HomeMy WebLinkAboutMinutes 71-06-07MINUTES OF AN ADJOURNED REGULARMEETING OF THE CYPRESS CITY COUNCIL HELD June 7, 1971 The adjourned regular meeting of the Cypress City Council was called to order at 3:15 p.m., on Monday, June 7, 1971. in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor Robert Harvey presiding. PRESENT: Councilmen Kanel, Roberrs and Harvey ABSENT: Councilmen Kanode and Lacayo Also present were City Manager/City Clerk Darzell Essex, City Attorney James E. Erickson and Secretary to the Planning Commission, Eli Hernandez, The adjourned regular meeting of the Planning Commission was called to order at 3:16 p.m., on Monday, June 7, 1911, in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Chairman Evans presiding. PRESENT: Commissioners Ricker, Sonju, Warren and Evans ABSENT: Commissioner Cardoze The Chairman of the Planning Commission announced that the Commission would defer to councilmanic procedures at this Lime. ADJOURNMENT: It was moved by Councilman Kanel, seconded by Councilman Roberrs and unanimously carried to ad3 ourn to the Administrative Conference Room at 3:17 p.m. It was moved by Commissioner SonJu, seconded by Conunissioner Warren and unanimously carried to adjourn the meeting o~ the Planning Commission to the Administrative Conference Room at 3:18 p~m~ CALL TO ORDER: The meeting of the City Council was called back to order at 3:20 p~m., in the Administrative Conference Room, 5275 Orange Avenue, Cypress, California, Mayor Robert Harvey presiding. PRESENT: Councilmen Kanel, Roberrs and Harvey ABSENT: Councilmen Kenode and Lacayo Also present were the City Manager/City Clerk Darzell Essex, City Attorney James E. Erickson and the Secretary to the Planning Commission, Eli Hertender, The meeting of the Cypress Planning Conunlssion was called to order at 3:21 pom., in the Administrative Conference Room, 5275 Orange Avenue, Cypress, California, Chairman Evans presiding. PRESENT: Commissioners Ricker, Sonju, Warren and Evans ABSENT: Commissioner Cardoze The City Manager indicated that the purpose of the Joint meeting between the City Council and the Planning Commission was to discuss the proposed amendments to the Zoning Ordinance. The Secretary to the Planning Commission stated that the proposed amendments, which relate to multiple-family development within the City, were the result of considerable study by the Planning Commtssion~ He then reviewed the proposed amendments in detail~ Various aspects of multiple-family development were considered, including density, open space, setback requirements and parking spaces. The Secretary indicated that it was the general feeling of the Commission that the R-4 zone should be abolished and that a new high-density zone, which would include provisions for high-rise development, be established in its place. City Council Minutes June 2, 1971 CO~ISSIONER CARDOZA ARRIVED AT 3:30 P~M~ COUNCILMAN LACAYO ARRIVED AT 3:37 P.M0 COUNCILMAN KANODE ARRIVED AT 4:00 P~Mo Following the presentation by the Secretary, a discussion period ensued whereby each Councilman expressed his viewpoints. While it was the general feeling of the City Council that they were in accordance with the proposed amendments, concern was expresseL that the amendments might be too restrictive and could substantially affect the development of multiple-units within the City. Mayor Harvey suggested the possibility of contacting a loan officer from a bank for the purpose of obtaining unbiased information as to whether or not the proposed ordinance would be too restrictive thereby making it noneconomical for a developer to build in the City. Discussion ensued with regard as to whether or not the final decision approving or denying a particular development should be made by the Planning Commission or whether it should be determined by the City Council, and as to the methods whereby a decision can be appealed, Councilman Leeaye indicated that he would prefer to continue in the same manner as the City has under the provisions set forth in the Urgency Ordinance, wherebye Conditional-Use Permit is granted or denied by the Comnmission and then automatically comes before the City Council for the final determination, Councilman Roberrs stated that he would personally be agreeable to having the final action taken by the Planning Commission; however, felt that there should be a provision seating that the decision could be appealed by any Councils, Mayer Harvey indicated tha~ he felt the Planning Commission should make final determinations which ate within their realm of responsibility with =he right of appeal t~ the City Council as currently provided for in the City Code, to which Councilman Kenode and Councilman Kanel expressed their agreement, It was moved by Councilman Roberrs and seconded by Councilman Lacayo to adopt a Minute Order to the effect that the Cl~y Council is in principle, in favor of the proposed amendments relating to the R-3 Zone as defined; wlth the exception, however, that in the preparation of an Ordinance adopting the amendments, a clause will be provided which will allow any Councilman the right to appeal any decision by the Planning Commission. COMMISSIONER KICKER LEFT THE MEETING A~ 6:00 Following considerable discussion relative to the motion, it was moved by Councilman Kanel and seconded by Councilman Kanode to table Councilman Robert's motion to the next regular meeting of the City Council scheduled to be held on June 14, 1971. The motion carried by the following roll call vote: AYES: 3 COUNCILMEN: NOES: 2 COUNCILMEN: ABSENT: 0 COUNCILMEN: Kanel, Kanode and Harvey Lacayo and Roberrs None In response to an inquiry from Councilman Rober~s, the City Attorney advised that Planning Commission decisions are presently subject to appeal by either the applicant, the City Council by its own metion, or by interested parties. In order to clarify his previous motion as it contained two parts, it was moved by Councilma~ Roberrs and seconded by Councilman Lacayo that the final Zoning Ordinance will contain a clause which will allow any Councilman the right to appeal any decision by the Planning Commission, The motion failed to carry by the following roll call vote: AYES: 2 COUNCILMEN: NOES: 3 COUNCILMEN: ABSENT: 0 COUNCILMEN: Lacayo and Roberrs Kanel, Kanode and Harvey None -2 - City Coumcil Minutes June 7, 1971 At this =iuB, the Secretary of the Planning Commission introduced Mr. Ralph White, newly employed Planning Technician, to the members of the City Council mid the Plsnning Commission.
