The regular meeting of the Cypress City Council was called to order at
4:05 pomo, on Monday, August 14, 1972, in the Cypress City Council Chambers,
5275 Orange Avenue, Cypress, California, Mayor Otto Lacayo presiding.
PRESENT: Councilmen Frankiewich, Roberrs and Lacayo
ABSENT: Councilmen Harvey and Kanel
Also present were Administrative Assistant Douglas Dunlap, Assistant City
Attorney Len }{ampel and the following members of the City Staff: Schatzeder
and Savordo
MINUTES:
It was the general consensus of the City Council to defer the consideration
of the Minutes until such time as all Councilmen are present~
STAFF REPORTS AND DISCUSSIONS:
It was moved by Councilman Roberrs, seconded by Councilwomen Frankiewich and
unanimously carried to place on the agenda at this time, the consideration of
award of contract to purchase an electronic programmable printing calculator~
The Administrative Assistant reviewed a report dated August 14, 1972, from the
Finance Director, which outlined the bids received for the purchase of one
electronic programmable printing celculatoro
It was moved by Councilman Roberrs and seconded by Councilwoman Frankiewich to
determine that the lowest responsible bid was submitted by Monroe Calculator Company~
and to award the contract for the purchase of one electronic programmable calculator
to the Monroe Calculator Company, 2110 E. First Street, Santa Ana, California. The
motion was unanimously carried by the following roll call vote:

EXECUTIVE SESSION
At the request of the Administrative Assistant, Mayor Lacayo declared an
Executive Session at 4:15 p.mo, with the Assistant City Attorney, the City's
Special Counsel Mro Tully Saymore and the Police Chief, to discuss matters of
litigation and personnel.

Addressing the City Council in regards to a dumping problem on property located
on the northeast corner of Orange Avenue and Denni Street, was Mr. Joe Hardcastle,

Mr~ Jim Hardesty, 5853 Holmby Court. Cypress, inquired as to the status of
two signs 1iotated on the Leal Dairy which are in violation of the City's
Ordinance,
Also addressing the City Council, was Mr. Delno Fanode, 5184 Melbourne Drive,
Cypress, who inquired as to the status of the application for federal funds in
connection with the Graham Street park site o
At the request ~,of Mayor Lacayo, it was moved by Councilman Roberrs, seconded by
Councilman Fanel and unanimously carried to place on the ageode for consideration
at this ~ime, an invitation which was received from Sbapell Industries, Inc~,
to tour Westminster Village o
Zt was the general consensus of the City Council to request the Staff to schedule
the tour for Saturday morning, August 26, 1972o
MINUTES
It was moved by Councilman Roberrs, seconded by Councilman Fanel and unanimously
carried to approve the Minutes of July 5, 1972, as presented°
Councilman Roberrs requested that the motion to reconsider the previous action of
the City Council which terminated the proceedings for the granting of the CATV
franchise, on page 8 of the July 10, 1972 Minutes, to read as follows: "It was
moved by Councilman Roberrs, although he opposed the reconsidersrico, and seconded
by Councilman Fanel to reconsider ....... "
At the request of Councilman Harvey, and to which Councilman Roberrs agreed, the fcu=th
paragraph from the bcttom of page 7 of the July 10, 1972 Minutes was amended to read
as fcllcws: "Councilman Roberrs, for the record, stated that he was a member of the
committee which discussed the installation of cable television because no other
Councilman was available to attendo"
It was then moved by Councilman Harvey, seconded by Councilman Fanel and unanimously__

Item No. 9: Consideration of acceptance of imprevements and release of bonds for
Tract No. 7123.
Recommendation: That the City Council accept the public improvements in Tract
No. 7123 as being satisfactorily completed in accordance with plans and specifications
and authorize the City Clerk to release the Monumentetton Bond and the Labor end
Materials Bond upon expiration of their required lien periods providing no mechanic A
liens are filed, with the Performance Bond to be held for one year from the date
of acceptance to guarantee against any defects in material or workmanship.

Mayor Lacayo declared a recess at 7:58 p.m. The meeting was called back to order
at 8:00 p.m., with all Councilmen present.
PUBLIC HEARING RE: CONSIDERATION OF AN AMENDMENT TO THE ZONING ORDINANCE
REGARDING APPEALS OFPLANNING COMMISaIONACTIONSTO T~E CITY COUNCIL: The Mayor
announced this was the time and place to consider an amendment to the Zoning
Ordinance of the City of Cypress regarding appeals of Planning Commission
actions to the City Council.
The Mayor declared the Public HearinS open, and requested the Staff to present
its report.
The Administrative Assistant presented a report dated August 8, 1972, from the
Secretary of the Planning Commission, which advised that the affidavits of posting
and publication of the Public Hearing notices are on file in the office of the
City Clerk, and that no communications have been received in reference to this
application for an amendment to the Zoning Ordinance.
Following considerable discussion concerning the amendment which would allow an
individual councilmen the opportunity to appeal any decision made by the
Planning Commission to the City Council with a waiver of the appeal fee, it was
moved by Councilman Harvey, seconded by CouncilmAn Roberrs and unanimously carried
to close the Public Hearing.
It was moved by Councilmen Robarts, seconded by Councilmen HArvey and unanimously
carried to read the following Ordinance by title only, title as follows:

Assistant presented a report dated August 8, 1972, which advised that this
item was continued from the July 24, 1972 City Council meeting~
It was moved by Councilman Roberrs and seconded by Councilman Kanel to continue
the consideration of this item to the next regular meeting of the City Council,
scheduled to be held on August 28, 1972o
Following a brief discussion, it was moved by Councilman Roberrs, seconded
by Councilman Kanel and unanimously carried to table this matter°
CONTINUATION OF CONSIDERATION OF A RESOLUTION OF THE CITY OF HUNTINGTON BEACH
PROMOTING THE WELL-BEINGOF THE HANDiCAppED: The Administrative Assistant
reviewed a report dated August 8, 1972, which indicated that this matter was
continued from the meeting of July 24~ 1972 in order for =he City Council to
obtain additional informetion~
Following a summary by Councilman Harvey of the opinion expressed at the League
of California Cities~ meeting relative to this matter, it was moved by Councilman
Roberrs, seconded by Mayor Lacayo and unanimously carried to receive and file
the Resolution from the City of Huntington Beach, and to instruct the Staff to
consider the possibility of contacting those organizations which are attempting
to place handicapped persons in various positions, where part-time employment
with the City might be required.

Assistant presented a report dated August 9, 1972, which summarized several
questions and answers which had been raised by the City Council at its meezing

carried to continue the consideration of this item to the next regular meeting

CONIINUArION OF CONSIDEKATION OF COMPLAINT REGARDING OFF-SET IN LOT LINE BETWEEN
TRACT #7581 AND TRACT #4102= The Administrative Assistant presented a report
dated August 9, 1972, which indicated that as requested by the Council at its
meeting of July 24, 1972, the possibility of a cost sharing plan for a block
wall with both the homeowners in Tract #4102 and the developer of Tract #7581 is
being investigated°
It was moved by Councilman Roberrs, seconded by Councilman Fanel and unanimously

of the City Council, and to instruct the Staff to discuss this matter further
with the property owners as outlined in the report~
CONSIDERATION OF RIGHT OF WAY CERTIFICATION~ APPROVAL OF PLANS AND SPECIFICATIONS

The Administrative Assistant presented a report dated August 9, 1972, from the
Public Works Director, which indicated that this proJ oct, which consists of
reconstruction of Crescent Avenue from Moody Street to the Los Angeles County
line, has been delayed for some time by the right of way difficulties encountered
by the County of Orange and the City of La Palmao
It was moved by Councilman Roberrs and seconded by Councilman Fanel to approve
the plans and specifications for construction of Crescent Avenue Street Improvement
Project #7203-10-0598, and authorize the City Clerk to advertise for bids with
bid date to be set after receipt of approval of the Orange County Road Department°

CONSIDERATION OF CYPRESS LIGHTING DISTRICT NO. 2-COUNTY AUDITOR'S REQUEST: The
Administrative Assistant presented a report dated August 9, 1972, from the
Public Works Director which indicated that because of an error in Resolution
#1277, a Resolution has been prepared which rescinds the Resolution and correctly
lists the required levying of assessments on parcels of land and incorporates the
changes requested by the County Auditor's officeo
It was moved by Councilman Roberrs and seconded by Councilman Kanel to adopt the

CONSIDERATION OF A COMMUNICATION FROM THE COUNTY OF ORANGE RELATIVE TO A COUNTY
USE PERMIT IN THEVICINITYOFGAYSTREET: The Administrative Assistant reviewed
a report dated August 8, 1972, from the Secretary of the Planning Commission, which
advised that the City has received a copy of an application for a use permit
for the establishment of a commercial stable for a maximum of 40 horses in the
County A-1 district, General Agricultural°
Following a discussion concerning this matter, it was moved by Councilman Robarts
to table the item° Councilman Roberrs' motion died for a lack of a seccnd~
It was then moved by Councilman Harvey and seconded by Councilman RAnel that the
City notify the County of Orange of the City's opposition to the use permit for
the establishment of a commercial stable in the vicinity of Gay Street, as it
was felt that this use would not be compatible with the surrounding residential
areas located in Cypress° The motion carried by the following roll call vote;

CONSIDERATION OF INFORMATIONAL REPORT REGARDING THE PROPOSED CHINO HILLS AIRPORT:
The Administrative Assistant presented a report dated August 8, 1972, which indicated
that the City Council, at its meeting of July 24, 1972, requested additional
information relative to the proposed Chino Hills Airport and information regarding
a committee ~nich was formed by the concerned cities of Ycrba Linda, Placentis,
Brea and La Habrao
Iu was moved by Councilman Roberrs and seconded by Councilwoman Frankiewich to
direct the Staff to further investigate the feasibility of a reciprocal approach
for opposing the Chino Hills Airport site and the aviation activities at the
Los Alamitos Naval Air Station; and further, that the City Council be informed
as to any technical information or presentations regarding the proposed Chino
Hills Airport° The motion was unanimously carried by the following roll call

dated August 9, 1972, which indicated that on Tuesday, August 8, 1972, the
Administ'raulve Coordinating Teem adopted the final response to the Environmental
Impac~ S~c~ement on the Naval Air Station, Los Alamitoso
It was moved by Councilman Harvey and seconded by Councilman Fanel to adopt the
Administrative Coordinating Team's report as the official City of Cypress response
to the draft Environmental impact Statement and to authorize the Staff to txanemiu

dated July 19, 1972, from the Recreation and Park Director, which outlined
the recommendations of the Recreation and Park Commission relative to this matter°

amend the Cypress City Code, Chapter 2, Article VI, Section 2-43, to state that

member of "
Following discussion, it was moved by Mayor Lacayo and seconded by Councilman
RoberUe, as a substitute motion, to amend the Cypress City Code, Chapter 2,
Article VI, Section 2-43, to state that" ..... An elected representative from
the Cypress Teen Center shall, without appointment by the Mayor, be an
ex officio member of ...... " The motion was unanimously carried by the following

CONSIDERATION OF ADOPTION OF THE CYPRESS RECREATION AND PARK DISTRICT TAX RATE
FOR FISCAL YEAR 1972-73: The Administrative Assistant reviewed a report dated
August 9, 1972~ which advised that the County Auditor's Office has requested
that the Cypress Recreation and Park District tax rate for the 1972-73 fiscal
year be established and submitted to his office by August 15, 1972o
It was m,oved by Councilman Harvey and seconded by Councilman Kanel to establish
the Cypress Recreation and Park District tax rate at 48°5¢ for the general
purposes of the District, and 1o5¢ for the repayment of the Debt Service, for
a to~al tax rate of 50¢ per $100o00 assessed valuation for the 1972-73 fiscal
year~ The motion was unanimously carried by the following roll call vote:

1715 (CYPRESS RECREATION AND PARK DISTRICT): It was moved by Councilman Roberrs
and seconded by Councilwoman Frankiewich to approve the Commercial Warrant List
for the Cypress Recreation and Park District for Warrants Noo 1661 through 1715
in the ~o~aI amount of $58,373,63° The motion was unanimously carried by the

carried =o place on the agenda for consideration at this time, a request of
Councilman Schmit of Garden Grove, for a Councilman to serve on the Orange
County Airport Land Use Commission as his alternate°
It was moved by Councilman Harvey and seconded by Councilman Kanel to recommend
that Councilwoman Prankiewich be considered as the alternate to Councilman Schmit
to serve on the Airport Land Use Commission°

City Council Minutes
August 14, 1972
Addressing the City Council concerning the method of appointing an alternate
to the Airport Land Use Commission, was Commander Howard Rowan, Los Alemites
Naval Air Station, Los Alemites, California.
The me=ion was unanimously carried.
It was then moved by Councilman Harvey, seconded by Councilman Roberrs and
unanimously carried to place on the agende at this time, the consideration of
Resolution Nee 1271, which requests the support of the Orange County Division of
the League of California Cities in petitioning the state legislature to either
alter the powers of the Orange County Airport Land Use Commission to be advisory
only, or to abolish the Orange County Airport Land Use Commission°
It was moved by Councilman Harvey, seconded by Councilman Roberrs and unanimously
carried that the City transmit Resolution Nee 1271 to the State convention of
the California League of Cities along with a cover letter explainling
the nature of the vote at the recent League meeting, and that both Councilmen
Harvey and Roberrs be contacted in order to review the contents of the letter
when it has been drafted°
It was moved by Councilman Roberts, seconded by Councilwoman Frankiewich and
unanimously carried to place on the agenda, the consideration of a Joint meeting
with the Planning Commission°
It was moved by Councilman Roberrs, seconded by Councilwoman Frankiewich and
unanimously carried to schedule a Joint meeting with the Planning Commission
at 4:00 pomo, on Monday, September 11, 1972.
It was moved by Councilman Roberrs, seconded by Councilman Harvey and unanimously
carried to place cn the agenda, prior to this evening's adjournment, an Executive
Session to discuss a matter of personnel.
