The adjourned regular meeting of the Cypress City Council was called to order at
4:10 p.m., on Monday, June 21, 1971, in the City Council Chambers, 5275 Orange
Avenue, Cypress, California, Mayor Robert Harvey presiding.
PRESENT: Councilmen Kate1, Roberrs and Harvey
ABSENT: Councilman Kenode and Lacayo
Also present were City Manager/City Clark Dartell Essex and the Building
Superintendent, Tom Nudeon.
ADJOURNMENT:
It was moved by Councilman Kanel, seconded by Councilm~n Robarts and unanimously
carried to adjourn at 4:11 p.m. to the Administrative Conference Room.
CALL TO ORDER:
The meatinE was called back to order at 4:15 p.m., in the Administrative
Conference Room, 5275 Orange Avenue, Cypress, California, Mayor Robert Harvey
presiding.

Also present were City Manager/City Clerk Darts11 Essex and the following
members of the City Staff: Dunlap and Grissom.
The City Manager indicated that the purpose of the afternoon meeting of the
City Council was to finalize the review of the Recreation and Park District
budget.

COIIqCILMAN LACAYO ARRIVED AT 7:32 P.M., AND TOOK HIS PLACE ON THE PODIUM,

Mr. Gene Schroeder, 9080 Bloomfield Street, Cypress, addressed the City Council
stating that he was representing the owner of the Lincoln Center Mobile Homo Park.
Mr. Schroeder indicated that the landscaping around the park has been partially
destroyed due to persons riding horseback in the vicinity of the trailer park.
In response to an inquiry from Mayor Harvey, the City Manager indicated that the
City had previously transmitted conrnonications to surrounding stables relative
to the problem of horseback riding on public streets. The Police Chief then
stated that the City's Ordinance prohibits the riding of animals on public
sidewalks; however, it is allowed on City Streets. He further indicated that
last week, a notice was forwarded to all police officers alerting them to watch
for those riding on the sidewalks, and then suggested chat in addition, perhaps
it would be helpful to post the area warning the riders chat they were on private
property where riding is not allowed. The Police Chief advised that authority is
limited in this area, however.
Councilman Lacayo suggested that an article pertaining to this matter be placed
in the City's newsletter.
Miss Randi Firus, Junior Leader of the Calicoettes, introduced to the City Council
Miss Teresa Bleick and Miss Thatass Dixon, also mombers of the Calicoettes. Miss
Firus then read a communication dated June 21, 1971, requesting on behalf of the
Cypress mombers of the CalicoaCres, that the City Council consider providing the group
with an official City of Cypress flag which their organization could carry in the
many ~aradesand competitions in which they participate.
Mayor Harvey then displayed the winning design which was selected by the City Council
at the conclusion of the City's flag design contest.
It was moved by Councilman Kanel, seconded by Councilman Kanodeand unanimously
carried to place this item on the aSsnda for consideration at this timo.
It was moved by Councilman Kanel and seconded by Councilman Kenode that the City
provide the Calicoacres with an official City flag, including a standard and a
holster.
Councilman Robarts then moved to amond the motion to state that the cost of the
flag should be limited to $100.00.
Discussion ensued with regard to what the cost of the flag might be to the City,
and it was the general opinion of the City Council that the City Manager
would investigate the cost of having several official City flags made, and report
back to the City Council at its next mooring, scheduled to be held on June 28, 1971.
Coucilman Robarts then withdrew his motion to amond the main motion, and suggested
that the City Manager investigate the possiblity of a momber or mombers of the
Cypress Cultural Arts Association who might wish to make a City flag.
The motion was unanimously carried by the following roll call vote:

CONTINUATION OF PUBLIC HEARING RE: CONDITIONAL USE PERMIT C-251: The Mayor
announced this was the timo and place for the Pdb~ic '~earing to consider a request
for a Conditional Use Permit which would allow the construction of a 130 unit
apartmont complex on property ~enerally located on the east side of Bloomfield ~reet,
appromimotely 500' south of the centerline of Lincoln Avenue, Cypress, initiated by
Creative Environmont, Inc.

The Mayor announced that the Public Hearing was open, and requested the Staff to
present its reports.
The City Manager presented a report dated June 9, 1971, which indicated that the
affidavit of posting of the notice of continuation of the Public Hearing is on
file in the office of the City Clerk, and no communications have been received
regarding this matter.
The Secretary to the Planning Commission displayed a transparency portraying the
subject property and surrounding areas; following which, a rendering of the proposed
development was emhibited.
A~ the invitation of Mayor Harvey, Mr. Leroy Rose, architect for the project, addressed
the City Council representing the developer. Mr. Rose indicated that the windows
of the development which face the mobile home park will be screened by louvers,
thereby eliminating the view into the park. He stated that the elevations to the
south would not be screened as the development will be over 100' from the
R-1 residences. Mr. Rose then discussed several of the conditions which had
been imposed by the Planning Commission,
In response to an inquiry from Mayor Harvey regarding three sets of plans which the
applicant submitted to the City Council at its meeting of June 14, 1971, Mr. Rose
stated that it was the preference of the developer that the City Council accept
either plans 1-B or 1-C,
At the request of Mr. Dean Rawley, 4057 Cheshire Drive, Cypress, the applicant
provided a set of plans of the proposed development to those citizens in the
audience who reside in the vicinity of the subject development,
RECESS:
Mayor Harvey declared a recess at 8:07 p.m. The meeting was called back to order
at 8:15 p.m., with all Councilmen present.
In response to an inquiry from Mr. Robert Head, 4027 Cheshire Drive, Cypress,
Mr. Rose stated that there would be carports along the entire south wall. Mr.
Head then indicated that the surrounding homeowners would like louvers insta/led
over the windows of the upper story along the south elevation.
A~ the request of Mr. Lee Crockett, 4037 Cheshire Drive, Cypress, Mayor Harvey
read the conditions which had been imposed by the Planning Conmission. Mr. Crockett
then stated that he felt that the two trees, which are in close proximity to Bloom-
field Street, are a hazard and then requested that they be removed.
Mr. Dean Rawlay again addressed the City Council, questioning the type of lighting
which will be provided throughout the project; to which Mr. Rose replied that a
low profile type of lighting will be installed in the planting area, and that
the lights which will be placed in the carports will not be seen by the R-1
residents.
Mr. Arnold Lowenberg, 4028 Cheshire Drive, Cypress, stated that he agreed with
Mr. Crockett in that the two trees which ha had referred to, should be removed. He
then indicated that the applicant had advised the homeowners that approximately
nine trees, which would reach a height of around 40 feet, would be planted in the
parking area.
Mr. Rose addressed the Council stating that he felt that the firm which he is
representing is in agreement with the residents in the surrounding area, and
that the developer will replace the trees as requested by the homeowners.
Discussion ensued regarding the conditions which had been imposed by the Planning
Commission. Mr. Head again addressed the Council requesting the addition of a
condition requiring a dispersed trash area rather than a general pick-up area. He

stated that he would also like a condition requiring an eight foot wall along all
boundaries of the development, excluding the side where there will be carports.
Following discussion regarding various modifications to the conditions as set forth
by the Planning Commission, Councilman Kanel asked those homeowners who had expressed
concern relative to the proposed development, if they were satisfied with the
conditions as modified. Mr. Head indicated that he would like louvers installed
over the windows of the entire south side of the development, which, Mayor Harvey
explained, should not be necessary as there is a substantial difference in the
setback from the R-1 residences to the south, than there is from the east,
In answer to an inquiry from Mayor Harvey, Mr. Rose indicated that the recreation
building which is proposed to be included in the development will be a one story
building.
It was moved by Councilman Lacayo, seconded by Cooncilman Kenode and unanimously
carried to close the Public Hearing at this time.
It was moved by Councilman Lacayo and seconded by Com~cilman Fanode to approve
Conditional Usa Permit No. C-251, subject to the following conditions:
1. Compliance with all applicable conditions of the Cypress City Code.
That the development be constructed in ~aneral accordance with the
officially approved plans, as modified, subject to approval by the
City Staff.
3. That a landscaping plan prepared by a registered landscape architect be
submitted to the Planning Commission for approval.
4. That a permsment automatic water sprinkling system be installed.
5. That all open parking spaces be striped with "double lines."
6. That bumper stops be provided in all parking spaces open or covered
which abut a wall.
7. Construction of the building to be in accordance with FHA sound-proofing
standards.
That the parking areas adjacent to Bloomfield Street be screened from
the street by shrubbery, with a 2-year bond to be posted by the applicant
in an amount sufficient to cover the cost of constructing a 3 ft. wall
along Bloomfield adjacent to the parking area,
That the building not be occupied or a certificate of occupancy granted
until all conditions of approval have been met or until guarantees
satisfactory to the City Staff that such conditions will be met, has been
obtained.
10. That the applicant obtain a variance for reduction of the 15 ft, front
yard setback.
11. Drainage to be solved to the satisfaction of the City Engineer.
12. All drainage fees shall be paid in accordance with the Master Plan of
Drainage.
13. All secondary and primelV utility services shall be underground.
14. Bloomfield Street (42') half street shall be dedicated and fully improved
in accordance with the Master Plan of Streets and Highways.
15. Street structural sections shall be approved by the City Engineer.

16. Street lights shall be installed par City standards,
17. Advance street light energy char~es shall be paid.
Street trees (15 gal.) shall be installed along Bloomfield incanformance
to the street tree policy of the Public Works Department. The type of
trees shall be as required under the Townscape and Urban Design Element
of the General Plan.
19. Plan check and inspection fees in the amount of 3%~ of the street improve-
ments shall be paid.
20. Necessary fire hydrants shall be installed in accordance with Fire Depart-
ment requirements and City standards.
21. All property line wells to be 6 feet in height, to be measured from highest
grade.
That locker storage be provided for each apartment unit within the carport.
That additional architectural treatmnt be 8ivan to the east and south
sides of the proposed development. The south side shall have non-adjustable
louvers on the top story and the east side on both stories. Such treatment
to be approved by the Secretary of the Planning Cov"m4ssion.
24. Gunst parking to be specifically identified as such.
25. Low profile lighting to be used throughout the project.
26. That the project meet with fire zone #2 requirements.
27. Design and color of walls to be approved by the Secretary of the Planning
Commission.
LocatiOn and design of trash area enclosures to be architecturally screened
from street and adjacent areas, to be approved by the Secretary of the
Planning Covnm4ssion.
29. That all parking spaces along the south property line be under cover
with a back well not less than 8 ft. in height.

That 10 tree pockets not less than 3 feet by 3 feet be provided in the
parking area located in the southern portion of the development, Box
trees to be planted within these three pockets--type of tree, size and
location to be approved by the Planning Cormmission. The type of tree most
adapt to the soil.
31. That speed bumps be located in appropriate locations within the driveways
of the development.

Mayor Harvey declared a recess at 9:40 p.m. The meeting was called back to order
at 9:50 p.m., with all Councilmen present.
CONTINUATION OF PUBLIC HEARING RE: CONDITIONAL USE PERMIT C-254: The Mayor
announced this was the time and place for the continuation of the Public Hearing
to consider an application for a Conditional Use Permit which would allow the

construction of a 72 unit apartment complex on property generally located on the
east side of Bloomfield Street, 500' north of Ball Roads initiated by Severa-Gustafson.
The Mayor announced the Public Hearing was open, and requested the Staff to present
its reports.
The City Manager presented a report dated June 9, 1971, which indicated the
affidavit of posting of the notice of continuation of this Public Hearing is on
file in the office of the City Clerk, and no communications have been received
in regard to this matter.
The Secretary to the Planning Commission displayed a transparency which portrayed
the subject property, along with a rendering of the proposed development, He
then reviewed a report dated June 9, 1971, which described the subject property
end adjoining properties. Attached to the report is Resolution No. 529 of the
Planning Co~m4ssion, approving Conditional Use Permit No. C-254 subject to twenty-six
conditions.
Mr. Gerald Con~iardo, architect for the proposed development, addressed the Council
stating that he was representing the SWYS Corporation. Mr, Con~iardo described the
proposed development, and then requested that the City Council consider permitting
the installation of a msnsard roof with wood shakes on the mansaM portion, instead
of a fire-retardent shake shingle roof which had been stipulated by the Planning
Co~m~ salon.
In answer to an inquiry from Councilma~ Roberrs, the applicant indicated that all
of the elevations for the proposed project were front elevations.
In reply to a question from Councilman Lacayo, the Secretary to the. Planning Counnission
stated that in the Planned Development zone there are no setback requirements.
Councilman Kanel expressed concern regarding certain windows of the proposed development
which face the second story windows of the Tanglewood development. The Secretary ~
to the Planning Commission indicated that the Commission, when considering this
matter, did not feel the windows would require special treatment because of the
similarity between the two developments in terms of land usage.
In response to a statement by Councilman Roberrs, the applicant indicated that the
walls of the carports facing the south property line would be completely independent
of the existing masonsty wall.
In answer to an inquiry from Councilman Roberrs, the Building Superintendent
stated that there are shakes and shin~les, which within the last four or five
months, have been approved for fire-retardent class C and D roof structures, end
which may be used in a fire zone 2.
Discussion was held relative to a condition requiring the installation of speed
bumps in the driveway, which, Councilmsm Roberrs felt would be advisable because
of the length and the strai~htness of the driveway. In answer to an inquiry
from Councilman Kanel, the Building Superintendent indicated that he did not
consider speed bumps necessary for the proposed development as the development
is not large enough to warrant then, and also that there would not be a complete
circulation of traffic.
It was moved by Councilman Robarts to add a requirement for the installation of
speed bumps as Condition No. 28 on the Conditional Use Permit. The Deputy City
Attorney advised that the motion could not be made until such time as the Public
Hearing was closed and a main motion on the floor.
Following further review of the conditions which had been imposed by the Planning
Comm{ssion, along with modifications by the City Council, it was moved by
Councilman Kinel, seconded by Councilman Kenode end unanimously carried to close
the Public Hearing at this time.

It was ~oved by Cou~cilman Kenode and seconded by Councilman Kanel to approve
Conditional Use Permit No. C-254 subject to the conditions as modified by the
City Council.
It was moved by Councilman Roberrs and seconded by Comlcilm'n~ Lacayo to amend the
motion to include as Condition No. 28, a requirment stipulating that a bond will
be posted by the applicant in a sufficient amount to cover the installation of
speed bumps for a two year period ef time. The motion carried by the following
roll call vote:

It was moved by Councilman Kanel to amend the motion to include as a condition a
provision requiring the installation of screening over the second story windows
of the buildings which will face the windows of the Townhouse development, Councilman
Kanel's motion died for a lack of a second.
The conditions for approval of Conditional Use Permit No~ C-254 are as follows

approved plans as modified to provide a mansard roof.

that part of its frontage outside of 30 feet from centerline and annexa-
tion to the City of Cypress. Developer to include all necessary legal
descriptions.
20. That a landscape plan prepared by a registered landscape architect be
submitted to the Planning Commission for approval.
21o That the shake shingles to be used in construction of the building shall
be fire-proo~ and shall be of a type acceptable to the Building Department.
Planting to be used in the landscaping of the development shall be in
general accordance with the rendering.
23. Storage lockers shall be provided in each carport,
Trash areas shall be screened from public view.
25~ Low profile lighting in the area adjacent to Tanglewood shall be so directed
as to shield the Tanglewood area from the glare of lights.
26. Twelve parking spaces shall be identified for guest parking.
27~ Roof equipment shall be screened.
28. The applicant shall be required to post a bond sufficient to cover the
installation of speed bumps for a two year period.
The motion to approve Conditional Use Permit No ~ C-254 subject to the above

C..ONT.IN.UATION OF PUBLIC HEARING RE: AN APPEAL OF THE PLANNING COPMISSION DENI..AL OF
AN APPLICATION FOR AMENEM~T TO THE ZONING ORDINANCE NO~ 90~-ZONE 'CHANGE Z-200: The
Mayor announced this was the time and place for ~he ~ubiiC Hearing ~o ~s'i~e~' an
appeal of the Planning Conxnission denial of an application for an amendment to the
Zoning Ordinance to change the zone of a certain parcel of land from C-2 (General
Commercial) to R-3 (Multiple Family Residential) on property generally located on
the west side of Holder Street, north of Ball Road, Cypress, submitted by Frank J~
Haneman and James Jo Fuchik, property owners.
The Mayor announced that the Public Hearing was open and requested the Staff to
present its reports°
The City Manager advised that the notice of continuation of this Public Hearing
has been posted and that the affidavits of posting, mailing and publication of the
Public Hearing notice are on file in the office of the City Clerk. He then read in
full two communications which the City had received relative to this matter; the
first letter urging the City Council to approve the request for a zone change,
signed by MroFr. ank J, Hangman and Mr. James J. Fuchik; and the second communication
which urged the denial of the zone change request, written by Mr, and Mrs. W. A.
Garringer~ The City Manager then read into the record, a letter from the property
owners requesting the appeal of the Planning Commission denial for the zone change.

The Secreuary to the Planning Comnission than presented a transparency of the subject
property, and reviewed a report dated June 9, 1971 which described the subject
and surromding properties. The report indicated that this identical application
(Zone Change No~ Z-i87) was previously reviewed by the Planning commission and City
Council, at which time the Planning Co~misaion recozmnended approval of the request;
however, it was denied by the City Co~mcil,
Mr. Richard Bradshaw, 2110 E. Katella Avenue, Anaheim, representing the applicants,
addressed the City Council reviewing what had transpired relative to this particular
zone change request. Mr~ Br adohaw indicated that he considered Holder Street to
be a secondary street which does not warrant additional commercial development. He
described the difficulty which existing shops and businesses have had at the subject
location, and stated that there are approximately 15 to 20 acres of property on
Balk Road, currently zoned C-2 and near the subject property, which would be mere
suitable for co~mr~rcial develcpment~ Mr. Bradshaw then read in full, three commonica-
tlons whlzh had been provided to him by the listing broker, all indicating that the
property is not suited for commercial developments He then presented elide pictures
depicting the subject and surrounding property. Mr. Bradshaw indicated that the
owners have tried to develop the property commercially, and it is with reluctance
tha= they have come to the conclusion that a zone change is necessary. He added,
~ha~ he felt an R-3 development would bring in additional revenue to the existing
shopping center, City, and would increase property values° Mr. Bradshew concluded
his presentation by reading two additional letters into the record; the first being
from Sc~tty's Food Center, dated June 14, 1971; and the second communication, dated
June 14, 1971, from Mrs° W. J~ Milsaf; both encouraging the City Council to approve
the zone change.
At the request of Councilman Kanel, Councilman Robarts reviewed his reasons for
acting in favor of the zone change request when this matter was previously before
the City Coumcil~ He indicated that because of the buffer on the north from the
R-i, and the adjacent R-3 on the east, and the ComzBrcial on the south, it Seemed
~o be a reasonable request. Cooncilm~ ~berts further indicated that since there
has not been any improvement in the area, he would still feel the way he did
when the matter was originally discussed.
In response to an inquiry from Councilman Kenode, the Deputy City Attorney advised
that when an application has been denied no new application for the same purpose
shall be filed within six months of the date the previous denial became final, unless
the Planning Commission, for good cause, shall grant permission to do so.
In answer to an inquiry from Councilman Kanel, the Secretary to the Planning Commission
indicated that approximately 136 units could possibly be developed on the property
under review, under the present Urgency Ordinance.
Councilman Kanel then stated that he would like to continue this matter in order
uo allow time for additional consideration°
It was moved by Councilma~ Kanel and seconded by Councilmm~ Kenode to continue the
Public Hearing on this matter to the regular meeting of the City Council scheduled
to be held on July 12, 1971, The motion carried by the following roll call vote:

It was moved by Councilman Lacayo and seconded by Councilman Kanode to adjourn the

The City Manager then indicated that Items No. 4, 7, 10, 15 and 16 on the agenda
might be considered by the City Council at this meeting. Councilman Lacayo withdrew
his motion with the consent of the City Council to consider only those item which
were referred to by the City Manager. Councilman Kenode withdrew his second to
the motion.

In response to an inquiry from Councilman Kanel, =he City ManeSet indicated ~
that those persons whose names appear on this employment list have not previously
passed an em~ioymenu examination, and that those persons who had worked as Maintenance
Aides for the City in ~he past, would not be required to again take the examination.
He stated that there are 10 Maintenance Aide positions which are to be filled° In
response to a further inquiry from Count:imam Kanel, the Public Works Director indicated
the= the majority of the boys which ~he City hired in this capacity last year, were
from the City of Cypress~
The motion was unanimously carried,

It was moved by Councilman Kanel and seconded by Councilmam Kenode to approve
the Mayor's appointment of Mrs° Carol Fry as the City's respresentative to the
Orange County Health Plannin~ Council. The motion was carried by the following
