Minutes 72-04-17MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL April 17, 1972 The adjourned regular meeting of the Cypress City Council was called to order at 7:30 pomo, on Menday, April 17, 1972, in the City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor Robert Harvey presiding. PRESENT: Councilmen Kanel, Kenode, Lacayo, Roberrs and Harvey ABSENT: None Also present were City Manager/City Clerk Dartell Essex, Deputy City Attorney John Murphy and the following members of the City Staff: Dunlap, Bryant and Grissom. Mayor Harvey explained that the purpose of this adjourned regular meeting of the City Council was to meet with the Cypress School District Board of Trustees in order to discuss the possibility of the City's acquiring two sites, which have been declared surplus by the Cypress Elementary School District, for recreation and park purposes. RECESS: Because =he School District Board of Trustees did not as yet have a quorum, Mayor Harvey declared a recess at 7:35 p.m. The meeting was called back to order at 7:48 pomo, with all Councilmen present. The City Manager then reviewed the discussions which have taken place relative to the acquisition of the two sites, one which is located on the southeast corner of Graham Street and Orange Avenue, and the ocher on the northeast corner of MoodF Street and Orange Avenue. Mr o Butler, Assistant Superintendent of Business Services, Cypress Elementary School District, indicated that in the event the surplus school property was not in the process of being sold by July 1, 1972, they would have to be put up for bid. He explained this was necessary in order to lowe~ the tax rate which the School District is now paying, and also to have funds for Capital Outlay purposes° Various means in which the City could finance the acquisition of the sites were discussed, whereas the City Manager indicated that there is the possibility of the City receiving federal funding for a portion of the Graham Street site, however, the earliest the City could receive State indication on this matter would be in September~ In response to an inquiry from Councilman Lacayo, Recreation and Park Commissioner Janet Spur=con addressed the City Council indicating that it was the desire of the Commission that the City pursue the matter insolaf as obtaining estimates for the sites, and to proceed with the acquisition of the Graham Street site. She indicated that it was the feeling of the Commission that the acquisition of the Moody Street site would depend upon the cost of the property. It was then moved by Councilman Roberrs and seconded by Councilman Lacayo, for the purpose of discussion, that the City Council, acting as the ex officio governing Board of Directors of the Cypress Recreation and Park District, determine that the City Council adopt as a policy, a decision to acquire both available surplus sites from the Cypress Elementary School District; and further, that the City Council set aside sufficient matching funds for the acquisition of the Graham Street site under a federal grant program; and further, that if the acquisition of the Graham Street site is delayed due to the federal grant application, that any tax penalties which are imposed upon the School District be reimbursed to the School District by the City. City Council Minutes April 17, 1972 Following further discussion, Councilman Roberrs, at the request of Councilman Lacayo, agreed to delete the third point of his motion. Addressing the City Council in reference to the acquisition of the two sites were the following persons: Mr~ Joe Hardcastle, 4588 Blanca Drive, Cypress Mr~ Karl Mazzeo, 9949 Madrid Circle, Cypress Mro Rae Sanborn, 9462 Lime Circle, Cypress Mrs~ Marshall Ricker, 5092 Evergreen Avenue, Cypress Mro Frank Clark, 9746 Cedar Court, Cypress Mro Richard Langdon, 5102 Evergreen Avenue, Cypress Mro John McCormack, 5682 Elinora Lane, Cypress Following discussion, the motion was unanimously carried by the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Kanel, Kenode, Lacayo, Eoberts and Harvey None None At this time, Mayor Harvey introduced to the City Council and audience, Councilwoman elect, Mrs° Alice Frankiewich. At the request of the City Manager, it was moved by Councilman Roberrs, seconded by Councilman Lacayo and unanimously carried to authorize the City Staff to file a notice of intention relative to an application for a federal grant for funds pertaining to the acquisition of one-half of the surplus school property located on Graham Street° ADJOURNMENT: It was moved by Councilman Kenode, seconded by Councilman Lacayo and unanimously carried to adjourn at 9:35 pomo, to 7:30 p.mo, on April 18, 1972o MAYOR OF THE CITY OF CYPRES?
