconded by Councilman Kanel and unanimously carried to approve Item No. 1 on the Consent Calendar. Item noo 1: Consideration of receipt of Orange County Mosquito Abatement District Minutes of the April 15, 1971 meeting. Recommendation: Receive and file. PUBLIC HEARING RE: CONSIDERATION OF CONDITIONAL USE PERMIT NO..C-2~6,LARMIN MULTIHOUSING CORPORAT.ION: The Mayor an~0unCed ¥h~s was the time and place for the Public Hearing to consider an application for a Conditional Use Permit which would allow the construction of an apartment complex on property generally located 110' west of Grindlay Street, north of Lincoln Avenue, Cypress, initiated by Larwin Multihousing Corporation. The Mayor declared the Public Hearing open, Because it was felt that all Councilman should be present when this matter is discussed, it was moved by Councilman Roberrs and seconded by Councilman Lacayo to continue the Public Hearing to the next regular meeting of the City Council, In response to an inquiry from Councilman Harvey, the City Attorney advised that unless the applicant consents to a continuance, 40 days after the initial Public Hearing, he would have the opportunity to deem his application denied. Mr. John Tapking, representing the Larwin Multihousing Corporation, addressed the City Council stating that he would favor continuing the Public Hearing on this matter to a date certain as determined by the City Council, The motion was unanimously carried by the following roll call vote: AYES: NOES: ABSENT: 4 COUNCILMEN: 0 COUNCILMEN: 1 COUNCILMEN: Kanel, Lacayo, Roberrs and Harvey None Kanode Councilman Lacayo then opened a discussion regarding the information which was provided to the Council on the Staff Reports regarding the applications for the three Conditional Use Permits which appeared on the agenda for this evening's meeting, outlining what he believed to be several inconsistencies in comparing the reports. Both Councilman Lacayo and Councilman ~aberts indicated that there should be a uniform manner in expressing the conditions which have been placed on a Conditional Use Permit, The City Manager indicated that the conditions are not standardized in any form by the Staff, and also represent the recommendations of the Planning Commission He added, that there are conditions which are listed on the reports which are required under the provisions of the existing City Code, and are repeated on the reports to emphasize the requirements. Mayor Harvey stated that he felt that there would be a considerable amount of confusion if comparisons were to be made between various Conditional Use Permits, because the characteristics of one development are not necessarily going to be identical to that of another, He further indicated that he personally has found the Staff Reports to be complete, and added, that he felt that if additional information appears to be lacking, it would behoove the Councilman to contact the City Manager's office in an attempt to find the answer to his question, Councilman Kanel agreed with Councilman Harvey's statement, -3- City Cotmcil Minutes May 24, 1971 Councilman Roberrs then indicated that he would like to have those conditions which are required under the provisions of the City Code clearly delineated so as to avoid any changes which the Planning Commission or City Council might be tempted to make. The City Attorney advised that a problem would not be created from a legal standpoint, as the provisions in the City Code would prevail. The City Manager then suggested that the Staff could place an asterick next to each condition which is a Code requirement, thus identifying it. PUBLIC HEARING RE: CONDITIONAL .U~E .P~R~.~ .~q: ..q-25!-TCREA~IVE ENVIRONMENT, INC: The Mayor declared this was the time and place for the Public Hearing to consider an application for a Conditional Use Permit which would allow the construction of a 130-unit apartment complex on property generally located on the east side of Bloomfield, approximately 500' south of the centerline of Lincoln Avenue, Cypress, initiated by Creative Environment, Inc, The Mayor declared the Public Hearing open, Councilman Lacayo expressed a desire to have an explanation as to how the requirements for parking spaces at the proposed apartments are derived, and then stated that he felt that the entire City Council should be present for determinations regarding major developments within the City. It was moved by Councilman Lacayo and seconded by Councilman Roberrs to continue the Public Hearing on this matter to the next regular meeting of the City Council scheduled to be held on June 14, 1971, The motion was unanimously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Kanel, Lacayo, Roberrs and Harvey None Kanode PUBLIC HEARING RE: CONSIDERATION OF .CQ~O~.ALUSE PERMIT C-2~2T-~ARWIN.MULTI- HOUSING CORPORATION: The Mayor announced this was the time and place for the Public Hearing to consider an application for a Conditional Use Permit which would allow a reduction of the 100' setback for 2 and 2~ story buildings adjacent to R-1 zones on portions of the property located on the north side of Lincoln Avenue, 100' west of Grindlay Street, Cypress, initiated by Larwin Multihousing Corporation, The Mayor declared the Public Hearing open. It was moved by Councilman Roberrs and seconded by Councilman Lacayo to continue the Public Hearing on this matter to the next regular meeting of the City Council. Councilman Lacayo stated that the Staff Report on this matter should include a reason as to why the applicant has requested a reduction of the setback require- mont. The Mayor declared the Public Hearing open. It was moved by Councilman Lacayo and seconded by Councilman Roberts to continue the consideration of this matter to the next regular meeting of the City Council. The motion was unanimously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Kanel, Lacayo, Roberrs and Harvey None Kenode - 4- City Council Minutes May 24, 1971 PUBLIC HEARING EEl:' CONSIDERATION OF ADQPT~ION OF .UNIFORM BUILDING CODES: The Mayor announced this was the time and place for the Public Hearing to consider the adoption of the Uniform Building Codes for the City of Cypress. The Mayor declared the Public Hearing open, and requested the Staff to present its report. The City Manager presented a report dated May 19, 1971, which indicated that the City Council, at its regular meeting held April 26, 1971, adopted the first reading and scheduled a Public Hearing for 8:00 p.m., on Monday, May 24, 1971, to consider the adoption of the Uniform Building Codes for the City of Cypress. The report advised that the affidavits of publication and posting of the Public Hearing notice are on file in the office of the City Clerk, and no co~munications have been received in reference to this matter. The report further advised that three certified copies of each of these codes have been on file in the office of the City Clerk and open for inspection. When asked if anyone in the audience wished to speak in favor of or in opposition to the adoption of the Uniform Building Codes, Mr. Jess Black, Anaheim, California addressed the City Council requesting an explanation of the Uniform Building Codes. The City Attorney then indicated that it consists of six volumes containing several hundred pages of technical requirements which are proposed periodically by the International Congress of Building Officials, throughout the Country. He commented that these codes are used by almost every city in the State of California, and that the codes are updated periodically, usually within a period of three years. In response to an inquiry from Countlima1 Roberrs, the Building Superintendent indicated that the City of Cypress is reviewing a number of noise abatement codes from other cities, and that probably within the next three or four months, the City will have a code relative to noise abatement to bring before the City Council, which will be more practical and enforceable than the provisions set forth under the City's Zoning Ordinance. In response to an inquiry from Councilman Roberrs regarding the procedure for adopting these Ordinances, the City Attorney explained that adopting a code by reference requires three actions as opposed to two for the adoption of a regular Ordinance o He indicated that the first reading preceeds what is normally considered to be the first reading, and that this evening's reading would be considered the first reading; which, if approved, would then require the second reading, or adoption of the Ordinances, which may be done anytime after five days following =he first reading of the Ordinance. Following discussion, it was moved by Councilman Roberrs, seconded by Councilman Lacayo and unanimously carried to close the Public Hearing at this time. The motion was unanimously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Kanel, Lacayo, Roberrs end Harvey None Kanode RECESS: Mayor Harvey declared a recess at 9:07 p.m. The meeting was called back to order at 9:15 p.m., with the following Councilmen present: PRESENT: Councilmen Kanel, Roberrs and Harvey ABSENT: Councilmen Kenode and Lacayo CONTINUATION OF CONSIDEKATIUN OF .~Q~S~.PROBLEMS A% .%ARA HILL APARTMENT COMPLEX: The City Manager presented a report dated April 21, 1971, which outlined portions of the city's Zoning Ordinance pertaining to noise and possible courses of action relative to the matter. COUNCILMAN LACAYO ARRIVED AT 9:17 P .M, , AND TOOK HIS PLACE ON THE PODIUMo At the request of Mayor Harvey, the City Manager outlined the procedures whereby a Conditional Use Permit may be revoked or modified, stating that in either case, it must follow the normal course of the granting of the original Conditional Use Permit, in that it must come before the Planning Commission and City Council for Public Hearings. In answer to an inquiry from Councilmml Kanel, the Police Chief described the three occasions on which the Police Department had responded to complaints regarding loud music emanatiBg from the recreation center at the Tara Hill Apartment complex. He stated that the persons who were engaged in participating or sponsoring the party were involved in a recreational activity, and were not in technical violation of the law of disturbing the peace in that they had no willful or malicious intent to vex, injure or annoy the enjoyment of anyone else's property, as the statute requires° He indicated that it would be very impractical to impose the penal law on a group attending a Saturday night party until midnight, because it is not considered unusual conduct. In response to an inquiry from Councilman Kanel, Mr. Newberry, who had earlier addressed the City Council, Stated that the noise resulting from the parties at the Tara Hill Apartment recreation room has been very extreme. In answer to a question from Councilman Kanel, the Building Superintendent indicated that in his opinion, soundproof draperies would be more satisfactory than installing sound baffling in the building. Councilman Roberrs indicated that he felt that it was the responsibility of the City Council to take some direct action in either preventing this type of situation from occurring, or, to create circumstances which would allow -6- City Council Minutes May Z4, 1971 persons to enjoy that mode of entertainment without the encroachment on the rights of the neighboring citizens. Councilman Roberrs stated that it is hie personal opinion that the recreation building at the apart- ment complex is in violation of the City Code, aua..tha=_hacause. o.f. ita unique structure causes a substantially greater problem to the community than it would have had it been a one story structure. He further stated that he believed that the City Comlcil has within its power, the opportunity.of requiring the Larwin Company to soundproof the building, or to cunderan the building and have it reduced to one story. The City Attorney then advised that the principle courses of action which are available to the City Council relative to this problem are those in the civil area. stated that there is the possibility of the City initiating an action to abate a public nuisance and to secure an injunction against it, or to adopt a noise regulation Ordinance, or to proceed with a modification of the Conditional Use Permit, in which instance the City Council could require modifications to the building in order to minimize the problem. Following discussion, it was moved by Councilman Kanel andt seconded by Mayor Harvey that the Larwin Company be notified that they will be given three weeks in which to adequately soundproof the recreation building at the Tara Hill Apartment complex, and that in the event this is not accomplished, proceed- in~s will be initiated to modify the Conditional Use Permit. The motion was unanimously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Kanel, Lacayo, Roberrs and Harvey None Kenode In answer to a statement from Councilman Roberrs, the City Manager indicated that the City has received three proposals from qualified accoustical firms to conduct a study relative to the City's noise standards, and that hopefully, this matter will be before the City Council in approximately one month. CONTINUATION OF CONSIDERATION OF REQUEST OF SUPPORT FOR ASSEMB~YMAN BUEKE'S OP~OSITIUN TO ASSEMBLY BILL 437: The City Manager indicated that the couacil has been provided with copies of this particular bill, as requested. Comcilman Kanel moved that the City support Senator Burke's Resolution in opposition to Assembly Bill 437, and the Resolution from the City of Costa Mesa supporting Senator Burkews opposition to the subject bill, Mayor Harvey seconded Councilmml Kanel's motion for the purpose of discussion, In response to an inquiry from Coumcilman Roberrs, the City Attorney stated that AB 437 is not a part of the overall package reform which has been proposed and is being pursued. He stated that it is a separate piece of legislation; however, that it does adhere to many of the recommendations which were made by the Criminal Justice Committee. CouD. cilman Roberrs indicated that he would not personally agree with the motion~ At the request of Com~cilman Kanel, Mayor Harvey read in full, the Costa Mesa Resolution. Following further discussion regarding Assembly Bill 437, the City Attorney indicated that while the City Council is free to take whatever action it might wish on this type of subject, it really would not be considered a municipal matter. It was moved by Councilman Roberrs and seconded by Councilmam Lacayo to table the motion. He 7 City Council Minutes May 24, 1971 Mayor Harvey stated that he was in sympathy with Assemblyman Burke's position; however, personally felt that this matter is outside of the City Council's realm of responsibility, and would be reluctant as a City Coancilman to go on record in favor of a Resolution of this nature. The motion to table Councilman Kanel's motion carried by the following roll call vote: AYES: 3 COUNCILMEN: Lacayo, Rob errs and Harvey NOES: 1 COUNCILMEN: Kanel AB SENT: 1 COUNCILMEN: Kenode CONTINUATION OF CONSIDEP~A~ON .0.F ..RESOLU~ION .I~ ~UPPQR%pF ASSM~Y .B~L~ 813: The City Manager indicated that as requested at the last meeting of the City Comlcil, a Resolution in support of Assembly Bill 813 has been prepared for City Council consideration. In response to an inquiry from Mayor Harvey, the City Attorney outlined the content of AB 813, stating that it attempts to restructure the annexation statutes which have not been revised in a comprehensive fashion for over fifty years. It was moved by Com~cilman Kanel and seconded by Councilma~ Roberrs to adopt the following Resolution by title only, title as follows: RESOLUTION NOo 1172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SUPPORTING THE ADOPTION OF AoB. 813 KNOWN AS THE UNIFORM CITY ANNEXATION ACT. ION. OF REQUEST FQ~ _qQI~4ENTS _q~ THE ORANGE_COUNTY DRUG STUDY TEAM REPORT: The City Manager indicated that the City Council was provided with information relative to this matter along with their Progress Report, and stated that an official report would be forthcoming at the next regular meeting of the City Council. It was moved by Councilman Kanel, seconded by Councilman Roberrs and unanimously carried to continue the consideration of this matter to the next regular meeting of the City Council scheduled to be held on June 14, 1971. CONSIDERAIION OF ACCEPTANCE OF IMPROVEMENTS AND RELEASE OF BONDS ON TRACT #4137: The City Manager presented a ~e~&~ "dated May'f~, i971, from the Public Works Director which indicated that the public improvements in Tract #4137, which is located 856 feet south of Ball Road and 645 feet west of Valley View Street, have been satisfactorily completed in accordance with plans and specifications, including completion of minor repairs to defective concrete and aspbaltic pavement~ It was moved by Councilmen Roberrs and seconded by Councilman Kanel to accept the public improvements in Tract #4137 as being satisfactorily completed in accordance with the plans and specifications and to authorize the City Clerk to release the Monumentation Bond and the Labor and Material Bond upon expiration of their required lien period providing no mechanics liens are filed, with the Performance Bond to be held for one year from the date of acceptance to guarantee against any defect s in material or work~ship and subject to the completion of the following condition: The developer shall pay optional design fees. -8- City CoLmcil Minutes May 24, 1971 The mntion was unanimously carried by the following roll call vote: AYES: 4 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 1 COUNCILMEN: Kanel, Lacayo, Roberts and Harvey None Kanode CONSIDERATION OF ADOPTION OF RESOLUTION_AI~Q~_ING~TH~ CITy OF CYPRESS .TO UTILIZE THE ORANGE COUNTY PURCHASING AGENT: The City Manager presented a report dated May 19, 1971, which indicated that Resolution No, 783 which allows the City to utilize the Orange County Purchasing Agent for the purchase of certain supplies and materials will expire on June 30, 1971; and that in order to renew this cooperative purchasing program, a Resolution must be adopted by the City Council. The City Manager stated that both he and the Police Chief have made arrangements to meet in Sacramento on the 25th of May, with the staff members of the California Council on Criminal Justice to review this project in detail~ He stated that the project will be brought before the City Council for its review prior to its submittal to the Council on Criminal Justice for its meeting on June 11, 1971. At the request of Mayor Harvey, it was moved by Councilman Kanel, seconded by Councilman Roberrs and onanimously carried to place on the agenda for consideration at this time, a Community Service Plaque in recognition of Miss Linda Larkins' service to the community as Miss Cypress of 1970. It was moved by Councilman Kanel, seconded by Councilman Roberrs and unanimously carried to award a Community Service Plaque to Miss Linda Larkins, Miss Cypress of 1970. The City Manager stated that there was an increase of cost for the total weed abatement program, and would therefore request that the City Council consider appropriating $42,108.92 from the General Fund to the 1971 weed abatement program. He explained that these funds are reimburseable to the City from the weed assessments. He further stated that some of the larger increases were due to the rubbish removal at the Juanits and Ball Road properties, and that there were other areas which contained more debris than had been estimated. In response to a question from Councilman Roberrs, the City Manager indicated that the City will pay 50% of the amount at the present time, 25% in December and 25% in the month of April 1972.
